RE: City of Hickory NPDES MS4 NCS000426; NOV-2019-PC-0283
Dear Ms. Powell,
The purpose of this correspondence is to respond to NOV 2019-PC-0283, issued after an audit on
December 12, 2018, of the City of Hickory NPDES MS4 NCS000426. The City of Hickory is committed to
creating a program and operating a compliant municipal separate storm sewer system. The deficiencies
noted in the correspondence date April 24, 2019 will be improved upon and addressed as follows:
(1) The City Council will adopt a resolution demonstrating support for a compliant Stormwater
management program.
(2) The Engineering department is currently working on and completing the following
documentation to DEQ for review and comment.
a. The Engineering department will conduct a self-audit evaluating compliance with the
permit conditions found in Part II Section B: Public Education and Outreach; Section C;
Public Involvement and Participation; Section D: Construction Site Runoff Controls. The
self-audit will be documented using the DEQ standard Phase II MS4 Permit Compliance
Audit Report Template.
b. The Engineering department will implement the NCDEQ developed Stormwater
Management Plan (SWMP) templet which details specific actions, measurable goals, and
implementation timelines to bring the stormwater management program into
compliance with NPDES MS4 requirements over a 5 year period. The SWMP will be
documented utilizing the DEQ standard Phase II MS4 SWMP template. The SWMP will
address all known compliance deficiencies including, at a minimum, all items detailed in
the DEQ MS4 Program Audit Report and the self-audit.
(3) The City of Hickory will submit an NPDES MS4 permit application within thirty days of receiving
DEQ concurrence. The submitted SWMP documents a compliant Stormwater management
program. The new 5-year NPDES MS4 permit will be public noticed along with the submitted
SWMP. The City of Hickory shall respond to all public comments on the Draft SWMP and shall
submit a final SWMP for DEQ approval and final permit issuance. The final DEQ-approved SWMP
will become an enforceable component of the NPDES MS4 permit.
