Box 1006 Charlotte, North Carolina 28201-1006 Subject: Issuance of NPDES Major Modification Permit NC0000396 Asheville Steam Electric Plant Buncombe County Facility Class I Dear Mr. Draovitch: The Division of Water Resources is forwarding herewith the Final NPDES Major Modification for Asheville Steam Electric Plant. This Major Modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). No major changes were made to the draft Major Modification sent to you on March 20, 2019. The Division is unable to grant your request for the removal or three internal outfalls, effluent guidelines require an independent compliance with the Technology Based Effluent Limits for each outfall. The final Major Modification maintains the following significant changes identified in the letter sent on March 20, 2019: To accommodate changes required for conversion to Combined Cycle Plant four additional internal outfalls were added to the permit: Outfall 001A, Outfall 001B, Outfall 001 C, Outfall 001 D. Instream temperature limits were added to Outfall 001 to assure compliance with the state temperature standard, this change is required because cooling tower blowdown was added to this Outfall. The Clean Water Act Section 316(b) Special Condition was updated. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such a demand is made, this permit shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources or any other Federal, State, or Local governmental permits that may be required.
