To Whom It May Concern:
You have our approval, in accordance with 15A NCAC 02B .0233 and any conditions listed below, to
impact approximately 1,530 ft2 of Zone 1 and 800 ft2 of Zone 2 of the protected riparian buffers for the
purpose of constructing the two pedestrian bridges at the subject property as described within your
application dated April 18, 2005. In addition, you should obtain or otherwise comply with any other
required federal, state or local permits before you go ahead with, your project including (but not limited
to) Erosion and Sediment Control, and Non-discharge regulations.
This approval is for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this authorization and approval letter and is thereby responsible
for complying with all conditions. This approval requires you to follow the conditions listed below.
The Additional Conditions of the Certification are:

3. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within these
boundaries approved under this authorization shall be clearly marked with orange warning
fencing (or similar high visibility material) for the areas that have been approved to infringe
within the buffer, wetland or water prior to any land disturbing activities to ensure compliance
with 15A NCAC 213.0233.
4. Certificate of Completion
Upon completion of all work approved within this authorization, and any subsequent
modifications, the applicant is required to return the attached certificate of completion to the
401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center,
Raleigh, NC, 27699-1650.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved
buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is
subject to review as provided in Articles 3 and 4 of G.S. 150B. This Authorization Certificate shall
expire five (5) years from the date of this letter.
This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 213
.0233. If you have any questions or would like a copy of the buffer rules, please call [phone].
This letter does not authorize any impacts to either Waters of the United States or Waters of the State.
Please contact the US Army Corps of Engineers (USACE) or NC Division of Water Quality (DWQ) if

Enclosed are a letter for the location of Neuse River Riparian Buffers , and a new
application for the bridge spans across the buffer. The Wetland impact total has been
increased, but it is still well below the 0.1 acre allowed with just notification. Square
footages have been added to the buffer impact table. These pedestrian bridges are 10 feet
wide and span the entire buffer. Any impact to this buffer will be miniscule. Light will
easily be able to access these areas, vegetation will be able to grow. A few trees will be
removed in order to set the bridge and piers. The buffer amounts on the chart have been
calculated by taking 10 foot times the length. Please respond as quickly as possible. Our
first submittal for these bridge crossings was on February 8`h 2005. We have responded
quickly every time we have been asked for additional information.

Attach a vicinity map clearly showing the location of the property with respect. to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.

VIII. Mitigation
DWQ - In accordance with 15A NCAC 21-I .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
littp://li2o.enr.state.nc.us/ncwetlands/strmgide.litm1.
1. Provide a brief description of the proposed mitigation plan. The description should provide

Dear Sir or Madam:
On February 9, 2005, the Division of Water Quality (DWQ) received your application dated February 8,
2005 and the additional information submitted and received on March 1, 2005 to impact no wetlands, no
stream and no protected riparian buffers (previously impacted 0.01 acres of wetlands) to construct the
proposed pedestrian bridges at Taryn Meadows Subdivision. The DWQ has determined that your
application was incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application to impact protected wetland, streams
and/or buffers on the subject property. Therefore, unless we receive the additional information requested
below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and
213 .0233(8) and will place this project on hold as incomplete until we receive this additional information.
Please provide five (5) copies of the following information so that we may continue to review your
project.
Additional Information Requested:
1. Your project is located in the Neuse River Basin, along with your request for Riparian Buffer
Authorization, you have submitted a subdivision plan for Taryn Meadows, and the DWQ has no
history of this subdivision. In our previous letter, we requested a county soil survey for this project
and it was provided on March 1, 2005. It is still unclear if the DWQ has conducted a site visit to
determine if these two stream features that are within Phase 1 of the development are subject to the
Neuse Riparian Buffer Rule. Please provide a letter from the DWQ that states whether these two
stream features are subject or not.
2. In your application, you are requesting Riparian Buffer Authorization for the impact of two
pedestrian bridges that cross over Beaverdam Creek, however there are no impacts listed on the
impact table within the application. Please be aware that the clearing of trees for the construction of
a pedestrian bridge and the permanent shading of the bridge is riparian buffer impacts. Please fill
out the Pre-Construction Notification Application correctly with the impacts requested listed in the
impact table, this should include impacts needed for the construction of the impact.

3. The subdivision plan provided within your application for Phase 1 of Taryn Meadows show what
looks to be a possible sewer line constructed in Phase 1 and Phase 2 of the Taryn Meadows project.
Please supply information as to if this sewer line exists, if it has been constructed for your project or
if it will be constructed for your project. This is the shaded linear area that runs north and south
within your project and along the flood plain of Beaverdam Creek.
Please respond within three weeks of the date of this letter by sending this information to me in writing
and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks,
we will assume that you no longer want to pursue this project and we will consider the project as
withdrawn.
This letter only addresses the application review and does not authorize any impacts to wetlands, waters
or protected buffers. Please be aware that any impacts requested within your application are not

Attach a vicinity map clearly showing the location of the property with respect to local

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and

site layouts, and explain why these design options were not feasible. Also discuss how impacts

VIII. Nlitigmion
DWQ - In accordance with 15A NCAC 2I-1 .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to

freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration

Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at

Taryn Meadows Bridge Study
Johnny Watson Builders Inc. plans to build two boardwalks across Beaverdam Creek in
Zebulon, North Carolina. This stream was studied in the Wake County FEMA study and
is designated as Basin 11 Stream 3 in the FEMA study. Bridge #1 is located near the
location of Section H in the FEMA study. Bridge 42 is located 600 feet upstream. The
flood elevations with floodways are 302.2 for bridge #1 and 306.3 for bridge 42.
These bridges are proposed to provide access to the common open space north of the
stream for the residences of Taryn Meadows. As shown in the "floodplain cross-section"
and the boardwalk design drawing, the bottom of the bridge deck system is to be six
inches above the floodway elevation. Both bridges are to be one hundred feet long with
handicap ramps on each end extending to natural ground. These ramps are outside the
FEMA floodway, which is 85 feet in width. The only obstructions located within the
floodway are the support posts. These are eight-inch square posts located on ten feet
centers. Thus there are nine posts supporting each deck structure. The total area of
proposed obstructions is 72 horizontal inches.
The floodway is wooded throughout the length of the project. Picture 91 shows the
location of bridge #1. Pictures #2 and 3 show the location of bridge #2. Tree surveys
were taken at these locations across the floodway to determine the trees which must be
removed for bridge construction. List #1 is for bridge #1 and List 42 is for bridge Q.
The obstructions which must be removed in order to construct the bridges total 98
horizontal inches for bridge #1 and 85 inches for bridge #2. Thus, the amount of flow
obstructions will be reduced by construction of the bridges and there will be no rise in
flood elevation.
The FEMA study shows allowable filling of the flood fringe which results in a rise of 0.4
feet. Filling of the flood fringe is not proposed in conjunction with the bridge
construction. The proposed construction results in less obstruction than presently exists
and the flood fringe is not being filled; thus, there will be no rise in the flood protection
elevation due to construction. The flood elevation actually is less than the stated base
flood elevation with floodway as stated in the FEMA study.
