Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order and/or appropriate legal action.
This verification.is valid until the NWP is modified, reissued, or revoked. All of the existing NWPs are scheduled to be modified,
reissued, or revoked prior to March 18, 2007. It is incumbent upon you to remain informed of changes to the NWPs. We will issue a
public notice when the NWPs are reissued. Furthermore, if you commence or are under contract to commence this activity before the
date that the relevant nationwide permit is modified or revoked, you will have twelve (12) months from the date of the modification or
revocation of the NWP to complete the activity under the present terms and conditions of this nationwide permit. If, prior to the
expiration date identified below, the nationwide permit authorization is reissued and/or modified, this verification will remain valid
until the expiration date identified below, provided it complies with all new and/or modified terms and conditions. The District
Engineer may, at any time, exercise his discretionary authority to modify, suspend, or revoke a case specific activity's authorization
under any NWP.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (LAMA),
prior to beginning work you must contact the N.C. Division of Coastal Management in Elizabeth City, NC, at (252) 264-3901.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal,
State or local approvals/permits.

Permit Special Conditions
Your work is authorized by Nationwide Permit 18 provided it is accomplished in strict
accordance with the attached General Conditions and the following Special Conditions:
a. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit.
b. The Permittee shall preserve and maintain 43,560 square feet (1.0 acre) of
DA jurisdictional wetlands on the east portion of the parcel as identified on the
applicant's plat. The Permittee is prohibited from performing any of the
following activities within the conservation area: Filling; grading; excavating;
earth movement of any kind; construction of roads, buildings, signs, or any other
structure; any activity that may alter the drainage patterns on the property; the
destruction, mowing, or other alteration of vegetation on the property; disposal or
storage of any garbage, trash, or other waste material; or any other activity which
would result in the wetlands being adversely impacted or destroyed. The entire
conservation area boundary shall be clearly marked with suns reading "Wetland
Conservation Area", to prevent future inadvertent impacts.
c. Prior to beginning work authorized by this permit, the Permittee shall
execute and cause to be recorded a conservation casement prohibiting hose
activities listed in condition b. above. The holder of this easement shall be
approved by the Corps of Engineers prior to recordation of the easement. The
Permittee shall provide the Corps of Engineers, a copy of the recorded easement
within 60 days of the recordation of the easement. The Permittee shall take no
action inconsistent with the terms and purpose of the conservation easement on
the property described therein.
d. Condition c. above runs with the land. The Permittee shall not.sell, lease, or
otherwise convey any interest in the property without first providing sixty (60) days
written notice to the Corps of Engineers of the proposed conveyance. The instrument

effecting such conveyance shall include legally binding restrictions on the use of the
mitigation property as described in condition b. above, to be enforceable by the Permittee
as well as the U.S. Army Corps of Engineers, Wilmington District. The instrument
establishing such restrictions shall be subject to the approval of the Corps of Engineers.
The Permittee shall enforce the terms of the required restrictions.
e. Excavated or fill material shall not be placed in any location or in any manner so as
to impair surface water flow into or out of any wetland area.

Quality Certification. This nationwide permit does not relieve you of the responsibility to
obtain other required State or local approval. This verification will be valid for two years
from the date of this letter unless the nationwide authorization is modified, reissued or
revoked.

Approval of 401 Water Quality Certification with Additional Conditions

You have our approval, in accordance with the attached conditions and those listed below, to place fill
within or otherwise impact 0.10 acres of wetlands for the purpose of constructing the proposed septic area
setbacks, construct the proposed parking areas and to construct the proposed residence at the subject
property, as described within your application dated July 11, 2005 and received by the N.C. Division of
Water Quality (DWQ) on July 15, 2005. After reviewing your application, we have decided that the
impacts are covered by General Water Quality Certification Number(s) 3402 (GC3402). The
Certification(s) allows you to use Nationwide Permit(s) NW18 when issued by the US Army Corps of
Engineers (USACE). In addition, you should obtain or otherwise comply with any other required federal,
state or local permits before you go ahead with your project including (but not limited to) Erosion and
Sediment Control, Non-discharge, and other regulations. Also, this approval to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total fills for this project (now or in the future) exceed one acre of
wetland or 150 linear feet of stream, compensatory mitigation may be required as described in 15A
NCAC 2H.0506 (h). This approval requires you to follow the conditions listed in the attached
certification and any additional conditions listed below.
The Additional Conditions of the Certification are:

2. Erosion & Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Sediment and Erosion Control Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the most
recent version of the North Carolina Sediment and Erosion Control Manual. The devices
shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects,
including contractor-owned or leased borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed,
operated, and maintained in accordance with the most recent version of the North Carolina
Surface Mining Manual.
d. The reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond
the footprint of the impacts depicted in the Pre-Construction Notification. All construction
activities, including the design, installation, operation, and maintenance of sediment and erosion
control Best Management Practices, shall be performed so that no violations of state water quality
standards, statutes, or rules occur.
4. No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum
extent practicable. If placement of sediment and erosion control devices in wetlands and waters
is unavoidable, they shall be removed and the natural grade restored within six months of the date
that the Division of Land Resources has released the project.
5. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant is required to return the attached
certificate of completion to the 401 Oversight/Express Review Permitting Unit, North Carolina
Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct
impacts to waters as depicted in your application and as authorized by this Certification shall expire upon
expiration of the 404 or CAMA Permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or
stream impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that
you receive this letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of
the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,

Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a
hearing.

To Whom It May Concern:
This letter is in response to the July 28, 2005 request for more information. We will be glad to provide
any information needed to further process this information. However it is our belief that all the
information has been provided in order to process the request At this time we want to make sure the
file stays open so that we can meet all the requirements to receive the permit
Your first issue with the permit was that the plan detail was incomplete. The house which will be
elevated on pilings will sit partially on the proposed fill area, and the rest will hang over into the
wetlands. The wetlands in this area are totally isolated from any open waters or streams and have been
determined by CAMA to have no connection and/or jurisdiction. It is therefore our belief that no further
plans are needed
The other concern was to whether we could relocate the house and parking to further minimize the
impacts. The house and drive must be located on the property based upon Dare County regulations.
However to minimize the impact we have received an easement and ok by the county to locate the
septic on the other lot which already has a house and septic on it We as stated will be placing a
conservation easement on an acre for mitigation.

On July 15, 2005, the Division of Water Quality (DWQ) received your application dated July 11,
2005 to impact 0.10 acres of wetlands to construct the proposed septic area setbacks, construct
the proposed parking areas and to construct the proposed residence. The DWQ has determined
that your application was incomplete and/or provided inaccurate information as discussed below.
The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore, unless we receive the
additional information requested below, we will have to move toward denial of your application
as required by 15A NCAC 211.0506 and will place this project on hold as incomplete until we
receive this additional information. Please provide the following information so that we may,
continue to review your project.
Additional Information Requested:
1. Plan Detail Incomplete
Please show all wetland impacts including fill slopes on the site plan. It appears from the
design plans provided that the residence will be constructed in an area outside of the fill
line. The wetlands impacts should be clearly delineated on the plans.
2. Impact Justification (Avoidance and Minimization)
This office believes that the residence and parking area can be moved or reconfigured to
avoid the impacts to wetlands. Please revise the plans to avoid the impacts. The
residence and parking areas can be moved to the non-wetland portion of the property to
the north where the septic system is located. The drain field repair areas could be
reconfigured to meet the required setbacks and avoid all impacts to wetlands.

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property

at the time of this application: The site consists of mostly wetland adjacent to the Pamlico
Sound. The parcel directly north however is highland, and is where the proposed septic will
be located. The area consists entirely of single-family dwellings for private use.

10. Describe the overall project in detail, including the type of equipment to be used: The Doerr
project will consist of constructing a single-family dwelling. First fill we be placed -in the
wetland in order to achieve required separation for the septic system. Also the parking area
on the east side will need to be filled for adequate access and parking or the owners and for
the Dare County. (fire trucks ambulances, etc) Once septic and access are achieved the
construction of the residence will begin. During the whole process silt fence will be installed
in order to keep wetland free of debris and fill. The suitable fill material will be brought to
the site bhp truck and spread by front end loader
11. Explain the purpose of the proposed work: The Three reasons for the requested fill are first,
to meet the required setbacks for the installation of the septic area. The primary system must
be 50' from all wetlands and the repair area must be 35'. Secondly, the other area of fill is
proposed for parking areas required be the county for the proper parking and access by
emergency vehicles and last part of the house will be located on the fill area.

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
First of all the only development requested on the 1.42 acre parcel is one single-family
dwelling. Next an engineered pod system was designed in order to achieve less required
separation from the wetland, which also means less required fill for the separation. Also the
construction of the driveway and parking will be included in one (.l acre) permit.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/newetlands/strni ,ide.html.

project will consist of constructing a single-family dwelling. First fill we be placed in the
wetland in order to achieve required separation for the septic system. Also the parkin area
on the cast side will need to be filled for adequate access and parking for the owners and for
the Dare County. (fire trucks ambulances etc) Once septic and access are achieved the
construction of the residence will begin. During the whole process silt fence will be installed
in order to keep wetland free of debris and fill. The suitable fill material will be brought to
the site by dump truck and spread by front end loader

to meet the required setbacks for the installation of the septic area. The primary system must

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and

First of all the only development requested on the 1.42 acre parcel is one single-family
dwelling. Next an engineered pod system was designed in order to achieve less required
separation from the wetland, which also means less required fill for the separation. Also the
construction of the driveway and parking will be included in one (.1 acre) permit.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
? wetlands

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration

VII. Impact Justification (Avoidance and Minimization)

First of all the onlv development requested on the 1.42 acre parcel is one single-family
dwelling Next an engineered pod system was designed in order to achieve less required
separation from the wetland which also means less required fill for the separation. Also the
construction of the driveway and parking will be included in one (.1 acre) permit.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as

at the time of this application: The site consists of mostly wetland adjacent to the Pamlico
Sound. The parcel directly north however is highland, and is where the proposed septic will
be located. The area consists entirely of single-family dwellings for private use.

10. Describe the overall project in detail, including the type of equipment to be used: The Doerr
pro'el ct will consist of constructing a single-family dwelling. First fill we be placed in the
wetland in order to achieve required separation for the septic system. Also the parking area
on the east side will need to be filled for adequate access and parking for the owners and for
the Dare County. (fire trucks ambulances, etc) Once septic and access are achieved the
construction of the residence will begin. During the whole process silt fence will be installed
in order to keep wetland free of debris and fill. The suitable fill material will be brought to
the site by dump truck and spread by front end loader
11. Explain the purpose of the proposed work: The Three reasons for the requested fill are first,
to meet the required setbacks for the installation of the septic area. The primm system must
be 50' from all wetlands and the repair area must be 35'. Secondly, the other area of fill is
proposed for parking areas required be the county for the proper parking and access by
emergency vehicles and last part of the house will be located on the fill area.

will accept the easement, but regulatory agencies are responsible for
