Subject: Comments on the Finding of No Significant Impact related to proposed Bridford Parkway Extension (SR 4126) in Guilford County, WBS Element No. 35007.1.1, Federal Aid Project No. STP-4126(1), TIP U-4006, DENR Project Number 05-0305. This office has reviewed the referenced document. The Division of Water Quality (DWQ) is responsible for the issuance of the Section 401 Water Quality Certification for activities that impact Waters of the U,S., including wetlands. It is our understanding that the project as presented will result in impacts to jurisdictional streams. The DWQ offers the following comments based on review of the aforementioned document: A) Prior to an issuance of the 40 I Water Quality Certification, the NCDOT is respectfully reminded that they will need to demonstrate the avoidance and minimization of impacts to wetlands and streams to the maximum extent practical. B) In accordance with the Environmental Management Commission's Rules (15A NCAC 2H,0506(b)(6)}, mitigation will be required for impacts of greater than 150 linear feet to any single perennial stream. In the event that mitigation is required, the mitigation plan should be designed to replace appropriate lost functions and values, In accordance with the Environmental Management Commission's Rules {15A NCAC 2H,0506 (h)(3)}, the NC Ecosystem Enhancement Program may be available for use as stream mitigation. C) As part of the 401 Water Quality Certification Application process, NC DOT is respectfully reminded to include documentation of stream detenninations (i,e. intennittentJperennial) and wetland delineations. D) Future documentation, including the 401 Water Quality Certification Application, should continue to include an itemized listing of the proposed wetland and stream impacts with corresponding mapping. E) NC DOT is respectfully reminded that all impacts, including but not limited to, bridging, fill, excavation and clearing, to jurisdictional wetlands, streams, and riparian buffers need to be included in the final impact calculations. These impacts, in addition to any construction impacts, temporary or otllerwise, also need to be included as part of the 40 1 Water Quality Certification Application. F) Sediment and erosion control measures should not be placed in wetlands. G) Borrow/waste areas should avoid wetlands to the maximum extent practicable. Impacts to wetlands in borrow/waste areas could precipitate compensatory mitigation. The NCDWQ appreciates the opportunity to provide comments on your project. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. Access road to the building site was located against adiacent property line to minimize impacts to wetlands at front of the property. Some impacts were necessary for the location of the main building in order to fit it and required parking areas on the property and to accommodate required buffers from adiacent residential properties. Site development and construction sequence is outlined on the attached grading and erosion control plan Sedimentation and erosion control measaures as well as storm water measures will be installed in sequence to minimize sediment and surface water runoff from the site. Permanent storm water retention basin will serve a similar function as a wetland and will offset the loss of wetlands on the site. VIII. Mitigation DWQ - In accordance with l5A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 lfuear feet of total impacts to perennial streams. USACE - In accordance with the Fmal Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in oetennining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any' application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete.
