Dear Mr. Jason DeBoer:
The Engineering Department has reviewed the sedimentation and erosion control plans received on
03/21/2019, and find these plans to be acceptable and hereby issue this "Letter of Approval,"
Groundcover shall be provided within 14 calendar days from the completion of any phase of grading
operations, and within 7 calendar days for perimeter dikes, swales, ditches, and slopes, and within 7
days for any other slope steeper than 3:1.
Please have your contractor notify the Engineering Department, phone number (336-222-5050), when
a preconstruction conference has been scheduled so that we may attend and discuss the Erosion
Control Plan.
The City's Sedimentation and Erosion Control Ordinance is a performance -oriented program requiring
protection of the natural resources and adjoining properties. If following commencement of this
project it is determined that the plan needs to be modified, then this office will require that the plan be
modified to comply with the City's ordinance. Also, please be advised that the ordinance requires that
a copy of the approved erosion control plan be on file at the job site. You should consider this letter to
give the Notice required by Section 31.5-18 of our right of periodic inspection to insure compliance
with the approved plan.
Please be advised that effective March 10, 2003 the conditions of the General Permit to Discharge
Stormwater under the National Pollutant Discharge Elimination System (revised Permit NC G010000)
shall apply to all projects with land disturbance of more than one acre. Also be advised that you are
subject to the General Permit requirements and subject to enforcement by the Division of Water
Quality for any violations of the General Permit. A copy of the General Permit is enclosed with this
letter.
Furthermore, effective October 1, 2010, all persons conducting land -disturbing activities larger than
one acre must inspect their project after each phase of the project, and document the inspection in
writing as required as required by NCGS 113A-54.1. This self -inspection program will be performed
in addition to the NPDES self -monitoring report required for the General Permit mentioned above. A
copy of the Announcement of the Self -Inspection Program letter, Frequently Asked Questions for the
program and a sample Self -Inspection Report is enclosed with this letter.

Also be advised that the person financially responsible for conducting this land disturbing activity is
also responsible for borrow material brought onto the site and waste material from the site that is
disposed elsewhere. Separate sites from which borrow material is obtained, and which is not
regulated by the provisions of the Mining Act of 1971, shall be considered as part of the land -
disturbing activity for this site. Separate sites to which waste material is disposed of, other than
landfills regulated by the NCDEQ's Division of Waste Management, shall also be considered as part
of the land -disturbing activity for this site. These off site areas shall therefore be included and shown
on the approved erosion control plan and have the necessary erosion control measures in place.
The land -disturbing activity described in this plan may be subject to the approval of other local, state
or federal agencies. This could include the Division of Water Quality under storm water or water
quality regulations; the U.S. Army Corps of Engineers under Article 404 jurisdiction; county, city or
town agencies under other local ordinances; or other approvals that may be required. This approval
cannot supersede any other permit or approval.
Check with the local North Carolina Department of Transportation office to determine if an
encroachment will be needed for any operations on DOT right-of-way. Permits will be required for
driveways.

Sedimentation Pollution Control Act of 1973 (NC General Statute 113A Article 4, as amended), the North Carolina Administrative Code, Title 15A,
Chapter 4: Sedimentation Control, and the City of Burlington, North Carolina Code of Ordinances, Chapter 31.5: Soil Erosion and Sedimentation Control.
A copy of this permit and the approved Erosion and Sedimentation Control Plan must be kept on project site.
Per City Ordinance Section 31.5-18 notice is hereby given that agents, officials, or other qualified persons authorized by the City will periodically inspect
land -disturbing activities to ensure compliance with the Act, City ordinances, or rules or orders adopted or issued pursuant to the ordinance, and to
determine whether the measures required in the Plan are effective in controlling erosion and sedimentation resulting from land -disturbing activity.
