After reviewing your application, we have determined that the Division of Water Quality (DWQ) General Water Quality Certification Number 3400 covers these water impacts. This Certification allows you to General Permit No. 198000291 when issued by the US Army Corps of Engineers (USACE). In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead with your project including (but not limited to) erosion and sediment control regulations and CAMA. Also, this approval to procced with your proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit. This approval is for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). If you do not accept any of the conditions of this Certification (associated with the approved water impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. PROJECT SUMMARY: The applicant proposes to construct 2 piers; 2 !'Ivo-stan "boathouses; 2 jet ski lifts; a wet slip, (for a total of7 slips); a boat ramp; bulkhead; and, an access road with parking area. Cham Properties Chowan Beach Winton Hertford County Project setting The project site is located off SR 1321 upstream of the Chowan River Bridge in Hertford County near Winton, North Carolina. The property was historically used for beach access but has not been used in numerous years. Of the :J:56 acre tract :J:4.0 acres have been cleared and rough graded and has been subject to enforcement action from the Division of Coastal Management, which has since been closed. The owner was also issued CAMA Minor Permit 004-06 on 6 August 2004 to fill and grade an area adjacent the River. The elevation of the tract ranges from:J:2 feet above normal water level (NWL) adjacent the Chowan River to an elevation of :J:25 feet above the NWL approximately 100 feet landward of the shoreline. The River is :J:900' feet wide at this location. Near the center of the :J:l,120' shoreline, two covered buildings exist on the property and are located within :J: 15' of the NWL. Additional stmctures on the side include access steps down the slope to the buildings and a gravel access road exist near the center of the property and terminates:J: 75' landward of the NWL. A drainage ditch exist on both sides of the road and flows to the upstream (north) end of the property, which drains to the River. The outlet of the ditch is scattered with concrete and masonry debris. Portions of the shoreline have been stabilized with granite and cement riprap. The upstream (north) side of the property contains non-coastal wetlands adjacent the Chowan River. Both the upstream (north) and downstream (south) properties are undeveloped. These adjacent properties are characterized by a fringe of 404 wetlands adjacent the river then transitioning to a :J:25' high rolling hill. A few hardwood trees and cypress trees exist on the site. Since the site was rough graded it has been seeded with grass in order to stabilize the slopes in accordance with the NC Land Quality Section. The ChO\van River is classified as B-NSW waters by the Environmental Management Commission at the project site. The Chowan River is designated as Joint Waters by the N C Division of Marine Fisheries and NC Wildlife Resources Commission and is not open to shell fishing. Project description The applicant proposes to construct two piers. The proposed upstream (north) pier is :J:6' wide by :J:89'long with a :J:20' by :J:23' platform on the terminal end. Two - :J:28' by :J:26' (drip line) boathouses, each containing 2 slips, with a :J:4' by :J:55' catwalk and two :J:4' by:J:28' finger piers for access are proposed on the upstream (north) side of this pier. Immediately downstream (south) of this pier a :J:15' wide by :J:18' long boat ramp is proposed. Approximately 400' downstream (south) of the above referenced pier the applicant is proposing a second pier. The downstream (south) pier measures :J:6' wide by:!:136'longwith a :!:20' by :!:23' platform. Located on the south side of this pier :!:90' from NWL is an:J: 18' by:!: 18' (dripline) covered platform. Also located on the downstream pier are two pile supported jet July 1, 2005 To Whom It May Concern: Chowan Beach Project, located in Hertford County, North Carolina, is privately owned under the title of Cham Properties. The Cham Properties family consists of three individual households, including 5 children. \Ve wish to restore Chowan Beach to a well-groomed and functional beach that it once was. \Ve want to construct a boat slip, boathouses, piers, and platforms, as well as install five (5) boatlifts and two (2) Jet Ski lifts. The multiple lifts are necessary for each individual household. The first pier will contain the boathouses, along with four lifts. The second will contain the open lift and two Jet Ski lifts. All of the above are for private use. The existing sandy beach will be graded with a tractor, with additional sand added as needed. This was approved previously in a minor permit. A treated timber bulkhead will be installed immediately in front of the existing Rip Rap Bulluleads. A detailed work plat drawn by Stanton Harrell shows all of the listed items. Carol Forehand has been hired to construct piers, boathouses, boat slip and bulldlead pending project approval. The construction will consist of traditional methods. Equipment to be used includes a backhoe, tractor, and pump wash down. All access through the site to area of environmental concern is available without crossing any wetlands. . ':: :; ), ~ :} " ~ ~ ~ y A silt fence shall be properly installed immediately landward of all bulkhead caps immediately following completion of backfilling activities. No backfill material shall be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted bulkhead. All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 8) The riprap material used to protect the authorized boat ramp shall be free from loose dirt or any pollutant. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. The riprap material shall consist of clean rock or masomy materials such as, but not limited to, granite, marl, or broken concrete. 10) The fill material shall be clean and free of any pollutants except in trace quantities. Boatramp Facility 11) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. 12) Excavation and ground disturbing activities above and below the normal water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than 18' X 15' as specified in the permit application MP-2 dated 7/1/05. Docking Facility 13) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. The authorized structure and associated activity shall not cause an unacceptable interference with navigation. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he/she abandons the permitted activity without having it transferred to a third party. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. This peffilit authorizes a maximum of seven (7) boat slips as referenced in the attached workplan drawing dated revised 6/25/05. The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. Stormwater :Management 23) The N.C. Division of Water Quality approved this project under stormwater management rules of the Environmental IvIanagement Commission under Stormwater Permit No. SW7050733 on 10/20/05. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. General 24) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina.
