It wasn't that the leachate was over-topping the ditch but rather that the leachate flow had broken through the ditch. It was in the area of thick brush. I have also dipped some of the sediment out to help it from spilling over. I can't reach far enough with my backhoe to get all of it out. I have contacted someone with a trackhoe with more reach and help repair the ditck bank. The ditch is not repaired yet but I can keep the leachate lowered so it doesn't spill over the ditch. The Animal Waste Management Permit (Section 111. No. 13) states that the "Permittee shall report by telephone to the appropriate Division Regional Office as soon as possible, but in no case more than twenty-four (24) hours following first knowledge of the...failure to maintain storage capacity in a lagoon/storage pond greater than or equal to that required in...this General Permit." We appreciate the fact that you reported the problem of high waste level as required by your permit and have worked with our staff to manage the problem once it occurred. While we recognize the extraordinary weather conditions existing at the time, the lack of adequate freeboard reported to our office still represents non-compliance with the Certificate of Coverage issued to your facility. As you are aware, this non-compliance is subject to appropriate enforcement action by DWQ, The factors that lead to non-compliance, efforts to notify DWQ of the problem, efforts made to resolve the problem once identified, and efforts proposed to prevent future problems have all been factors in our decision regarding enforcement. Upon review and consideration of the information submitted and/or discussed with DWQ staff, the Winston-Salem Regional Office has determined that a Notice of Deficiency (NOD) is'appropriate and that no further compliance/enforcement actions will be taken by the Division for the high waste levels occurring between October 2009 and March 2010. Additional information is required before we can continue our review. Please address the following by October 8, 1999: 1. According to the permit application and Waste Utilization Plan (WUP),there are 225 dairy cows on the farm. However,the facility is only certified for 122 dairy cows. Please contact your technical specialist regarding the recertification of your facility. If your facility has already been recertified, then a copy of the Certified Animal Waste Management Plan(CAWMP)'must be submitted. • 2. The waste storage pond design documentation states that there is 162 days of temporary storage and the WUP states that there is only 108 days of temporary storage in the waste storage pond. It appears that the correct number of days of storage is less than 162 for the number of animals at the facility(225 dairy cows). Please clarify the number of days of storage that is available in the waste storage pond. 3. When utilizing soybeans in a crop rotation,residual nitrogen should be accounted for in the following crop. It appears that the nitrogen residual from soybeans is not accounted for in the Waste Utilization Plan(WUP) submitted. Please contact your technical specialist to review your Waste Utilization Plan(WUP)and revise the WUP to account for residual nitrogen from soybeans, if necessary. 4. The application windows for the soybeans appear to be outside of the current recommendations for application windows for these two crops. Current guidance states that the application window for soybeans should be from July through September. 5. The WUP submitted calculates the amount of nitrogen produced in one year. However, it appears that the WUP uses a two-year crop rotation. Your WUP should be revised so that the nitrogen produced and the nitrogen utilized by crops is calculated for the same time period. Some options for revising the WUP include: calculating the amount of nitrogen produced for a two-year period of time,revising your WUP to show waste utilization for Year One and Year Two of the two-year rotation in separate tables, or showing a two-year crop rotation with corn and soybeans on half the acreage from each field. 6. Your Waste Utilization Plan(WUP) lists the acreage on Tract 2861, field 6 as 6acres. This is higher than currently recommended. Please contact your technical specialist to revise the Waste Utilization Plan or provide justification that supports the increased yield as shown in the current WUP.
