Charles S_ Wooten, Jr. owns and operates Bear Ridge Farm, a swine operation located along NC Highway 50 in Pender County. B. Charles S. Wooten, Jr. was issued Certificate of Coverage AWS710069 under General Permit AWG100000 for Bear Ridge Farm on May 29, 1998, effective May 29, 1998, with an expiration date of December 31, 2001. This permit does not allow the discharge of waste to waters of the State. C. On April 13, 2000, DWQ staff observed a discharge of wastewater by Bear Ridge Farm from a sprayfield via a ditch to Angola Creek, which are Class C Sw waters of the State within the Cape Fear River Basin. D. Charles S. Wooten, Jr. had no valid permit for the above -described activity. E. DWQ staff estimated the volume of the discharge at greater than 1,000 gallons. Mr. Wooten did not issue a press release regarding the discharge. F. The cost to the State of the enforcement procedures in this matter totaled $803.65. 0 Based upon the above Findings of Fact, I make the following: CONCLUSIONS OF LAW: A. Charles S. Wooten, Jr. is a "person" within the meaning of G.S. 143-215.6A pursuant to G.S. I43-212(4). B. Angola Creek constitutes waters of the State within the meaning of G.S. 143- 215.1 pursuant to G.S. 143-212(6). C. The above -cited discharge constituted making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required by G.S. 143- 215.1. D. Charles S. Wooten, Jr. violated G.S. 143-215.10C(h)(1) by failing to issue a press release for a discharge of 1,000 gallons or more of animal waste. E. Charles S_ Wooten, Jr. may be assessed civil penalties in this matter pursuant to G.S. 143-215.6A(a)(2), which provides that a civil penalty.of not more than ten thousand dollars (S 10,000.00) per violation may be assessed against a person who is required but fails to apply for or to secure a permit required by G.S. 143-215.1. F. Charles S. Wooten, Jr. may be assessed civil penalties in this matter pursuant to G.S. 143-215.6A(a)(1), which provides that a civil penalty of not more than ten thousand dollars (SI0,000.00) per violation may be assessed against a person who violates any classification, standard, limitation, or management practice established pursuant to G.S. 143-215, G. The State's enforcement costs in this matter may be assessed against Charles S. Wooten, Jr. pursuant to G.S. 143-215.3(a)(9) and G_S. 143B-282. I (b)(8). H. The Director, Division of Water Quality, pursuant to delegation provided by the Secretary of the Department of Environment and Natural Resources, has the authority to assess civil penalties in this matter. Based upon the above Findings of Fact and Conclusions of Law, I make the following: DECISION: Accordingly, Charles S_ Wooten, Jr. is hereby assessed a civil penalty of: $51 o for making an outlet to the waters of the State without a permit as required by G.S. 143-215.1. $-,000 for violating G.S. 143-215. IOC(h)(1) by failing to issue a press release for a discharge of 1,000 gallons or more of animal waste $ 5, 0 0 o TOTAL CIVIL PENALTY, which is 3o percent of the maximum penalty authorized by G.S. 143-215.6A. $ 803.65 Enforcement costs TOTAL AMOUNT DUE As required by G.S. 143-215.6A(c), in determining the amount of the penalty I have considered the factors listed in G.S.14313-282.I(b), which are: (1) The degree and extent of harm to the natural resources of the State, to the public health, or to private property resulting from the violation; (2) The duration and gravity of the violation; (3) The effect on ground or surface water quantity or quality or on air quality; (4) The cost of rectifying the damage; (5) The amount of money saved by noncompliance; (6) Whether the violation was conunitted willfully or intentionally; (7) The prior record of the violator in complying or failing to comply with programs over which the Environmental Management Commission has regulatory authority; (8) The cost to the State of the enforcement procedures. Excessive ponding of animal waste was observed in the spray field in pull #4. Runoff of animal waste had occurred and had discharged from the spray field through a storm water diversion into an adjacent ditch that feeds Angola Creek. Angola Creek is class "C-Swamp" waters of the State in the Cape Fear River Basin. Mr. Wooten applied waste on 5.76 acres in pull #4 on April 11, 2000 from 8:50 am to 12:00 pm. Mr. Wooten indicated that he observed -the waste application from the location of the reel but did not walk down to where the gun was spraying. Mr. Wooten said he did not observe any ponding or runoff on April 11, 2000. On April 13, 2000, Mr. Mathis and Ms_ McVicker observed the ponding in the spray field and discovered that waste runoff had occurred and discharged into the adjacent ditch. Mr. Mathis followed the ditch to where it entered Angola Creek. Water quality samples were taken at the ponded area in the spray field, at the point where the waste entered the ditch, at a point downstream of where the ditch entered Angola Creek, and at a point upstream of where the ditch entered into Angola Creek. Mr. Mathis advised Mr. Wooten to contain and collect the waste and reapply it to the spray field. On April 14, 2000, Mr. Mathis returned to the Bear Ridge Farm to monitor clean-up procedures. Mr. Wooten and Mr. Kevin Weston of Murphy Farms, Inc. were on site. Mr. Wooten said that 0.3 inches of rain had fallen since April 11, 2000. Mr. Mathis took water quality samples where the waste entered the ditch and at a point just upstream from where the ditch entered Angola Creek. Mr. Mathis estimated that the volume of waste discharged to waters of the State was greater than 1,000 gallons and requested that Mr. Wooten follow the proper notification procedures. Mr. Wooten did not comply with the proper notification requirements. Farm and/or Company Compliance History: Include a copy of CAFO Designation letters, previous NOV=s, NOD=s,_previous civil assessments, etc. - The referenced facility was issued a Notice of Deficiency on rune 20, 1997 for erosion on the lagoon dike wall. A civil penalty was assessed on October 31, 1997 for failure to designate an Operator in Charge. Amount of Waste Discharged (If applicably. Mr. Wooten indicated that he had been loading hogs at another farm all morning. Mr. Wooten began clean-up procedures as Mr. Mathis left -the site. Mr. Wooten did not comply with the proper notification procedures. Fish kill observed? Y/N_ If yes, include report_ from WRC: No fish kill was observed at the time of the inspection. Mitigating Circumstances: None. Recommendation: The Wilmington Regional Office of the Division of Water Quality is recommending assessment of a civil penalty to the Director of the Division of Water Quality, pursuant to G.S. 143-215..6A. Include a copy of the previously completed Animal Operations Inspection Form, pictures and site sketch of waste flow if waste is discharged -to surface waters. Also include violator's response to Notice of Recommendation for enforcement. If citing certified plan or permit condition violations, include copies ofpermit or plan. Assessment Factors required to be considered by G. S. 143B-282.1(b): 1. The degree and extent of harm to the natural resources of the State, to the public health, or to private property resulting from the violation: Water Quality samples taken downstream of the discharge point in the ditch leading to Angola Creek displayed fecal coliform bacteria levels of up to 1,180,000. colonies per 100 ml. The duration and gravity of the violation: The application event occurred from 8:50 am to 12:00 pm on Tuesday, April 11, 2000. The ponding, runoff, and discharge were not discovered until approximately 6:00 pm on Thursday, April 13, 2000. The discharge was not blocked until approximately 12:00 pm on Friday, April 14, 2000. Over 1,000 gallons of animal waste discharged to a ditch that feeds Angola Creek in the Cape Fear River Basin. The discharge was a result of poor land application operations and could easily have been avoided with the proper precautions. Mr. Wooten was advised on April 14, 2000 to submit a press release to the appropriate news stations within 48 hours. Mr. Wooten did not follow the notification procedures. 3. The effect on ground or surface water quantity or quality: The effects to groundwater and air were not documented. Water quality was impacted as determined by water quality analysis. 4. The cost of rectifying the damage: The cost to rectify the environmental damage cannot be easily estimated. The surface waters of Angola Creek are classified as CIass "C-Swamp" waters of the State. Animal waste discharged into a receiving stream will degrade water quality due to very high levels of pathogens (IE. fecal coliform bacteria), ammonia, nutrients and other dissolved oxygen reducing constituents. 5. The amount of money saved by noncompliance: The amount -of money saved by noncompliance is not known. 6. Whether the violation was committed willfully or intentionally: In the opinion of the inspector, the discharge was not willful or intentional, but did show a lack of proper management that is required when applying animal waste. Mr. Wooten willfully did not issue a press release to the appropriate news stations for the discharge. 7. Holders of Certificates of Coverage under this permit shall comply with the following specified conditions and limitations: 1. PERFQRMANrE STANDARDS The animal waste collection, treatment, storage and transmission system permitted under this permit shall be effectively maintained and operated as a non -discharge systerr. to prevent the discharge of pollutants to surface waters, wetlands, or ditches. Facilities which are in compliance with their Certified Animal Waste Management Plan (CAWMP) and this permit, which unintentionally discharge as a result of a storm event greater than the 25 year, 24 hour storm, will not be considered to be in violation of this permit. 2. The CAWMP is hereby incorporated by reference into this general permit. New or expanding farms are required to be certified prior to the stocking of animals. The CAWMP CP must be consistent with all applicable statutes, rules and standards in effect at the time of siting, design and certification of the facility. Any violation of the CAWMP shall be - considered a violation of this general permit and subject to enforcement actions. Such a violation may require the Perminee to cease applying animal waste to the site and to take =1' any immediate and long term corrective actions as may be required by the Division of Water Quality (DW Q). j 3. This facility may -not be expanded unless the CAWMP is first modified and recertified by a technical specialist to.reflect this expansion. Additional animals may not be stocked until all applicable parts of the CAWMP Have been recertified. A copy of the complete modified CAWMP and the new certification must be submitted to the local Soil and Water Conservation District Office and to the DWQ. 4. A copy of this Certificate of Coverage (COC), General Permit, certification forms, lessee and landowner agreements, and the CAWMP.shall be maintained at the farm (stored at places. such as the .farm residence, office, outbuildings, etc.) where .animal waste management activities are being conducted for the life of this permit. 'These documents shall be kept in good condition and records shall .be maintained in an orderly fashion. 5. For all new and expanding operations, no collection or storage facilities may be constructed which could be inundated by a 100 year flood. In addition to protection from inundation, the facility shall be designed in order to minimize potential harm to or within the floodplain. II. OPERATION AND ^,MAINTENANCE REQMREMENTS 1. The collection, treatment, and storage facilities, and land application equipment and sites shall be properly maintained and operated at all times. 2. A suitable vegetative cover shall be maintained on all land application sites and buffers in accordance with the CAWMP. No waste may be applied upon fields not approved by or prepared in accordance with the CAWMP. 3. An acceptable pH of the soil shall be maintained on all land application sites to insure optimum yield for the crop(s) being grown. 4. The Plant Available Nitrogen application rates -and hydraulic loading rates, identified in the CAWMP, shall not be exceeded. 5. Application of animal waste onto land which is used to grow crops for direct human consumption (e.g., strawberries, melons, lettuce, cabbage, apples, etc.) shall not occur within 30 days prior to or during the planting of the crop or at any time during the growing season, or in the case of fruit bearing trees, 30 days prior to breaking dormancy. Application of animal wastes shall not occur within 30 days of the harvesting of fiber and food crops for direct human consumption that undergo further processing. If waste is to be applied on bare soil, the waste shall be incorporated into the soil within twenty-four (24) hours after application on the land. " 5. Domestic and/or industrial wastewater from showers, toilets, sinks, etc. shall not be discharged into the animal waste collection, treatment, storage and transmission system. Washdown of stock trailers, owned by and used to transport animals from this farm.only, will be permissible as long as system design accommodates the additional flow and as long as only. those detergents and disinfectants are utilized which are labeled by the manufacturer as readily biodegradable. 7. Disposal. of dead animals shall'be done in accordance with the North Carolina Department of Agriculture (NCDA) Veterinary Division's regulations and the CAWMP. 8. Grazing animals on an application site shall be controlled in accordance with Natural Resources Conserva6on.Service (MRCS) Standards. 9. All uncontaminated stormwater runoff from the surrounding property and buildings shall be diverted away from the animal waste lagoons and storage ponds to prevent any unnecessary addition to the liquid volume in the structures. 10. A protective vegetative cover shall 'be established on all disturbed areas (lagoon embankments, berms, pipe runs, erosion control areas, etc.) Emerging vegetation such as trees, shrubs, and other woody species shall not be allowed to grow on the lagoon dikes or sideslopes. Lagoon areas should be kept mowed and accessible. 11. Disposal of the sludge shall be in accordance with the CAWMP. When removal of sludge from.the lagoon is necessary, provisions must be taken to prevent damage_ to lagoon dikes and liners. 12. Solid materials including, but not limited to, bottles, light bulbs, gloves,.syringes or any other solid waste from the animal waste operation shall be prevented from entering the treatrnentlstorage lagoon and shall be disposed of properly. 13. The facility must have at all times (a) adequate animal waste application and handling equipment on site, (b) a lease for the use of the necessary equipment, (cl a contract with a thud parry applicator capable of providing adequate waste application, or (d) a contract for the purchase of the equipment. In all cases, the equipment and any contractor must be capable of land applying the waste on the sites specified in the CAWMP in compliance with both the agronomic and hydraulic loading rates for the sites. 2 III. MONITORING AND REPORTING REQUIREMENTS l . Waste collection, treatment, storage and transmission structures (i.e. piping, pumps, reels, etc.), under the control of the owner/operator shall be inspected weekly. Lagoon berms, storage ponds, and structures should be inspected for evidence of erosion, leakage, animal. damage or discharge. A written chronological record of maintenance and repairs shall be maintained on the farm and be made readily available during a scheduled inspection of the farm. These records shall also be made available at the request of the Division. All repairs shall be approved by a technical specialist prior to initiation and completed promptly. If a piece of equipment is being replaced with a piece of equipment of the identical specifications, no technical specialist approval is necessary [i.e. piping, reels, valves, pumps. (if the GPM capacity is not being increased or decreased), etc.]. Any major structural repairs (to lagoons or waste storage ponds) shall have the approval of a technical specialist. 2. If not already installed at this facility, a level gauge shall be installed within 60 days of issuance of the COC under this general permit to monitor waste levels. This gauge shall have readily visible permanent markings indicating the maximum lagoon levels at which pump -out must begin, end of pump -out, and freeboard elevations_ Where storage ponds are utilized, only a gauge with visible permanent markings indicating the pump -out begin and freeboard elevations need be installed. Caution must be taken not to damage the integrity of the liner when installing the gauge. Waste lagoon and storage pond levels s:uU be recorded weekly on forms supplied by the DWQ. 3. A representative Standard Soil Fertility Analysis shall be conducted annually on each application site receiving animal waste. The results of these tests shall be maintained on file by the Permittee for a minimum of three years and shall be made available. to the DWQ upon request. 4. An analysis of the liquid animal waste from the lagoon shall be conducted initially after issuance of the COC :and thereafter as close to the time of each waste application as practical. This test shall be conducted as close to the time -of application as practical and at least within 60 days Ibefore or after) of the date of application. This analysis shall include the -following parameters - Nitrogen Zinc Phosphorous Copper pH 5. Proper records, including maintenance, repair and irrigation records, shall be maintained on site.and in chronological and legible form for a minimum of three years by the Permittee. These records shall be maintained on forms.provided by the DWQ and shall be readily available for inspection. 6. Regional Notification: The Permittee shall report by telephone to the appropriate Regional Office as soon as possible, but in no case more than 24 hours following first knowledge of the occurrence of any of the following events: a. Failure of any component of the animal waste collection, treatment, storage and land application system resulting in a discharge to surface waters. b . Any failure of the animal waste treatment and disposal program that renders the facility incapable of adequately receiving, treating or storing the animal waste and/or sludge. c. Spillage or discharge from a vehicle or piping system transporting animal waste or sludge to the application sites which results in, or may result in, a discharge to surface waters. d. Any deterioration or leak in a lagoon -system or storage pond that poses an immediate threat to the enviroamenL e. Failure to maintain adequate storage capacity in a lagoon or storage pond that poses an immediate threat to public health or the environment. f. Overspraying animal waste either in excess of the limits set out in the CAWMP or .where runoff -enters waters of the State_ g _ -Any discharge that bypasses a lagoon system or storage pond. For any emergency which requires immediate reporting after normal business hours, please contact the Division of Emergency Management at 1-800-858-0368. The pern-i1ttee shall also file a written report of the occurrence in letter form within 5 days following first knowledge of the occurrence, unless waived by the Regional Office. This report shall outline the actions taken or proposed to betaken to correct the problem and -to ensure that the problem does not recur. IV. JNSPECTIQ, !S Any duly authorized officer, employee, or representative of the DWQ may, upon presentation of credentials and in accordance with reasonable and appropriate biosecurity measures, enter and:inspect any property, premises or place on or related to the collection, treatment, storage and land application system at any reasonable time for the purpose of determining compliance with this permit; may inspect and obtain a copy of any records that must .be kept under the terms and conditions of this permit; and may obtain samples of the wastewater, groundwater, or surface water. V . GENERAL CONDTTI N 1. The issuance of a COC under this permit shall not reheve-the Permince of the responsibility .for damages to surface waters or ground waters resulting from the operation of this program. 2. The Permittee shall designate and employ a certified animal waste management system operator to be in charge (OIC) of the animal waste management system.. No animal waste management system shall be operated unless supervised by the OIC. 4 3. For existing farms, the operating level of lagoons and other uncovered waste containment structures must not exceed the level that provides adequate storage to contain at a minimum a 25 year, 24 hour storm plus any additional storage required in the CAWMP. For new and expanding farms, the operating level of lagoons and other uncovered waste containment structures must not exceed the level that provides adequate storage to contain at a minimum a 25 year, 24 hour storm event, chronic rainfall, plus an additional 1 foot of freeboard. In either case, the maximum waste level shall not exceed that specified in the CAWMP. 4. Upon reasonable cause to believe that any activities conducted pursuant to this permit may cause or contn'bute any waste, directly or indirectly, to be intermixed with the waters of the State, the DWQ may require any monitoring (including but not limited to groundwater, surface water, sludge, soil and plant tissue) necessary to determine the source, quantity, quality, and effect of such waste upon the waters of the State. Such monitoring, including its scope, frequency, duration and any sampling, testing, and reporting systems, shall meet all applicable Commission requirements. "Reasonable Cause" may be based on the findings of a related Federal, State, Commission or DEHNR authorized study or report, or on showing that violations of State water duality or other applicable environmental standards have occurred or may occur. 5: Failure to abide by the conditions and limitations contained in this permit, the facility's CAWMP and any COC issued under this permit may subject the Permittee to an enforcement action by the DWQ in accordance with North Carolina General Statutes and may include the requirement to obtain an individual animal waste operation permit, the addition of treatment or storage units, or the addition of land application sites. r- 6. The issuance of a COC under this permit does not excuse the Permittee from the obligation to comply -with all applicable statutes, rules, regulations, or ordinances (local, state, and federal). 7. if animal production at the facility is to be suspended or terminated, the owner is responsible for developing, implementing and completing a "closure plan" which will eliminate the possibility of an illegal discharge, pollution, erosion, and the potential for injury and shall be in accordance with NRCS lagoon closure standards in.effect when the closure plan is developed and implemented. Closure shall also include notifying the-DWQ. 8. The annual permit fee shall be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly constitutes grounds for revocation of this COC. 9. Failure of the Permittee to maintain, in full force and effect, lessee and landowner agreements which are -required in the CAWMP, shall constitute grounds for.revocation of this COC. It was observed that some erosion of the clay liner has occurred on the lagoon. Large cuts were observed in various sections of the inner and outer dike walls of the lagoons. It is our concern that some of these gullies may become deep enough to cut.through the liner material and sacrifice the integrity of the structure. As was discussed at the time of the inspection, the cuts should be filled with. a suitable clay material, compacted and reseeded with an appropriate vegetative cover. In addition, the washout along the ditch line adjacent to the spray fields should be -filled and reseeded to prevent further erosion and to reduce the risk of runoff. We suggest that you contact.yaur service company, .local MRCS or Soil and Water District office for any assistance they may be able to provide to correct the situation.' Stevens, Director of the Division of Water Quality (DWQ), make the following: I. FINDINGS OF FACT: A. Charles S. Wooten, Jr. owns and operates Bear Ridge Farm, a swine operation located along NC Highway 50 in Pender County. B. Charles S. Wooten, Jr. was issued Certificate of Coverage AWS710069 under General Permit AWG100000 for Bear Ridge Farm on May 29, 1998, effective May 29, 1998, with an expiration date of December 31, 2001. This permit does not allow the discharge of waste to waters of the State. C. On April 13, 2000, DWQ staff observed a discharge of wastewater by Bear Ridge Farm from a spray -field via a ditch to Angola Creek, which are Class C Sw waters of the State within the Cape Fear River Basin_ D. CharIes S. Wooten, Jr. had no valid permit for the above -described activity. E_ DWQ staff estimated the volume of the discharge at greater than 1,000 gallons. Mr. Wooten did not issue a press release regarding the discharge. F. The cost to the State of the enforcement procedures in this matter totaled $803.65. IL Based upon the above Findings of Fact, I make the following: CONCLUSIONS OF LAW: A. Charles S. Wooten, Jr. is a "person" within the meaning of G.S_ 143-215.6A pursuant to G.S. 143-212(4). B. Angola Creek constitutes waters of the State within the meaning of G.S. 143- 215.1 pursuant to G.S. 143-212(6). C. The above -cited discharge constituted making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required by G.S. 143- 215.1. D. Charles S_ Wooten, Jr_ violated G.S. 143-215.10C(h)(1) by failing to issue a press release for a discharge of 1,000 gallons or more of animal waste. E. Charles S. Wooten, Jr. may be assessed civil penalties in this matter pursuant to G.S. 143-215.6A(a)(2), which provides that a civil penalty of not more than ten thousand dollars ($10,000.00) per violation may be assessed against a person who is required but fails to apply for or to secure a permit required by G.S_ 143-215.1. F_ Charles S. Wooten, Jr_ may be assessed civil penalties in this matter pursuant to G.S. 143-215.6A(a)(1), which provides that a civil penalty of not more than ten thousand dollars ($10,000.00) per violation may be assessed against a person who violates any classification, standard, limitation, or management practice established pursuant to G.S. 143-215. G. The State's enforcement costs in this matter may be assessed against Charles S. Wooten, Jr. pursuant to G.S. 143-215.3(a)(9) and G.S. 14313-282.1(b)(8). H. The Director, Division of Water Quality, pursuant to delegation provided by the Secretary of the Department of Environment and Natural Resources, has the authority to assess civil penalties in this matter.
