Yes, as long as you address the concerns in the NOV letter
in writing. Here are some suggestions:
1. Statements that you have been pumping for xx many weeks and are now XX many inches below the maximum liquid mark.
2. How do you propose to ensure that the waste level stays legal in the future?Any new or newly repaired equipment?Change
in application schedule?A complete pump out planned in the spring? Any leaking drinkers or gutters to be repaired, etc.
3. Is there anything you have done or plan to do to remind yourself(or someone else)to take waste samples?Same question
apply to recording waste levels each week.Anything you plan to do different to remind/ensure that levels are recorded?
4. When will/have you removed the concrete bags from the spillway and repair and re-seed the area?

This Notice is a follow-up to the routine Compliance Inspection conducted by Division of Water
Resources (DWR) staff on November 15, 2017. While our office is aware of the farrn's waste
equipment issues and sensitive to the financial concerns related to the dairy industry, we must
notify you of the animal waste violations observed during the inspection. A "final copy" of the
inspection report is attached for your review.
Violations
1. DWR was previously aware of waste storage issues at Covington Dairy, Inc. and on
November 15, 2017 DWR staff observed that waste from the storage structure was into the -
spillway. Per discussion that day with Operator in Charge (01C) Mr. Michael Lee, there had
been recent waste application equipment repair problems. Land application was to resume
that afternoon. Our records indicate that Mr. Lee kept our office updated in writing regarding
waste application progress and additional equipment problems. Waste levels were again
compliant by December 7, 2017. However, the exceedance of the maximum waste level
above that specified in the Covington Dairy, Inc. Certified Animal Waste Management
Plan (CAWMP) is a violation of Cattle Waste Management System General Permit
(permit) condition V. 2.
2. Onsite waste management records also indicate that several months of waste level records
(freeboard) were missing since the last inspection. The failure to record weekly freeboard
is a violation of permit condition III.2.a.

3. The permit also requires that a representative sample of the animal waste be obtained within
60-days (before or after) the date of application. Records indicate that some of the waste
applications during Fall 2016 and Summer 2017 were outside the 60-day window. This is a
violation of Section III.5. of the permit.
Other Concerns:
As discussed with DWR staff during the November 15, 2017 inspection, all concrete bags must
be removed from the spillway of the waste storage structure. While our office appreciates that
the bags were used to slow the flow of waste during the emergency situation, they must now be
permanently removed and the spillway re-seeded if necessary.
It may also be necessary to revise the CAWMP once potential land sales are final. If this land is
sold, please contact your technical specialist with the Alamance Soil and Water Conservation
District(SWCD) to adjust the available application fields listed in the CAWMP. Additionally,
you may need to request that the permitted animal numbers be revised if necessary.

take, to address the violations and concerns listed above, both now and in the future. Your

I also discussed House Bill 74 (passed in 2013) which allows a cattle operation to have their permit rescinded if
they have <100 cattle for three years or more. Once it's rescinded, an operation would be considered "new" if
they ever wanted to have more than 100 cattle in the future. That means they and the structure would have to
meet NRCS standards at the time the farm decides to have more than 100 cattle.
As always, there is always closure of the WSP then request that the permit be rescinded. I suggested Michael
discuss any technical and financial assistance with your office.
I am copying Jeff Robinson on this since Alamance is now his county as far as inspections go. Let me know if

The Waste Utilization table shown below summarizes the waste utilization plan for this operation. This plan provides an estimate of the number of acres of cropland needed to use
the nutrients being produced. The plan requires consideration of the realistic yields of the crops to be grown,their nutrient requirements,and proper timing of applications to
maxinlize nutrient uptake. `
This table provides an estimate of the amount of nitrogen required by ilia crop being grown and an estimate of the nitrogen amount being supplied by manure or other by-products,

During the Fall or Winter of 2009-2010, a representative of your animal operation informed the
Division of Water Quality (DWQ) Winston-Salem Regional Office that there was inadequate freeboard in
the waste pond(s) or lagoon(s) serving the facility. The Animal Waste Management Permit (Section Ill. No.
13) states that the "Permittee shall report by telephone to the appropriate Division Regional Office as soon
as possible, but in no case more than twenty-four (24) hours following first knowledge of the...failure to
maintain storage capacity in a lagoon/storage pond greater than or equal to that-required in...this General
Permit." We appreciate the fact that you reported the problem of high waste level as required by your
permit and have worked with our staff to manage the problem once it occurred.
While we recognize the extraordinary weather conditions existing at the time, the lack of adequate
freeboard reported to our office still represents non-compliance with the Certificate of Coverage issued to
your facility. As you are aware, this non-compliance is subject to appropriate enforcement action by DWQ.
The factors that lead to non-compliance, efforts to notify DWQ of the problem, efforts made to resolve the
problem once identified, and efforts proposed to prevent future problems have all been factors in our
decision regarding enforcement. Upon review and consideration of the information submitted and/or
discussed with DWQ staff, the Winston-Salem Regional Office has determined that a Notice of Deficiency
(NOD) is appropriate and that no further compliance/enforcement actions will be taken by the Division for
the high waste levels occurring between October 2009 and March 2010.
In the future, please continue to evaluate ways to maintain freeboard levels in the required range.
This may include, but is not limited to, water conservation practices, adding additional application sites,
updating your cropping systems, adding additional and 1 or more flexible application equipment, and main-

Dear Mr. Covington:
On February 19, 2004 Melissa Rosebrock of the Division of Water Quality's Winston-
Salem Regional Office (DWQ-WSRO) performed a compliance inspection at your dairy farm in
Alamance County. A "Final Notes" copy of the inspection is attached for your records. In
reviewing the on-farm records pertaining to animal waste application, several violations were
documented which require your immediate attention and action:
• Animal waste was applied to three fields that did not have a vegetative cover
during the Fall of 2003 (T-3437 F-3A, T-3423 F-2, and T-9694 F-19). Failure
to maintain a vegetative cover on all land application fields and buffers in
F. accordance with the Certified Animal Waste Management Plan (CAWMP)
is a violation of Section IL #2 of the Cattle Waste Operation General
Permit. Future cropping systems should be managed so that adequate land
application sites are available at all times. Please contact the Alamance
SWCD at 336. 226.0477_ext. 3 should you need any technical assistance.
• Waste levels in the storage pond were only recorded one to two times per
month. Per the permit, levels are to be recorded weekly (Section III. #2).
• Waste applied to Tract-3458 F-1 during September 2003 did not have an
accompanying waste analysis performed within 60 days of application. The
Permit states that an analysis of the animal waste shall be conducted as
close to the time of application as practical and at least within 60 days of the
date of application (section IIL #4). A review of our files indicates that this
was previously brought to your attention during last year's compliance
inspection.

During the recent inspection you also stated that animal waste is to be applied and corn
planted in T-3437 F-3A and T-3423 F-2. Since these fields are not listed in your CAWMP under
"Corn," they should be added to the plan as soon as possible. Please be advised that the permit
states that no waste may be applied upon fields not included in the CAWMP (Section ]L #2).
Please contact Mr. Phil Ross with the Alamance SWCD/NRCS for assistance regarding your
CAWMP.

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals,and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLUR1, SLUR2,
SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality(DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.
