On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules
(15A NCAC 2B.0233)
Dear Mr. Wilson:
On September 9, 2005, at your request I conducted an on-site determination to review three
features located on the subject property for applicability to the Neuse Buffer Rules (15A NCAC
213 .0233). The features are labeled as "A, B and C" on the attached map initialed by me on
September 7, 2005.
At your request, I conducted an appeal of their determination as stated above. The DWQ has
determined that the streams labeled as "A, B and C" on the attached map are not present
in the ground and therefore are not subject to the Neuse Buffer Rule. The owner (or future
owners) should notify the DWQ (and other relevant agencies) of this decision in any future
correspondences concerning this property.
This letter only addresses the applicability to the buffer rules and does not approve any activity
within the buffers. Nor does this letter approve any activity within Waters of the United States
or Waters of the State. If you have any additional questions or require additional information
please call me at (919) 733-9502. This determination is subject to review as provided in Articles
3 & 4 of G.S. 150B.

Dear Mr. Dorney:
On behalf of the owner, Kane Realty Corporation, we hereby request an appeal of the on-site determination
performed by Ms. Debbie Edwards of the Express Review Program, Wetlands Unit on April 22, 2005 and
described within her report dated April 22, 2005 (see attached report). We arc requesting that the feature described
as a "cemented hole" in her report and approximated on the attached maps be exempted from the Ncuse Buffer
Rule.
In addition, there are three other stream features depicted on the soil survey cast of Industrial Drive and Nvcst of the
railroad tracks (see the attached maps) that we are requesting an on-site determination on. The two sites arc
immediately adjacent to each other the Kane Realty Corp. is the responsible party for both determinations. As
such, a single report of your determination should be suflicicnt: To assist you in your scheduling you should know
that the sites are located five minutes from your office and should take, no more of than an hour including travel
time to complete these determinations.
Please contact me as soon as possible to schedule- an on-sitc;.ev luatidn of these features. and call. me if you need
further explanation of the information provided.-
