This permit, issued on November 21, 2005 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) Unless specifically altered herein, this permit authorizes the relocation the two 11.5 ft. x 12 ft. boatlifts, the addition of the 6 ft. x 25 ft. floating dock creating two additional docking spaces, the reduction in length of the existing pier from 115 ft. to 90 ft., the relocation and dimensional changes of the gazebo and the creation of the associated deck, and the removal of the 6 ft. x 18 ft. floating dock, all as expressly and specifically set forth in the permit application and attached workplan drawings. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures shall be conducted on, in or over public trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit shall be accessible on-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. This prohibition sb_all be appliccl and cirf'orced throughout the entire existence of the permitted structure. 3) The docking facility and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the property owner's riparian access corridor located to the northeast, which is determined by drawing a line parallel to the channel, or deep water, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 4) No portion of the authorized structure shall extend beyond the town of Wrightsville Beach pierhead line. 5) Because of the proximity to the northeastern most property owner and to ensure compliance with Conditions No. 3 and 4, an as-built survey shall be performed of the docking facilities, and a copy of the survey provided to the Division of Coastal Management, within 60 days of completion of construction of these portions of the project. 6) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 7) The roof of the gazebo shall not be designed for second story use. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 9) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. The permittee shall not hold the State of North Carolina or the United States liable for any damage to the structure or moored boats. The addition of tic piles shall require modification of this permit. General 13) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. 14) No vegetated wetlands or open waters shall be excavated or filled, even temporarily, without permit modification. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non-water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: Should the adjacent property to the southwest be sold prior to the initiation of construction, the permittee shall be required to obtain a signed riparian corridor waiver from the new property owner prior to the placement of any structures within the 15 foot riparian corridor. NOTE: The U.S. Army Corps of Engineers authorized the proposed project under General Permit No. 197800056 (COE Action Id. PROJECT SUMI IARY: The applicant proposes to reconfigure an existing pier, gazebo, floating dock and boat lifts to allow the construction of an additional floating dock. O.H. Parrish Page 2 9. PROJECT DESCRIPTION: The project site is located at 202 Waynick Blvd., adjacent to Banks Channel located at the southern end of Wrightsville Beach, between the Atlantic Ocean and Greenville Sound. The site is located in the Town of Wrightsville Beach, in New Hanover County. The lot is approximately 0.06 acre with 50' of shoreline frontage. The lot averages 3'-5'above mean sea level and the shoreline is stabilized by a retaining wall. Waterward of the retaining wall is an intertidal beach area approximately 10' wide. The applicant maintains a single-family residence on the property and vegetation consists of lawn grasses and landscape shrubs. There is an existing private pier (6'x 115% with an associated gazebo, floating docks and boatlifts located at the subject property, which extends into Banks Channel in a westerly direction. The pier terminates in a gazebo (16' x 20'), which then leads to a floating dock (6' x 30') accessed by a gangway. The floating dock is in alignment with the pier and runs from east to west, perpendicular to the shoreline. There are two existing boatlifts (12' x 12') located on each side of the floating dock. There is also an existing floating dock (8' x 16') located on the northern side of the fixed pier, just landward of the gazebo. The pier and floating docks currently provide docking space for three (3) vessels, and are landward of the established Wrightsville Beach Pier head Line. The Wrightsville Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Banks Channel, which are included in the Wrightsville Recreational Area, are classified SB9 by the N.C. Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of sliellfisli. The applicant proposes to reconfigure an existing pier, gazebo, floating dock and boatlifts to allow the construction of an additional floating dock. The existing pier would be reduced by 25' to a final project dimension of 6' x 90'. The existing gazebo would be then be relocated at the terminal end of the reduced pier. The gazebo would provide access to the new floating dock (6' x 25'), which would be constructed between the gazebo and the existing 6'x 30' floating dock. The existing 6' x 30' floating dock would remain within its existing location and alignment. The existing two boatlifts (12' x 12') would be relocated approximately 12' towards the west on each side and at the terminal end of existing floating dock. The applicant states that the existing 8' x 16' floating dock located at the northern side of pier would be removed and not incorporated into the new configuration. The proposed docking system would provide dockage/storage space for up to four vessels. According to the work plat drawings and application forms provided by the applicant's agent, the proposed structure would be located within the applicant's established area of riparian access, and would not extend beyond the established pier head line. The agent states that the existing water depth at the location of the proposed floating docks is -6' at mean low water (MLW). 10. ANTICIPATED IMPACTS The proposed pier, gazebo and floating dock would incorporate an additional 1478 sq. ft. of Estuarine Waters and Public Trust Area. The proposed structure would be consistent with the Town of Wrightsville Beach Pier Head Line and can be built with in the applicant's area of riparian access. The Applicant has received a waiver from the adjacent riparian property owner to the south to allow encroachment into the riparian corridor 15' setback.
