When this facility was first inspected, the hogs were free-range, the lagoon had been breached leaving it with no retention, and there was a serious problem with trees on the dam. Since the initial management deficiency letter, the animals have been confined but the other problems have not been addressed. In addition, the land that the animals were free -ranged upon is not owned by the farmer as was assumed. The woman that owns the property was unaware that the pigs were on her land and only became apprised of the situation when she was informed that the trees could not be harvested due to the lack of vegetation and the subsequent shortage of buffering growth. R. 2, Box 210 Macon, NC 27551 Q�� EDEHNR Subject:Notice Of Intent To Revoke Deemed Permitted Status Hawkins Farm 3 Secondary Road 1335 Warren County Dear Mr. Hawkins: On July 31, 1995, Mr. Steve Mitchell, from the Raleigh Regional Office conducted a compliance inspection of the subject animal facility, This inspection is a part of the Division's efforts to determine potential problems associated with liquid waste disposal systems. Mr. Mitchell's site visit determined that wastewater from your facility was not discharging to the surface waters of the state. No manmade pipes, ditches, or other prohibited conveyances (for the purpose of willfully discharging wastewater) were observed. However, as a result of the inspection, the following management deficiencies were observed: —Your lagoon has little freeboard, less than 12 inches in some areas. This problem should receive prompt attention in order to prevent a future discharge or a lagoon breech. —It was noted that a significant number of large trees are growing along the toe of the lagoon slope. Trees can compromise lagoons and cause them to seep wastewater. All trees six inches or less in diameter and thick undergrowth should be removed and the lagoon berm stabilized. —The north east corner of the lagoon has been eroded away by a significant discharge several years ago and needs immediate repair. This problem must be permanently corrected. --In addition, approximately seventy pigs have been allowed to roam free in the woods around the facility. These hogs have been confined in and allowed direct access to an area that encompasses the headwaters of Hubquarter Creek. The waste from these animals is not treated and flows down hill into natural conveyances toward Lake Gaston. This creek constitutes surface waters of the State and is classified as Class C. This discharge of waste from these animals to the surface waters of the State must be eliminated. If you can eliminate this discharge by implementing changes in your operation within thirty (30) days of your receipt of this letter, no discharge permit P.O. This can be accomplished by, but not limited to, the removal of the animals from the woods, and/or fencing them off to allow the construction of a berm to collect the waste generated and then transport it to the lagoon for correct treatment and disposal. Mr. Mitchell, with the assistance of Mr. Larry West (Warren County Soil and Water Conservation) reinspected this facility on April 3, 1996. This inspection is part of the Division's efforts to reinspect facilities that were determined to have potential problems with liquid waste disposal systems. In your response received by this Office on November 15, 1995, the free ranging hogs were the only item attended to. The other management deficiencies detected in July still exist. There is no freeboard in the lagoon due to the large breech in the north east corner and there are still a significant number of trees growing along the toe slope. Now that the animals have been confined to the hog houses, the lack of freeboard has become paramount in its need of attention. In accordance with the requirements of NCAC 2H.0213, you are hereby given notice that sixty (60) days following your receipt of this letter, the Division of Environmental Management intends to revoke your permit unless the following conditions are met: 1. Repair of the breech in the lagoon wall. This will increase the freeboard to the required 19 inches. 2. Removal of all trees six inches or less in diameter and thick undergrowth in conjunction with the lagoon stabilization. 3. Submittal of an approved animal waste management plan and have the attached form completed. One copy of the plan must be sent to the Warren County Soil and Water Conservation District. The certification form and two (2) copies of the plan must be returned to: Division of Environmental Management Water Quality Section Operations Branch Post Office Box 29535 Raleigh, N.C. 27626-0535 Failure to comply with the above conditions will result in your permit revocation and therefore, the existing waste management system serving this animal operation will be in use without a permit as required by North Carolina General Statute 1 a3-215.1.. This approved animal waste management plan must explain how the waste will be collected, stored, treated, and land applied in an environmentally safe and acceptable manner. For assistance in the development of this plan you should contact your local agricultural agencies. This plan must be Certified by a designated technical specialist or a professional engineer. For a listing of certified technical specialists or assistance with your waste management plan you should contact your local Soil and Water Conservation District. If the Division has not received the requested plan and certification within the allotted sixty days, or if there are discharges to the surface waters of the State, a civil penalty of up to $10,000 per day may be assessed and you may be required to apply for an individual non -discharge permit from the Division. As a result of recent information, the letter was revised. Recently, Jeff Hawkins, a local producer requested a farm plan for his outdoor swine project and a letter of support. Jeff along with another producer are participating in a grant funded experimental project to compare the results of hogs raised outdoors vs. confinement. As I understand, this particular grant allows the producer to create their own approach to the operation and management of outdoor swine production without government and university technical planning guidance. The grant is administered by Operation Spring Plant, Inc and not through the local field office. As you all know, NRCS requires conservation plans to be based on developed technical standards and planning policy. Currently, NRCS does not have any technical guidance to develop a conservation plan simply based on a producer's own plans. However, NRCS technical and planning staff are reviewing the producer's proposed production system to determine if any of his ideas can meet any of the existing technical guidance for conservation planning of outdoor swine. NRCS may provide technical assistance to plan only for practices that will mitigate water quality impacts (exclusion -type fencing, buffer practices, surface runoff management) if the production system does not meet the conservation planning guidelines for outdoor swine operations. Below is the producer's plans in regards to the operation and management of his outdoor swine operation. The operation will utilize three existing hog houses and lagoon. The first house consists of 40 to 60 sows for breeding purposes. According to Jeff, each sow will average 10 to 15 pigs. The second house is where the pigs are born and will stay till they reach 60 lbs (max); which takes about one month and then they will be moved to the third house. At the third house, the pigs will stay till they reach 100 lbs (max) at which 1/2 of the population will be moved to the outdoor paddocks and the other 1/2 will remain in the house till they are sold at 240 lbs. Approximately, 100 to 150 pigs will all be placed in the first outdoor paddock where they will remain till they reach 240 lbs (max) which takes about 3 months. Then the next batch of pigs will be place in the second paddock and stay till sold. Once all the pigs have been sold in the third paddock, then a new batch of pigs will rotate back to the first paddock and the process starts all over. According to Jeff, it takes approximately 5 1/2 months from birth to market. 1 of 2 1/4I2008 1:57 PM FW: Conservation Planning (Outdoor Swine Production) ., Jeff's production goals are to sale 100 finishing hog (tops) per month. In regards to the outdoor paddocks, currently, Jeff has thinned an existing hardwood forest on steep slopes. He plans to construct three (3) fenced paddocks (161' x 600). Each paddock will have a 81x 8' concrete pad located at the top of the hill where sweet potatoes will be feed to the hogs. The paddocks will have scattered hardwood trees throughout for shade and acorns for food. No vegetation is planned to be established. A fence is planned to be installed approx 30 feet above a main drainage way which is located at the toe of the slope of the paddocks. within the 30 ft buffer, a 15 ft wide path is to be located for access to the paddocks. As I understand, you'll need to contact Mr. Jacob Crandall, Assistant State Conservationist for Water Resources for the letter of support from NRCS as you requested. Mr. Crandail serves as the NRCS technical contact for Operation Spring Plant CIG grant in which you are participating. You may reach Mr. Crandall at 919-873-2103. On December 7, 2007, you requested assistance regarding a conservation plan for your outdoor swine operation. Without proper stocking rates, vegetative cover, buffers, and nutrient removal, outdoor swine facilities may potentially cause severe environmental degradation. NRCS requires conservation plans to be based on developed technical standards and planning policy. NRCS technical guidance regarding outdoor swine production does not recommend woodland as a permanent rotational portion (only for shade) of an outdoor swine production facility because of the potential for excessive nutrient loading, erosion, and tree damage. Current NRCS technical guidelines on outdoor swine facilities require either a pasture -based system for vegetative maintenance or a system of dry lot rotation with crops planted for removal of generated nutrients. At this time, NRCS technical and planning staff is reviewing your proposed production system to determine if any of your ideas can meet any of the existing technical guidance for conservation planning of outdoor swine. NRCS may provide technical assistance to plan only for practices that will mitigate water quality impacts (exclusion -type fencing, buffer practices, surface runoff management) if your production system does not meet conservation planning guidelines for outdoor swine operations. As a reminder, a 100 ft wide vegetative buffer is mandatory along all drainage ways, springs, wetlands, streams, creeks, ponds and other water bodies (see attached Conservation Planning Guidelines for Outdoor Swine Operations; Summary of NC Tech Note; 8/20/07). 1 strongly recommend that you contact the NC Department of Environmental and Natural Resources, Division of Water Quality regarding permits for swine operation at 919-733-7015. North Carolina law (Senate Bill 1217) states, if there are 250 or more total swine on your farm (includes in house and outdoor together), then your facility will need to apply for a permit from the Division of Water Quality and a confined lagoon system will be required to have a nutrient management plan for land application of waste materials. (4) For the outdoor management part of this production system: (a) his 'rotation' paddocks are going to be in the woods, we have no technical guidance for managing an entire production system in the woods, (b) he is planning to create permanent feeding areas with concrete pads, something our technical note specifically says shouldn't be done, (c) he's going to have 100-150 finishing hogs on (by my math) a little over 2 acres (actually a third of this for 90 days), thus he couldn't rotate these animals (too many) as in our dry lot scenario even he was going to Plant crops for nutrient uptake, (d) no vegetation establishment is planned, thus ruling out both our pasture and dry lot systems --vegetation establishment wouldn't be possible anyway because this outdoor operation is going to be in the woods, (e) nutrient loading in the woods by this number of pigs could be really high, with no rotational system for uptake The questions for us are: (1) if this is the production system, then should CIG be actually funding this with the potential severe environmental consequences??? (2) what guidance do we need to give Robert in providing assistance with this operation --obviously he can't plan using anything but our technical guidelines and practice standards, (3) is there anything that can be done to make this system an acceptable demonstration for EQIP/CIG, if not, what action needs to be taken? Below is Jeff's plans regarding the layout and operation of his outdoor swine operation including an attached sketch. The operation will utilize three existing hog houses and lagoon. The first house consists of 40 to 60 sows for breeding purposes. According to Jeff, each sow will average 10 to 15 pigs. The second house is where the pigs are born and will stay till they reach 60 lbs (max); which takes about one month and then they will be moved to the third house. At 'the third house, the pigs will stay till they reach 100 lbs (max) at which 1/2 of the population will be moved to the outdoor paddocks and the other 1/2 will remain in the house till they are sold at 240 lbs. Approximately, 100 to 150 pigs will all be placed in the first outdoor paddock where they will remain till they reach 240 lbs (max) which takes about 3 months. Then the next batch of pigs will be place in the second paddock and stay till sold. Once all the pigs have been sold in the third paddock, then a new batch of pigs will rotate back to the first paddock and the process starts all over. According to Jeff, it takes approximately 5 1/2 months from birth to market. Jeff's production goals are to sale 100 finishing hog (tope) per month. This problem must be permanently corrected. 4. —in addition, approximately seventy pigs have been allowed to roam free in the woods around the facility. These hogs have been confined in and allowed direct access to an area that encompasses the headwaters of Hubquarter Creek. The waste from these animals is not treated and flows down hill into natural conveyances. toward Lake Gaston. This creek constitutes surface waters of the State and. is classified as Class C. This discharge of waste from these animals to the surface waters of the State must be eliminated or permitted. If you can eliminate this discharge by implementing changes in -your operation within thirty (30) days of your receipt of this letter, no discharge permit will be required. This can be accomplished by, but not limited to, the removal of the animals from the woods, and/or fencing them off to allow the construction of a berm to collect the waste generated and then transport it to the lagoon for correct treatment and disposal. Hawkins Farm Facility ID#: 93-3 Warren County Dear Mr. Hawkins: [DIEHNFRZ Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly, requires a certified operator for each animal waste management system that serves 250 or more swine by January 1, 1997. The owner of each animal waste management system must submit a designation form to the Technical Assistance and Certification Group which designates an Operator in Charge and is countersigned by the certified operator. The enclosed form must be submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a certified operator for your animal waste management system is a violation of 15A NCAC 2H .0224 and may result in the assessment of a civil penalty. If you have questions concerning operator training or examinations for certification, please contact your local North Carolina Cooperative Extension Service agent or our office. Examinations have been offered on an on -going basis in many counties throughout the state for the past several months and will continue to be offered through December 31, 1996.
