Hello Friends -
wanted to follow-up with you all regarding the hog lagoon on the landlocked Haynes Farm that is located just north of
Brassfield Road in Granville County. Amy Edge and I met the listing agent (Julie Wright) yesterday to see the property, It
is a beautiful property that the Conservancy hopes to acquire. The streams and wetlands on the Haynes property connect
directly to adjoining US Army Corps land around Falls Lake.
Attached is a photo taken yesterday of the lagoon on the Haynes Farm (disregard the date on the photo), The family
indicates that the deceased Mr. Haynes had the lagoon cleaned out in the 1980s or 1990s and that the lagoon has filled
up with rainwater since that time. We observed the dam to be intact with trees growing on it yesterday. If the lagoon was
ever drained, it does not appear that the dam was cut. We did not see any signs that the water in lagoon has ever
breached the dam. My quick estimate was that the water was about 18 inches below the top of the dam. We let the
listing agent know that TRLC and the family would need to work out a plan for the lagoon to be properly closed before the
Conservancy could consider acquiring it. After seeing the lagoon yesterday, the agent understands and agrees 100%.
We would welcome your guidance on how to address the lagoon. Please let me know if you (or someone from your
office) can visit the site with me and Amy any of these mornings:

The access path to the Haynes property is through three other property owners. Once we have a date, I can ask the
Haynes farm caretaker to unlock the gate for our visit.

The Division has always taken the stance that the current property owner is the "Responsible Party" should an overflow
or other discharge occur.
We have also always taken the stance that " Once a Lagoon, Always a Lagoon", until properly closed to NRCS current
standards.
We can certainly add this one to our inventory of abandoned sites.

Buster - I found the deeds when the property was owned by Robert and Sylvia Sutter from 1977 to —1985 - they appear to
have lost it to foreclosure by USDA FHA. Then Goldston bought it in 1985 and held it until 1989 until swapping with
Haynes Hog Corp. Haynes Hog Corp transferred to Helen Haynes Revocable Trust at some point. Under NC law who is
responsible for closing the lagoon: The last operator? The owner when the operation ceased? The current owner of the
tract?
How do we determine if the lagoon is still contaminated?

Sorry for the delay. I had to ge tin and out pretty quick this morning. Yes I have this facility as being registered as Haynes
Hogs. (Facility # 39-13) on SR 1717 % miles N. of the Wake line.
Does this match your information?.
This was removed from the Registration Data back in 1996, but was sent the same letter that all of these previously
abandoned facilities got which stated that.there are "Deemed Permitted" and that no discharges can occur. I will check
further as the last time anyone from this office was there.

Hello Buster - Tar River Land Conservancy has been asked to take a look at.a property near Creedmoor in Granville
County that we figured out has three abandoned hog houses on it. I have attached the GIS shapefiles for the property,
which is owned by Mrs. Helen Haynes (widow). Does your list show an inactive lagoon on this property? There appears
to be an old lagoon on the aerial photo. I have not been out but will probably visit in late August. Any info you might have
would be helpful.

Thanks very much. Buster discovered that there were 2 Haynes farms - one -on the Granville -
Wake line on State Road 1700 where his records show that Teresa closed out a lagoon. The
Haynes family have another farm located off of Brassfield Road (State Road 1717) in Granville
County near Creedmoor that the family acquired in 1989 - see attached aerial photo of the
farm in relation to current roads and neighborhoods.
Teresa, do you recall if the lagoon that you closed was on their Brassfield Rd farm, or the
other farm on State Road 1700?

Yes, we closed the lagoon; breached the dam and put in a pipe so rainwater would flow out.
All residues were applied to the cropland at agronomic rates. Page Haynes even used a broom
to sweep out the last residues of the concrete bottom.

I spoke with Buster Towel this afternoon about old Haynes hog lagoon. He says he has some
records that the Wake District may have worked on trying to close it back in 1996? Anyways,
he tried calling you but you were out of the office. His number is 919-791-4239. You may
recall something.
Warren said BJ seemed to be involved with it, but he wasn't or myself during our time here.
I vaguely recall , each time BJ would try to do a field visit, access was blocked to go back
there..

Hi Diana - Tar River Land Conservancy has been contacted by a real estate agent about a tract
near Creedmoor owned by Mrs. Helen Haynes. The 119-acre tract is located north of Brassfield
Road and is bisected by Robertson Creek (in the Neuse Basin). Attached are the GIS files for
the property. The Creedmoor planning department tells me that there are abandoned hog houses
on the property. Do you have any records of an abandoned hog lagoon on this property? I
plan to visit in August but wanted to gather background information before I met with the
real estate agent. The property is landlocked and has a lot of creek frontage and beaver -
maintained wetlands. The best use may be as open space. Any info you have on the property
would be welcomed, including if you or Warren assisted to close a lagoon on the site in the
past.

Dear Mr. Haynes:
On August 1, 1996, Ms. Vanessa Manuel of the Raleigh Regional
Office conducted a Compliance Inspection of the subject animal
facility accompanied by yourself. Both your on -site assistance and
cooperation was very helpful and appreciated. The inspection is a
part of the Division's efforts to annually inspect registered
animal operations. As a result of the inspection, the following
comments and/or recommendations were developed:
I. At the time of the inspection, wastewater from this
facility was not discharging to the surface waters of the
State. No manmade pipes, ditches, or other prohibited
conveyances (for the purpose of discharging wastewater)
were observed.
2. One holding pond with a concrete bottom is in existence
at the subject facility. The holding pond had at least
three (3) feet of available freeboard. No erosion, large
trees, or animal holes- were ,observed along the dam or
side slope of the dam wall which could compromise the
integrity of the holding pond.
The subject animal facility is no longer in operation. As stated
by yourself and supported by Ms. Teresa Hice with the Wake field
office of the Soil and Water Conservation District, Haynes Hogs is
undergoing the proper closure procedure to close out the business
and to prevent potential environmental impacts. Ms. Hice stated
the Closure Plan was recently approved, and Cost Share Money will
be dispersed to aid in the cost to land apply the remaining animal
waste from the holding pond and then to breech the dam. The entire
closure procedure is targeted for completion the end of either
September or October of this year.
Effective wastewater treatment and facility stewardship are a
responsibility of all animal facility operators. The Division of

This is to acknowledge receipt of your request that your facility no longer be registered as an animal waste
management system per the terms of 15A NCAC 2H .0217. The information you provided us indicated that your operation's
animal population does not exceed the number set forth by 15A NCAC 2H .0217, and therefore does not require registration
or a certified animal waste management plan.
Under 15A NCAC 2H .0217, your facility is deemed permitted if waste if properly managed and does not reach the
surface waters of the state. Any system determined to have an adverse impact on water quality may be required to obtain a
waste management plan or an individual permit. You are reminded that a discharge of wastes to the surface waters of the state
will subject you to a civil penalty up to $10,000 per day.
Should you decide to increase the number of animals housed at your facility beyond the threshold limits listed below,
you will be required to obtain a certified animal waste management plan prior to stocking animals to that level. Threshold
