We have attached a revised site plan of the Marina Village at Snug Harbor showing the deletion of the bulkheads. Also attached is a notarized copy of the text which will be included as part of the restrictive covenants for the development. Please review and let me know if you have any questions or comments. Covenant Compliance with Wetland & Buffer Regulations. In accordance with Title 15A NCAC 2H .500, lot numbers _ through ~, located in the Marina Village at Snug Harbor, Carteret County, North Carolina as shown on plans prepared by Carolina Engineers dated are to be developed in compliance with NCDWQ 401 Certification, NCDCM Major CAMA Permit # ,and USACOE General Wetlands Fill Permit # It has been determined that a portion of these lots have been determined to meet the requirements for designation as a wetland, stream or protected stream buffer. Any subsequent fill or alteration of this area shall conform to the requirements of the state rules adopted by the State of North Carolina in force at the time of the proposed alteration. The intent of this provision is to prevent additional wetland, stream or buffer filling or draining, so the property owner should not assume that a future application for filling or draining would be approved. The property owner shall report the name of the subdivision in any application pertaining to said rules. This covenant is intended to ensure continued compliance with all rules adopted by the State of North Carolina and therefore the State of North Carolina may enforce benefits.
