Pancho Bank Parcel Credit Release - Task 8 final
Dear Mr. Howard:
On December 19, 2017, the Division of Water Resources (DWR) received a Year 5 Monitoring
Report from Restoration Systems, LLC (RS) for the Pancho Mitigation Bank, located in Wayne
County, North Carolina. On August 23, 2018, DWR issued a partial credit release (2.5%) for
partial approval of the monitoring report. An Area of Concern (AOC) was observed by Katie
Merritt, with DWR, during an onsite visit on March 28, 2018 to evaluate the site's conditions for
closeout of the monitoring requirements. A remedial action plan was submitted to Ms. Merritt
by RS to address the AOC. On December 17, 2018, RS submitted written documentation
indicating the remedial action plan had been fully implemented. On April 11, 2019, Ms. Merritt
revisited the site to evaluate the AOC. Ms. Merritt's findings were also documented in photos
provided with this letter. As a result of this site visit evaluation Ms. Merritt supports closing
out the site for any further monitoring of the riparian vegetation.
By copy of this letter, the monitoring requirements at the subject site have been met and DWR
is releasing RS from its financial assurance obligations under Performance Bond No.
22BSBGQ8686 with the Hartford Fire Insurance Company.
According to the UMBI signed on March 17, 2008, the following additional Project Milestones
have been fully met, and the corresponding credits shall be released:

By copy of this correspondence, DWR confirms that you have fully satisfied the above
requirements for the above -referenced tract and 7.5% of your Neuse riparian buffer credits
(0.075 x 218,671.2 ft2 = 16,400.34 ft2) are now available for sale. Additionally, 7.5% of your

nitrogen nutrient offset credits (0.075 x 25,753.311b -N = 1,931.50 lb -N) are now available
for sale. Please update your credit ledgers accordingly.
Please note that nutrient offset credits generated at this site must be used for
impacts in HUC 03020201 of the Neuse River Basin excluding the Falls Watershed.
Additionally, the riparian buffer credits must be used for impacts in the Neuse River
Basin according to guidelines in 15A NCAC 02B.0295, which became effective on
November 1, 2015.
