Dear Mr. Bolich:
Groundwater Management Associates, Inc. (GMA) is assessing chlorinated aliphatic compound
contamination in Smithfield, Johnston County, on behalf of NCDOT. One application to construct a
nested well pair composed of one shallow monitoring well (11-MW17) and one deep monitoring well
(11-MW17D) is attached, as well as the right-of-way (ROW) encroachment agreement (R/W 16.1)
signed by the North Carolina Department of Transportation (NCDOT).
Both wells will be of Type II construction. The shallow monitoring well will be cased and screened to a
depth of 20 feet, and the deep monitoring well will be cased and screened to a depth of 50 feet. A
topographic map, a map of the existing and proposed new monitoring wells, and schematics of the

Dear Mr. Lawhorn,
Groundwater Management Associates, Inc. (GMA) is submitting the enclosed encroachment agreement for
additional groundwater investigations at the NCDOT Site #11, Former S.T. Wooten Asphalt Plant, Intersection
Peedin Road and Venture Drive, Smithfield, Johnston County. The completed right-of-way (ROW) encroachment
agreement (R/W 16.1), the VCER-1, site Figures 1-3, and well construction schematics are enclosed (Figures 4
and 5). Monitoring wells MW17 and MW17D are the two proposed in the ROW of Peedin Road.
Installation is expected to take a maximum of two days, will be marked with cones and proper flagging for
traffic during installation procedures. All underground utilities will be located prior to the installation of the wells
and will dictate the final drilling locations. The monitoring wells will be protected by flush mounted manhole
covers. The monitoring wells will be installed along the outer limits of the NCDOT ROW for SR 2403, will be
protected with flush-mount manhole covers, and placement and construction of these monitoring wells will not
obstruct or interfere with travel or the maintenance of SR2403.

party of the second part,
WITNESSETH
THAT WHEREAS, the party of the second part desires to encroach on the right of way of the public road designated as
Route(s) NC SR 2403 (Peedin Road) ,located At and within 500 feet of the property located at 130
E. Peedin Road, Smithfield, Johnston County, NC.
with the construction and/or erection of: Advancement of two monitoring wells (MW17and MW17D; max depths 25 and 50 feet
below land surface, respectively -see attached location figures and well construction schematics) along the southern side of
Peedin Road (SR 2403), at 130 E Peedin Road, Smithfield, Johnston County .
WHEREAS, it is to the material advantage of the party of the second part to effect this encroachment, and the party of
the first part in the exercise of authority conferred upon it by statute, is willing to permit the encroachment within the limits of the
right of way as indicated, subject to the conditions of this agreement;
NOW, THEREFORE, IT IS AGREED that the party of the first part hereby grants to the party of the second part the right
and privilege to make this encroachment as shown on attached plan sheet(s), specifications and special provisions which are
made a part hereof upon the following conditions, to wit:
That the installation, operation, and maintenance of the above described facility will be accomplished in accordance with the party of
the first part's latest POLICIES AND PROCEDURES FOR ACCOMMODATING UTILITIES ON HIGHWAY RIGHTS-OF-WAY, and such
revisions and amendments thereto as may be in effect at the date of this agreement. Information as to these policies and procedures
may be obtained from the Division Engineer or State Utility Agent of the party of the first part .
That the said party of the second part binds and obligates himself to install and maintain the encroaching facility in such safe and
proper condition that it will not interfere with or endanger travel upon said highway, nor obstruct nor interfere with the proper maintenance
thereof, to reimburse the party of the first part for the cost incurred for any repairs or maintenance to its roadways and structures
necessary due to the installation and existence of the facilities of the party of the second part, and if at any time the party of the first part
shall require the removal of or changes in the location of the said facilities, that the said party of the second part binds himself, his
successors and assigns, to promptly remove or alter the said facilities, in order to conform to the said requirement, without any cost to the
party of the first part.
That the party of the second part agrees to provide during construction and any subsequent maintenance proper signs, signal lights,
flagmen and other warning devices for the protection of traffic in conformance with the latest Manual on Uniform Traffic Control Devices
for Streets and Highways and Amendments or Supplements thereto. Information as to the above rules and regulations may be obtained
from the Division Engineer of the party of the first part.
That the party of the second part hereby agrees to indemnify and save harmless the party of the first part from all damages and
claims for damage that may arise by reason of the installation and maintenance of this encroachment.
That the party of the second part agrees to restore all areas disturbed during installation and maintenance to the satisfaction of the
Division Engineer of the party of the first part. The party of the second part agrees to exercise every reasonable precaution during
construction and maintenance to prevent eroding of soil; silting or pollution of rivers, streams, lakes, reservoirs, other water
impoundments, ground surfaces or other property; or pollution of the air. There shall be compliance with applicable rules and regulations
of the North Carolina Division of Environmental Management, North Carolina Sedimentation Control Commission, and with ordinances
and regulations of various counties, municipalities and other official agencies relating to pollution prevention and control. When any
installation or maintenance operation disturbs the ground surface and existing ground cover, the party of the second part agrees to
remove and replace the sod or otherwise reestablish the grass cover to meet the satisfaction of the Division Engineer of the party of the
first part.
That the party of the second part agrees to assume the actual cost of any inspection of the work considered to be necessary by the
Division Engineer of the party of the first part.
That the party of the second part agrees to have available at the construction site, at all times during construction, a copy of this
agreement showing evidence of approval by the party of the first part . The party of the first part reserves the right to stop all work unless
evidence of approval can be shown.
Provided the work contained in this agreement is being performed on a completed highway open to traffic; the party of the second part
agrees to give written notice to the Division Engineer of the party of the first part when all work contained herein has been completed .
Unless specifically requested by the party of the first part, written notice of completion of work on highway projects under construction will
not be required.
That in the case of noncompliance with the terms of this agreement by the party of the second part, the party of the first part reserves
the right to stop all work until the facility has been brought into compliance or removed from the right of way at no cost to the party of the
first part.
That it is agreed by both parties that this agreement shall become void if actual construction of the work contemplated herein is not
begun within one (1) year from the date of authorization by the party of the first part unless written waiver is secured by the party of the
second part from the party of the first part.
During the performance of this contract, the second party, for itself, its assignees and successors in interest (hereinafter referred to as
the "contractor"), agrees as follows :
a. Compliance with Regulations: The contractor shall comply with the Regulations relative to nondiscrimination in Federally-
assisted programs of the U. S. Department of Transportation, Title 49, Code of Federal Regulations, Part 21, as they may be
amended from time to time, (hereinafter referred to as the Regulations), which are herein incorporated by reference and
made a part of this contract.
b. Nondiscrimination : The contractor, with regard to the work performed by it during the contract, shall not discriminate on the
grounds of race , color, or national origin in the selection and retention of subcontractors, including procurements of materials

WITNESSETH
THAT WHEREAS, the party of the second part desires to encroach on the right of way of the public road designated as
Roule (s) NC SR 2403 (Peedin Road ) ,located At and within 500 feel of the property located a t 130

WHEREAS, it is to the material advantage of the party of the second part to effect this encroachment , and the party of
the first part in the exerCise of authority confe rred upon it by statute, is willing to permit the encroachment within the limits of the
right o f way as indicated, subject to the con ditions of this ag reement:
NOW, T HEREFORE, IT IS AGREED that the party of the first part hereby gran ts to the party of the second part the ri g ht
and privilege to make this encroachment as shown on attached plan sheet(s), specifications and special provisions which are
made a part hereof upon the following conditions, to wit:
That the Inslallatlon, operation, and maintenance of the above described fa cility wilt be accomplished in accordance with the party of
the first part's latest POLICIES AND PROCEDURES FOR ACCOMMODATING UTILITIES ON HIGHWAY RIGHTS-OF-WAY, and such
reVISions and amendments thereto as may be in effect at the date of this agreement. Information as to these polities and procedures
may be obta ined from the D iviSIOn Eng ineer or State Utili ty Agent of the party of the first part.
That the said party of the second part binds and obligates himself to install and maintain the encroaching facility In such safe and
p roper condition that It Will not i nterfere with or endanger travel upon said highway, nor obs truct nor Interfere With the proper maintenance
thereof, to reimburse the party of the first part for the cost incurred for any repairs or maintenance to Its roadways and structures
necessary d ue to the Installati on and existence o f the facilities of the party of the second part , and tf at any time the party of the first part
shall require the removal of or changes In the location of the sa id facilities , that the said party of the second part b inds himself, his
successors and assigns, to promptly remove or alter the said faCilities, in order 10 conform to the said requirement, without any COSI 10 the
party of the fi rst part
That the party of the second pan agrees to provide during construction and any subsequent ma i ntenance proper signs, signal lighls,
flagmen and other warning devices for the protection of traffic in conformance w ith the latest Manual on Uniform Traffic Control Devices
for Streets and Highways and Amendments or Supplements thereto Information as to the above rules and regulations may be obtained
from the DiV is ion Eng ineer of the party of the first part.
That the party of the second part hereby agrees to indemnify and save harmless the party of the first part from all damages and
claims for damage that may an se by reason of the installation and maintenance of this encroachment
That the party of the second part agrees to restore all areas dis turbed during ins tallation and maintenance to the satisfaction of the
Division Engineer of the party of Ihe first part. The p arty of the second part agrees to exercise every reasonable preca u tion during
construction and maintenance to prevent erodi ng of soil ; silting or pollution of nvers, streams, lakes, reservoi rs, other water
impoundments, ground surfaces or other property; or p Ollution o f the air . There shall be compliance with applicable rules and regulation s
of the North Carolina Div iSion of Environmental Management, North Carolina Sedimentation Control Commission, and wi th ordinances
and regulations of various counties, municipalities and other official agencies re lat ing to pollution prevention and contro l. When any
inSlallallOn or maintenance operation disturbs t he ground surface and eXlsttng ground cover, the party of the second part agrees to
remove and replace the sod or othel'\'Vise reestablish the grass cover to mee t the satisfaction of the Division Engineer of the party of Ihe
first part,
That the party of the second part agrees \0 assume the actual cost of any inspection of the work considered to be necessary by the
Division Engineer of the party of the first part.
That the party of the second part agrees to have available at the construction site, a t all times dunng construction, a copy of this
agreement showing evidence of approval by the party of the first part . The party of Ihe first part reserves the right to stop all work unless
evid~nce of approval can be shown.
Provided the work contained in this agreement is being performed on a completed highway open to traffic; the party of the second part
agrees to give written notice to the Division Engineer of the party of the first part when all work contained herein has been completed

OUTIng the performance of thiS contract, the second party , for itself, its ass ignees and successors In in teres t (herei nafter referred to as
the 'contractor'"), agrees as follows:
a. Compliance with Regulalions: The contractor shall comply with the Regulations relative to nondiscrimination In Federally.
assisted programs of the U. S. Department of Transportalion, nile 49 , Code of Federal Regula tions , Part 21 , as they may be
amended from time to time, (hereinafter referred to as the Regulations), which are heroin Incorporated by r eference and

GENERAL REQUIREMENTS

prior to submission of encroachment ag reemen t to the Division Engineer.
2. All crossings should be as near as possible normal to the centerline of the highway .
3. Minimum vertical clearances of over head wires and cables ab ove all roadways must conform to clea rances set out in
the Nat ional Electric Safety Code
4 . Encasements shall extend from ditch line to ditch line In cut sections and 5' beyond loe of slopes in fill sections ,

Standard Provisions
1. An executed copy of this Encroachment Agreement will be present at the construction site
at all times during construction. NCDOT reserves the right to stop all work unless
evidence of approval can be shown.
2. All materials and construction shall be in accordance with NCDOT standards and
specifications, including but not limited to, the current NCDOT Standard Specifications
of Roads and Structures, NCDOT Roadway Standard Drawings, and NCDOT Policies, &
Procedures for Accommodating Utilities on Highway Rights of Way.
3. The traveling public shall be warned of construction with complete and proper signing
and traffic control devices in accordance with the current NCDOT Standard Specifications
of Roads and Structures and NCDOT Roadway Standard Drawings. No work shall be
performed in the Right of Way unless this requirement is satisfied. NCDOT reserves the
right to require a written traffic control plan for encroachment operations.
4. NCDOT does not guarantee the Right of Way on this road, nor will it be responsible for
any claim for damages brought by any property owner by reason of the installation. All
Right of Way and easements necessary for construction and maintenance shall be
dedicated to NCDOT with proof of dedication furnished to the District Engineer prior to
beginning work.
5. Two-way traffic shall be maintained at all times. Lane closures shall be performed us}ng
proper signing and flagged techniques as described in the current NCDOT Standard
Specifications of Roads and Structures NCDOT Roadway Standard Drawings, and
NCDOT Policies and Procedures for Accommodating Utilities on Highway Rights of
Way.
6. No lane of traffic shall be closed or restricted before 9:00 a.m. or after 4:00 p.m.
7. NCDOT reserves the right to further limit, restrict, or suspend operations within the Right
of Way if, in the opinion ofNCDOT, safety or traffic conditions warrant such action.
8. The Traffic Services Supervisor shall be notified in Wilson, N. C. at (252) 640-6400 prior
to beginning work on the Right of Way if there are existing NCDOT signs. traffic signals.
or signal equipment in or near the proposed work zone. Costs to relocate, replace, or
repair NCDOT signs, signals, or associated equipment shall be the responsibility of the
Encroacher.

9. All erosion control devices and measures shall be constructed, installed, maintained, and
removed by the Permittee in accordance with all applicable Federal, State, and Local laws,
regulations. ordinances, and policies. All earth areas shall be regraded and seeded in
accordance with the current NCDOT Standard Specifications for Roads and Structures.
10. When surface area in excess of one acre will be disturbed. the Encroacher shall submit a
Sediment and Erosion Control Plan which has been approved by the appropriate
regulatory agency or authority prior to beginning any work on the Right of Way. Failure
to provide this information shall be grounds for suspension of operations.
11. Notify the County Maintenance Engineer's Office prior to beginning work at «919) 739-
5330 in Wayne County or (919) 209-1110 in Johnston County).
12. The District Engineer shall be notified in writing at 2671 US 70 West, Goldsboro, N.C.
27530 upon completion of work associated with this agreement.
13. It shall be the responsibility of the Encroacher to determine the location of utilities in the
encroachment area. The Encroacher shall be responsible for notifying utility owners.
providing protection and safeguards to prevent damage or interruption to existing
facilities, and for maintaining accessibility to existing utilities.
14. The encroacher shall furnish verification signed by a Professional Engineer certifying this
utility was installed as shown on the final approved construction plan. A Contractor
Certification Memo is attached to the encroaching party's contract and shall be signed.

15. Owners of Communication Enclosures with Electrical Power are required to provide
advanced notice to adjacent property owners of the proposed enclosure location 15 days
prior to construction.
16. Owners of Communication Enclosures with Electrical Power are required to provide
municipalities 15 days advanced notice prior to construction.

1 7. The party of the second part shall provide traffic control devices, lane closures, road
closures, positive protection and/or any other warning or positive protection devices
necessary for the safety of road users during construction and any subsequent
maintenance. Tilis shall be performed in conformance with the latest NCDOT
Roadwav Standard Drawings and Standard Specifications {or Roads and Structures
and Amendments or Supplements thereto. When there is no guidance provided in the
Roadway Standard Drawings or Specifications, comply with the Manual on Uniform
Traffic Control Devices {or Streets and Highwavs and Amendment or Supplement
thereto. Information as to the above rules and regulations may be obtainedfrom ti,e
Division Engineer of the party of the first part.
18. NCDOT WORK ZONE TRAFFIC CONTROL OUALIFICATIONS AND TRAINING
PROGRAM -Effective Ju{v 1, 2010, allflagging operations within the NCDOT Right
of Way require qualified and trained Work Zone Flaggers. Effective July 1, 2011,
qualified and trained Work Zone Traffic Control Supervisors will be required on
Significant Projects. It is intended for the program to include anyone working within
NCDOT Right of Way including work associated with NCDOT construction and
encroachment agreements as well as all NCDOT operations.
Training for this certification will be provided by NCDOT approved training sources
and/or private entities that have been pre-approved to train themselves. If you have

Special Provisions
1. The Encroacher shall contact the County Maintenance office at (919) 209-1110 in
Johnston County for inspection. The Encroacher shall provide 24 hours notification
for in~pections.
2. Notify the appropriate utility departments/companies prior to beginning work.
3. The proposed monitoring wells shall be placed as far as possible from the existing EP, or
as close as possble to the right-of-way line.
4. Excavated material shall not be placed in the roadway at any time.

5. Any damaged storm drainage pipes, pavement, pavement markings, reflectors or curb and
gutter shall be repaired and/or replaced by the encroaching party. Right-ol-Way
monuments disturbed during construction shall be referenced by a Professional Land
Surveyor and reset after construction.
6. Any traffic control including lane closure or detour shall be the responsibility of the
encroaching party notifying the DOT of closure or detour one week prior to closure.
7. Excavation within 500 feet of a signalized intersection will require notification by the
party of the second part to Andy Brown, PE -Division Traffic Engineer at telephone
number (252) 640-6400. All traffic signal or detection cables must be located prior to
excavation.
8. Excavated areas adjacent to pavement having more than a 2 inch drop shall be made safe
with a 6: 1 or flatter slope and shall be designated by appropriate delineation during
periods of construction inactivity including, but not limited to, night and weekend hours.
9. All COST, LIABILITY and MAINTENANCE of the installation SHALL be the
responsibility of the encroaching party.
10. NCDOT approval of this Encroachment Agreement covers only the area with in NCDOT
R/W and does not grant permission to work in any RAIL ROAD RIGHT OF WAYS, Wet
Land, Sensitive Environmental Areas, Private Property Etc. Permits and permission must
be obtained from the appropriate authorities.
11. Well cap shall be flush mounted with the ground/pavement surface in areas within the
clear recovery area and the routine mowing boundaries, with the frame and cover
designed for HS 20 loading.
12. Any contaminated soils encountered in construction as spoil from the well installation
shall be removedfrom the Right of Way prior to completion of the wells.
13. After the monitoring well has served its intended purpose, the encroaching party shall
fill the well(s) in a manner approved by the Division of Environmental Management.
Any above ground obstructions shall also be removed from the Right of Way.
14. After installation is complete, markers should be placed noting the well location to prevent
risk of accidental damage.

15. All ditches, slopes and other disturbed area shall be shaped to a uniform grade and seeded
as per attached seeding instructions. All seeding operations SHALL be done with in a
reasonable time frame.
16. There SHALL be no wells,valves, meters, manholes or markers set in roadway ditches.
17. If there are any changes to be made from the original plan location with in the NCDOT
Roadway or RlW the encroaching party shall cease work immediately and notify DOT for
re-evaluation and approval of possible changes from the original encroachment contract.
18. There SHALL be no excavating or drilling equipment operating within the roadway.
19. If this installation requires traffic stoppage, appropriate law enforcement shall be available
on site to direct traffic.

NCG-O 1 0000 general construction permit effective August 3, 2011 issued by the North Carolina
Department of Environment and Natural Resources Division of Water Quality. Temporary or
permanent ground cover stabilization shall occur within 7 calendar days from the last land-
di'sturbing activity, with the following exceptions in which temporary or permanent ground cover
shall be provided in 14 calendar days from the last land-disturbing activity:
• Slopes between 2: 1 and 3: 1, with a slope length of 10ft. or less
• Slopes 3:1 or flatter, with a slope of length of 50 ft. or less
• Slopes 4: 1 or flatter
The stabilization timeframe for High Quality Water (HQW) Zones shall be 7 calendar days with
no exceptions for slope grades or lengths. High Quality Water Zones (HQW) Zones are defined
by North Carolina Administrative Code 15A NCAC 04A.0 105 (25). Temporary and permanent
grbund cover stabilization shall be achieved in accordance with the provisions in this contract
and as directed.
SEEDING AND MULCHING: (East)
The kinds of seed and fertilizer, and the rates of application of seed, fertilizer, and limestone,
shall be as stated below. During periods of overlapping dates, the kind of seed to be used shall
be, determined. All rates are in pounds per acre.

On cut and fill slopes 2: 1 or steeper Centipede shall be applied at the rate of 5 pounds per acre
and add 20# ofSericea Lespedeza from January 1 -December 31.
Fertilizer shall be 10-20-20 analysis. A different analysis of fertilizer may be used provided the
1-2-2 ratio is maintained and the rate of application adjusted to provide the same amount of plant
food as a 10-20-20 analysis and as directed.
TEMPORARY SEEDING:
Fertilizer shall be the same analysis as specified for Seeding and Mulching and applied at the rate
o~ 400 pounds and seeded at the rate of 50 pounds per acre. Sweet Sudan Grass, German Millet
or Browntop Millet shall be used in summer months and Rye Grain during the remainder of the
year. The Engineer will determine the exact dates for using each kind of seed.
FERTILIZER TOPDRESSING:
Fertilizer used for topdressing on all roadway areas except slopes 2: 1 and steeper shall be 10-20-
20 grade and shall be applied at the rate of 500 pounds per acre. A different analysis of fertilizer
may be used provided the 1-2-2 ratio is maintained and the rate of application adjusted to provide
the same amount of plant food as 10-20-20 analysis and as directed.
Fertilizer used for topdressing on slopes 2: 1 and steeper and waste and borrow areas shall be 16-
8-8 grade and shall be applied at the rate of 500 pounds per acre. A different analysis of
fertilizer may be used provided the 2-1-1 ratio is maintained and the rate of application adjusted
to provide the same amount of plant food as 16-8-8 analysis and as directed.
SUPPLEMENTAL SEEDING:
The kinds of seed and proportions shall be the same as specified for Seeding and Mulching, with

the exception that no centipede seed will be used in the seed mix for supplemental seeding. The
rate of application for supplemental seeding may vary from 25# to 75# per acre. The actual rate
per acre will be determined prior to the time of topdressing and the Contractor will be notified in
writing of the rate per acre, total quantity needed, and areas on which to apply the supplemental
seed. Minimum tillage equipment, consisting of a sod seeder shall be used for incorporating
seed into the soil as to prevent disturbance of existing vegetation. A clodbuster (ball and chain)
may be used where degree of slope prevents the use of a sod seeder.
MOWING:
The minimum mowing height on this project shall be 4 inches.
