Dear Mr. Fox,
On September 28, 2017, a visit was made to Ross Dairy and Triple R Dairy in Haywood County, NC. This visit was
prompted by a request from the farm owners as well as local NRCS office for input from NC State Extension service
relative to engineering and animal waste management issues at both locations. The following Extension personnel
were present: Mr. Ethan Henderson (Haywood County Extension Agent); Mr. Mark Rice (Extension Ag Engineer,
Animal Waste, BAE, NCSU), Mrs. Shannon Banner (Graduate Research Assistant, BAE) and Dr, Stephanie Ward (Dairy
Extension Specialist, ANS, NCSU).
Statement of the Issue
Both Ross and Triple R Dairy received notices from the Division of Water Quality that testing sites on
Jonathan Creek indicated an overgrowth of microbial species, as well as increased volatile solids (VS) and biological
oxygen demand (BOD), presumably related to improper drainage of a culvert between the two dairy locations.
When contacted, both owners (Steve/Phillip Ross and Ralph/Hank) were aware of the initial report (requested by
Mountain True). Both Ross families, as well as the local NRCS director (Mr. Vanhook) agreed that they had worked
well together on past issues and that both Ross families were amenable to addressing the current run off problems.
However, both farms had requested assistance from the Haywood District NRCS, which had not yet been provided
due to staff vacancies. From here forward, the reported violations at each dairy farm will be addressed separately.
This letter will focus on the Triple R Dairy.
Summary of Findings and Suggestions
The primary problem area on this dairy was the poorly graded lot leaving the freestall housing going into the parlor
holding pen, combined with leachate from silo storage (problem has since been amended) and an overflowing
water system. Once the grade of the lot is addressed, we believe that will alleviate much of the run off problem at
this lot site and will redirect the run off into the appropriate collection site. Additionally, a roof extension on the end
of the freestall housing will prevent further run off at this location.
It is imperative that everyone involved understand that, while these sound like straightforward solutions, all require
a significant financial commitment and consideration of animal health and well-being. on this visit, and others
unrelated to this issue, it is clear that both families are striving to take great care of their livestock and their family
farms. The topography of the land where these farms are situated is problematic and will continue to be as these
operations grow to support the demand for good quality milk and to support future generations on the farm. One
final suggestion would be that both sets of owners discuss the future of each location and consider working with
third party consultants to have a strategic plan for growth.

Triple R Dairy Visit- Potential Violations/Problem Areas
1. Leachate from silage storage and water trough
This area was identified on a previous visit (not by this team) as problematic because of leachate
from the concrete silo as well as leaking water pipes. The head to a natural spring is located
above the silo structure and feeds the water system for this side of the cow housing. This area is
below level of the holding pen as cows wait to enter the parlor. Thus, waste, leachate, and
water were all meeting in this common spot and the lot is not properly graded to drain this area
to the waste storage pond.
In addition to waste management concerns, this area was quiet slippery and also represented
potential hazards for cows entering and leaving the parlor.

Suggested solution: The owners (Steve and Phillip Ross) had already made amendments to the
silo corner on the day of our visit and decreased utilization of that silo as a storage spot for wet
feed. This should address the leachate concerns from that silo. The most needed change was to
regrade the lot so that the waste water could flow off the lot and into the waste storage pond
system.
2. Run off from free stall housing into culvert
This area was identified as a run off source during rain events, because cows are able to access
this lot and it is not covered. Also, the barn floor slopes in this direction so when it rains, run off
from the corner of the lot is not captured. Though not well pictured below, there is not an easy
solution to catching that run off.

Suggested Solution: While it is not easy nor economical, and that was recognized by all present,
the best option is to tie in a new roof extension. The owners did mention that this alley is used
as a turn -around point for their feed tractor and wagon so the alley way could not be narrowed
in order to ensure adequate space for equipment maneuvers. The final suggestion was to
extend the roof all the way over the concrete block wall and install steel beam support there for
the roof extension. This would cover the area from rainfall as well as allow room for the feed
wagon to enter, turn, and exit. The option of capturing the runoff from this section of the
freestall barn and diverting it to the waste storage pond should also be explored as an option to
extending the roof.

Thanks for meeting with us yesterday to discuss Triple R Dairy. As we discussed, water quality issues are still occurring
downstream of the farm.
DWR is requesting the status of providing temporary and permanent engineering assistance to the farm. Attached are
the two problem areas that we discussed.
The culvert area by the silage pit and the waste management of the free stall area at the far end of the building. DWR
feels that engineering assistance is needed for these two areas.
DWR understands that resources are tight and schedules busy. However, due to the severity of the condition of the
stream below this dairy we are requesting a timeline to provide engineering assistance. Another Notice of Violation
will be issued in the near future.

along with Duane, who is copied here. One of our Ag engineers, Mark Rice, went along and had some good suggestions. I
am working on a report to follow up, however, it is going to be a few weeks before I can get it out to Duane and the
farms. I'm in Wisconsin all this week and MN most of next week, then come home to the dairy show at state fair in
Raleigh.
Both farms are very willing to work on the issues, but this will not be a quick and/or easy process. Some major
construction is going to be required and planning for doing that around the cows and without causing a huge loss in
production for the farms has to be a well thought out process. I'm saying that, essentially, to preface the request that if
you guys run into any more issues in the immediate future that you'd let us know so we can work with the farms to
make progress towards a (hopefully) permanent solution. I appreciate, as do the farmers, the patience and cooperation
that has been afforded by everyone involved. I also appreciate the opportunity to work together with yours and Duane's
office on this. The more often we can do that, I think we'll see the best results for everyone.

Triple R Dairy (Facility #144-13) increased the volume of their animal waste storage pond in -May 2011. The
project was constructed in accordance with drawings I prepared and approved on April 13, 2011. The pond
expansion was also followed by a change in the manner which Triple R Dairy manages animal waste.
Originally, the animal waste management system was designed with all lot -scraped manure stored in a
drystack facility. Wastewater produced on the dairy was stored in an earthen pond. Modifications to the waste
storage pond include a push -off ramp which enables Triple R Dairy to store lot -scraped manure and wasted
bedding in the pond.
Triple R Dairy is now operating a manure slurry system by comingling manure and wastewater in the expanded
pond. This modification of the animal waste management system provides a greater storage capacity. Triple
R Dairy has adequate animal waste storage for 350 dairy cows for a 90 -day period. The expanded pond is
capable of storing manure, wasted bedding .wastewater, rainfall, and runoff for a 60 -day period. The drystack
facility has a 30 -day capacity for manure and wasted bedding. The two facilities combine to give Triple R Dairy
90 days of waste storage.
I attached calculations demonstrating the storage capacity of the waste management system. Additionally, I
attached pond expansion drawings and an as -built of the modified waste storage pond. If you have any

The Waste Utilization table shown below summarizes the waste utilization plan for this operation. This plan provides an estimate of the number of acres of cropland needed to use
the nutrients being produced. The plan requires consideration of the realistic yields of the crops to be grown, their nutrient requirements, and proper timing of applications to
maximize nutrient uptake.
This table provides an estimate of the amount of nitrogen required by the crop being grown and an estimate of the nitrogen amount being supplied by manure or other by-products,
commercial fertilizer and residual from previous crops_ An estimate of the quantity of solid and liquid waste that will be applied on each field in order to supply the indicated quantity
of nitrogen from each source is also included. A balance of the total manure produced and the total manure applied is included in the table to ensure that the plan adequately provides
for the utilization of the manure generated by the operation.

Hey J.R.,
I've finished reviewing Triple R's add-infor: Just as with Dean Ross some fields have acreages that are
not listed in the Planned Crops summary Table but I guess this could be buffers.
Also, Tract 327, the irrigation fields list usable acres of 16 & 4.46 in the Planned Crops Summary Table
but the wettable acre determination shows 5.48 acres. Am I missing something here?

This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN)
application on fields that are part of your Certified Animal Waste Management Plan.
In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you
must keep records of all sources of nitrogen that are being -added to these sites. This would include nitrogen
from all types of animal waste as well as municipal and industrial sludges/residuals, and commercial fertilizers.
Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to
be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRYS, SLUR1, SLUR2,
SLD1, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ)
compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during
routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an
appropriate enforcement action.
Please be advised that nothing in this letter should be taken as removing from you the responsibility or
liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting
requirement.

I can not comply with the date you gave me on the SPECIAL AGREEMENT for December 31, 1998. 1 did not
receive my plans until late last Fall, so 1 was delayed until April 1, 1998 getting started,
Here is a list of the work we have done since April I, 1998.
A. Dry stack is finished and I am waiting on Steel Company to come put roofing on. It should be completed by
September 20, 1998,
B. Holding pond is completed and the barn wash-up water is going in it now.
C. I am now grading out old barn lot in preparation for building a new free -stall barn. Completion date expected
for it is December 15, 1998.
D. When the frcestall barn is completed the barn lot run off water will be diverted into holding pond which is all
ready in operation.
E. Irrigation pipe and pumping equipment, hopefully will be installed by December.
F. Clean water and dirty water curbing on holding lot cannot be done until next spring, because some of the
curbing is to go in my bunker silo and it will be fill of silage this fall and winter. Completion date for curbing
hopefully will be April of 1999.
G. Seeding and fencing to be completed by the last of May 1999.
