I checked with Michael Shepherd (see email below) and the excel spreadsheet and instructions regarding the closure plan are attached. You/Wilbur will also need waste samples of the liquid and the solids to complete the closure plan. After the closure is finished, the Closure Report Form will need to be completed, signed by a tech specialist, and submitted to us (DWR). Before we would allow the permit to be rescinded ("come of the list")though, all the current environmental concerns need to be addressed. The stream banks are/were in bad shape with all the cattle traffic. Even though the dairy cattle have been sold, I suspect Wilbur or someone will eventually come back with beef cows or something. I'd say about 80`Yo of folks do this so I would want to make sure everything was addressed so he didn't get into trouble in the future. However, considering his location, he might be selling to a developer so the stream concerns might be a moot point. Do you know his future plans? ****Just FYI: If and when the land is sold, realtors and banks are VERY interested know if all closure procedures and forms were documented correctly---from a liability standpoint. Take photos of the bottom of the waste pond showing that all the waste solids were removed prior to pushing in the dam. We would do a sludge survey and calculations to get both volume estimates and waste samples of both liquid and solids then develop a closure plan. Once all the liquid and solid waste is removed and verified then dam is breached and pipes removed. Once all is completed a tech specialist and/or PE will fill out a sign off the closure on the DWR form. It sounds like from Wally's email all the liquid is removed so the solids calculations may be harder unless there is a good set of as built drawing of the pond. They will need a trackhoe to remove the solids without any liquid to agitate and will have to the spread with a side Slinger raising the cost. Hope this helps. He sold his cows back in September. He has his lagoon pumped out and he says there is very little sludge left in the lagoon. He has contacted the office to find out what steps he needs to take to close his lagoon. He is not receiving any cost share money for the closure and I just wanted to touch base with you to see if there was anything that the State would require that he would 2 / need to include when he closes his lagoon, besides grading for proper drainage and establishing a good grass cover to prevent erosion. A `final' copy of the inspection report is enclosed for your review. During the inspection, Mr. Robinson observed the following: Violations and Concerns 1) Woody vegetation on the embankment of the waste storage pond had not been maintained as was noted in previous inspections {see 2015 compliance inspection) Per Section 11.12. of the permit "Trees, shrubs, and other woody vegetation shall not be allowed to grow on the lagoon/storage pond embankment." 2) Failure to report inadequate freeboard as required per section I11.13. of the permit "The permittee shall report by telephone to the appropriate Division Regional Office as soon as possible, but in no case more than twenty-four (24) hours following first knowledge of the occurrence of any of the following events: Failure to maintain waste level in lagoon/storage pond below that of the designed structural freeboard (twelve (12) inches from top of dam or as specified in lagoon/storage pond design). Not that this notification is in addition to the report required by Condition 111.13.e above." Upon review of the permittees records, a freeboard of only twelve (12) inches was recorded on March 1, 2016, when the designed freeboard for that waste storage pond is twenty-six (26) inches. No report was called in to the Winston-Salem Regional Office in response to this event. Failure to limit cattle access and/or provide an adequate buffer along the stream increases the potential for future violations of the NC stream standards for fecal coliform, dissolved oxygen, and turbidity. Corrective Actions: 1) All woody vegetation on the waste pond embankment must be cut within thirty (30) days. 2) For future incidents involving inadequate freeboard, please notify the Winston-Salem Regional Office within twenty-four (24) hours of the event at (336)-776-9800. 3) We strongly suggest installing rip rap in large drainage ways or a stream crossing where the trail crosses the creak in order to mitigate impacts to surface waters. Limiting the amount of contact cattle have with surface waters will decrease the risk of impact to water quality and consequently potential compliance issues. A follow-up inspection will need to be conducted to determine the quality of the stream and to assess corrective actions taken in response to this violation. While most animal waste operations appeared to be in order, there are other concerns that require your immediate attention and action. Specifically, Ms. Rosebrock noted that a soil analysis had not been obtained for those. fields that received animal waste in 2003. As discussed during the inspection, failure to have complete records is a violation of North Carolina General Statute 143-215.10C and your Animal Waste Management Permit. A reminder that a representative Standard Soil and Fertility Analysis, including pH, copper, and zinc, still needs to be obtained for those fields receiving animal waste during 2004. Per the dairy waste permit, the results of any waste or soil tests are to be maintained for three years. While conducting the onsite inspection, staff also observed that at least 900 feet of stream was impacted with sediment and waste run-off due to cattle traffic. The single strand of barb- wire, installed as a result of last year's compliance inspection, does not appear to be excluding the cattle adequately. As discussed with staff, additional exclusion must be installed within 30 days. We encourage your continued cooperation with the Alamance SWCD/NRCS regarding a permanent solution to this situation. Please be.advised that North Carolina General Statutes provide for penalties of up to $25,000 per day per violation as well as criminal penalties for violations of state environmental laws and regulations. Additionally, Ms. Rosebrock documented that you are using the plant available nitrogen (PAN) rate of 255 lbs./acre in calculating the PAN balance for strip-cropped cool season grass hay in T-1779 F-14. While this rate may be feasible, it 'is not listed in your Certified Animal Waste Management Plan (CAWMP). Please contact you technical specialist to have this field added to the appropriate chart. Be advised that failure to abide by the CAWMP is a violation of Section V. #5 of the cattle waste permit. While most farming operations appeared to be in excellent condition, there are other concerns that warrant your attention. Specifically, Ms. Rosebrock noted that animal and parlor waste were washing from the concrete lot into ' a fresh water drainage ditch at the corner of the barn lot. While the discharge of waste from the lot was not reaching waters of the State on the date of the inspection, the potential certainly exists for a discharge to waters in the future, particularly during rain events and/or if conditions deteriorate further. To eliminate the possibility of any type of waste getting into surface waters of the State we recommend that you contact the Alamance County SWCD/NRCS at 336.226.0477 ext.3 for assistance and suggestions regarding curbing, guttering, etc. Please respond, in writing, to this office within 30 days of receipt of this Notice, outlining your plans for addressing the above discharge problem and when you anticipate the repairs to be completed. Also note that this waste discharge concern was described in your 2000 DWQ Compliance Inspection report as well. Additionally, Tract-1779 Field-14 is strip cropped with orchardgrass, hay, corn, and sorghum while the Certified Animal Waste Management Plan (CAWMP) lists this field as non-strip cropped. Land on fields F-12 and F-4 has also been cleared which changes the overall acreage. Please contact your technical specialist to have your CAWMP revised to reflect these changes. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLUR1, SLUR2, SLD1, and SLD2) and maintained in the facility records for review. Specifically, the inspection was conducted to determine the status of your compliance with Title 15 A, North Carolina Administrative Code 2H .0200 regulations, which qovern wastewater disposal systems which do not discharge to surface waters of the State. Animal waste management systems which comply with the .0200 regulations are "deemed permitted" by the Division, and thus, are not required to apply for individual permits for operation. The primary factor in assessing compliance with the regulations is whether or not a discharge of pollutants occurs from the facilities (in your case a lagoon) during any rain event less severe than a 25 year storm. A 25 year storm is a storm of such severity, that it can statistically be expected to recur once every 25 years. A 25 year storm in Yadkin County would amount to any rainfall 6 inches or greater within a 24 hour period. You should be aware, however, that because the weather data used to compile what is a 25 year storm covers many years, it is possible to experience 25 year storms on two consecutive days. Likewise, you could receive 5 inches of rain one day, and 5 inches the next, and neither would constitute a 25 year storm, so you would need at least 10 inches of freeboard to prevent a discharge. At the time of the inspection, it was noted that your lagoon was full with practically no freeboard. The general recommendation for lagoon operators is to maintain at least 18 inches of freeboard in a lagoon (1 foot plus the 6 inches from the 25 year storm) . Should a discharge from your lagoon occur, you could have fines imposed upon you in the amount of $10 ,000 .00 per day for each day the discharge occurs. You could lose your "deemed permitted" status, requiring submittal of an individual nondischarge permit application to DEM, or requiring you to qet an approved animal waste management plan prior to the mandatory December 31 , 1997 deadline for animal waste management plans.
