Wright Brothers Construction Co Inc. is in receipt of the Notice of Violation letter written on May 7,
2019 and referenced above. Wright Brothers is committed to restoring the pre -project dimensions of the
larger impoundment upon approval of the enclosed plan.
Wright Brothers placed material at the site on 4/24/19 & 4/25/19 from the neighboring R2519B project.
Wright Brothers would like to install a floating turbidity curtain around the area the material was placed
and excavate the material back out, as noted on the enclosed aerial picture. We would access the site as
noted on the drawing haul road. The material will be hauled to an approved site for reclamation per the
NCDOT and NCDEQ standards. Wright Brothers will work with the NCDOT and NCDEQ to assure all
necessary plan approvals are in place before work begins.
Wright Brothers sincerely believed this site had a mining permit that allowed the acceptance of waste
material. We received a copy of the permit and submitted it to the NCDOT as their standards. Wright
Brothers failed to wait on confirmation of the site before placing material. We did stop hauling
immediately upon the site visit with Mr. Barnett. While we can not undo the mistake, we will work in a
continuous manner upon approval to rectify the problem. We are accepting of any guidance the NCDOT
and NCDEQ can give us on improving the plan.

1.0 PROJECT AND SITE DESCRIPTION
Wright Brothers Construction Co Inc. has prepared this Restoration Plan, hereafter referred to as
the "Workplan", for the purpose of providing a detailed description of removal procedures,
which we will be implementing during the onsite removal of the material placed at Boone -
Woody Mining Co Inc (Pin: 085003002620000), located on NCDOT Project C203358, Yancey,
NC.
2.0 GENERAL WORK ACTIVITY OVERVIEW
The work covered under this Workplan will be conducted in a sequential manner, with some
activities being conducted concurrently with others. Restoration work will be performed in
accordance with OSHA, NCDOT, and the requirements of the federal agencies. A summary of
the general sequence for the work activities is outlined as follows:
• Pre -inspection of the site to confirm the area of disposal
• Pre -construction measurements of the area
• Installation of the turbidity curtain
• Excavation of the material placed at the site
• Removal of material to appropriate offsite disposal/recycling facilities.
2.1 WORK HOURS AND SCHEDULE
Restoration activity shall be conducted between 7:00 a.m. and 6:00 p.m. on weekdays and
weekends. Restoration work is expected to take approximately three days.
2.2 EQUIPMENT /MATERIAL STAGING AND PARKING
Vehicle and equipment parking will initially be located at the excavation site; however, staging
and parking may occur in other areas of the site during the course of Restoration activities.
2.3 DEBRIS/STOCKPILE STAGING
Soil and debris stockpiles will initially be staged in the existing roadway area of the site within
the terminated roadway; however, staging may be rotated to other site area during the course of
Restoration activities.
2.4 VEHICULAR TRAFFIC
Public vehicular traffic will he protected from the Restoration area. Flaggers will be used as
needed.
3.0 HEALTH AND SAFETY
Wright Brothers shall consider safety and the prevention of accidents an integral part of its
operation. Under Federal, State and local laws, Wright Brothers is responsible to provide a safe
working environment, and to protect life, health and safety of its employees and subcontractor's
personnel. Although providing safe working conditions is primarily a management
responsibility, safety and accident prevention can be accomplished only through coordinated
efforts of all employees and subcontractor personnel. If the task or service being undertaken
cannot be done safely, we shall discontinue work until proper controls can be established.
Wright Brothers will hold daily tailgate meetings for its employees prior to work
commencement.
These meetings are designed to discuss the projected work schedule and prepare each worker for
any potential hazards associated with the work activities. All personnel attending the safety
meeting will be required to sign the safety -meeting log upon completion of the tailgate safety
meeting. During the tailgate meetings, personnel will be reminded of site conditions and are
encouraged to participate with health and safety concerns.
4.0 RESTORATION ACTIVITIES
4.1 PRE -RESTORATION SURVEY
Prior to commencement of Restoration, a thorough walkthrough and evaluation of the site will be
conducted to confirm that all appropriate measures have been completed to ensure that the area is
ready for commencement of Restoration activities.
4.2 GENERAL RESTORATION ACTIVITIES
In general, the tasks will include a variety of procedures. The most important aspect in the
development of these procedures will be the safe conduct of the work. Wright Brother's
procedures will limit the use of labor to the most controlled and safe conditions and rely upon
mechanized means of removal wherever possible. Excavator and haul equipment will be utilitzed
to haul offsite and recycled accordingly.
Restoration will be conducted in a manner that does not interfere with or encroach upon the
existing surrounding.
5.0 EXCAVATION RESTORATION ACTIVITIES
Wright Brothers will install turbidity curtains around the work area. We will excavate from
existing ground level down to reclaim the material. Stabilization surrounding area will be done
as needed.
6.0 MATERIAL RECYCLING AND RESTORATION DEBRIS DISPOSAL
In accordance with the Waste Management Plan, all Restoration debris will be loaded into semi -
end dumps and hauled to an approved reclamation site.
7.0 STORMWATER POLLUTION PREVENTION (SWPPP) AND
EROSION CONTROL PLANS (ECP)
Wright Brothers will follow requirements for stormwater management and erosion control as
specified in the SWWPP. All equipment will be checked for leaks and drive train cleaned before
getting in proximity of the water. If additional reach is required to work safety, crane mats will
be available to assist in the positioning of equipment.
8.0 RESTORATION EQUIPMENT
The following will be the major pieces of equipment used in the Restoration, additional
equipment may be necessary based on conditions.
• Cat 336 Excavator
• Semi -end dumps
