This evaluation is conducted as a part of the Division's effort to determine compliance with the State's Animal Waste Management Regulations. As a result of the visit the following violations were observed: Animal operations with waste lagoons and/or holding ponds are required to maintain sufficient freeboard that the maximum liquid level must be far enough below the spillway to allow for containment of all the rainwater that would reach the holding pond during the 25- year, 24-hours storm. This includes the rain that falls into the holding pond as well as all rainwater that drains into the holding pond. This effluent should never be in the volume set aside for the 25-year, 24-hour storm storage unless the 25-year, 24-hour storm has occurred. on February 5, 2002 the liquid was observed at the crest of the spillway, but was not actively discharging during the visit. Also, Mr. Bunt observed cattle that were in the unnamed tributary to Pokeberry Creek. Animal access to stream may result in a water quality standards violation due to the wastes and/or sediment from animal activity. Animal feedlots should be located as far as practical from downslope drainage ways, perennial streams, or ponds. No direct discharge as a result of a rainfall less severe than the 25- year, 24-hour storm event is permitted from confined or concentrated cattle feedlots. N. C. Solid wastes were being pushed into this holding pond. Mr. Hunt observed cattle that were in the unnamed tributary that flows to the Rocky River. Animal access to streams may result in a a, water quality standards violation due to the wastes and/or sediment from animal activity. Animal feedlots should be located as far as practical from downslope drainage ways, perennial streams, or ponds. No direct discharge as a result of a rainfall less severe than the 25- year, 24-hour storm event is permitted from confined or concentrated cattle feedlots. You should be aware that a discharge reaching waters of the state from the large stockpile of uncovered solid wastes would also constitute a violation of N.C. General Statue 143-215.1(a). NCDEM N. C. Dairy Chatham County Dear Mr. Strowd: On November 10, 1997, Terri Hollingsworth from the Raleigh Regional Office conducted a compliance inspection of the subject animal facility. This inspection is part of the Division's efforts to determine compliance with the State's animal waste nondischarge rules. The inspection determined that the cattle operation was not discharging wastewater into waters of the State at the time of the inspection. However, conditions exists that require your immediate attention to prevent an illegal discharge which is subject to civil penalties of up to $10,000 per day, per violation. The amount of freeboard in your holding pond was inadequate. Animal waste holding ponds are required to maintain enough freeboard (19 inches) so that no discharge of wastewater will occur during any rainfall event less severe than a 25 year124 hour storm. Please respond in writing to this office, within 14 days of receipt of this letter, outlining your plans to correct this condition. This bill required that a properly certified operator be designated as the Operator in Charge for each animal waste management system that serves 250 or more swine, 100 or more confined cattle, 75 or more horses, 1,000 or more sheep, or 30,000 or more confined poultry with a liquid animal waste management system. The deadline for designating an Operator in Charge for animal waste management systems involving cattle, horses, sheep, 'or poultry was January 1, 1997. Because a training and certification program was not yet available for these systems, you were allowed to apply for and were issued a temporary animal waste management certificate from the Water Pollution Control System Operators Certification Commission (WPCSOCC). Because you applied for and were issued a temporary certificate, you were allowed to be designated as the Operator in Charge of an animal waste management system. Your temporary certificate expires December 31, 1997, and is not renewable. Our records indicate that you have not obtained a permanent animal waste management system operator certification.
