Here are some suggestions: 1. Statements that you have been pumping for xx many weeks and are now XX many inches below the maximum liquid mark. 2. How do you propose to ensure that the waste level stays legal in the future?Any new or newly repaired equipment?Change in application schedule?A complete pump out planned in the spring? Any leaking drinkers or gutters to be repaired, etc. 3. Is there anything you have done or plan to do to remind yourself(or someone else)to take waste samples?Same question apply to recording waste levels each week.Anything you plan to do different to remind/ensure that levels are recorded? 4. When will/have you removed the concrete bags from the spillway and repair and re-seed the area? While our office is aware of the farrn's waste equipment issues and sensitive to the financial concerns related to the dairy industry, we must notify you of the animal waste violations observed during the inspection. A "final copy" of the inspection report is attached for your review. Violations 1. DWR was previously aware of waste storage issues at Covington Dairy, Inc. and on November 15, 2017 DWR staff observed that waste from the storage structure was into the - spillway. Per discussion that day with Operator in Charge (01C) Mr. Michael Lee, there had been recent waste application equipment repair problems. Land application was to resume that afternoon. Our records indicate that Mr. Lee kept our office updated in writing regarding waste application progress and additional equipment problems. Waste levels were again compliant by December 7, 2017. However, the exceedance of the maximum waste level above that specified in the Covington Dairy, Inc. Certified Animal Waste Management Plan (CAWMP) is a violation of Cattle Waste Management System General Permit (permit) condition V. 2. 2. Onsite waste management records also indicate that several months of waste level records (freeboard) were missing since the last inspection. The permit also requires that a representative sample of the animal waste be obtained within 60-days (before or after) the date of application. Records indicate that some of the waste applications during Fall 2016 and Summer 2017 were outside the 60-day window. This is a violation of Section III.5. of the permit. Other Concerns: As discussed with DWR staff during the November 15, 2017 inspection, all concrete bags must be removed from the spillway of the waste storage structure. While our office appreciates that the bags were used to slow the flow of waste during the emergency situation, they must now be permanently removed and the spillway re-seeded if necessary. It may also be necessary to revise the CAWMP once potential land sales are final. If this land is sold, please contact your technical specialist with the Alamance Soil and Water Conservation District(SWCD) to adjust the available application fields listed in the CAWMP. Additionally, you may need to request that the permitted animal numbers be revised if necessary. At some point Michael will need to talk with you all about revising his waste plan to remove those fields.That would be a good time for any new fields, crops, etc. to be added if needed as well. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sludges/residuals,and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLUR1, SLUR2, SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality(DWQ) compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an appropriate enforcement action.
