We have no comment for the Caldwell Co. Bridge #115 project. We appreciate it being replaced with another bridge.

Hello all! Do you have the submittal for these projects? I have not been receiving applications for review from DWR (via
laserfiche) for several months. They have been working on resolving the problem for over a month, but no luck, so far.
1
Could you send the projects info to me directly? We may need to start doing it that way for new projects until they get
the problem resolved.

Heath and Jonathan: It turns out I will be processing the PCNs for these 3 projects. Please forward NCWRC responses to
me.
I have conducted an initial review of these 3 projects, and determined that it will not be necessary to request the tribes’
review and comment, because the projects are located in areas that have been extensively modified (predominantly
within the existing NCDOT right-of-way).
Please reply or call if you have any questions or if I may serve you in any other way.

Eric:
Thanks for the information. I have a couple questions since this is new to me:
1. If you do not hear from the Eastern Band of Cherokee Indians by 4/15, what day will the permit be
approved? Just asking since the contractor was planning to start work mid-April.
2. Does the 30 day review window by the Cherokee override how sometimes permits are automatically approved
after 45 days?
3. Is the 45 day review time-out referenced above measured in calendar days or business days?
Additionally, Heath submitted three permit packages (attached) for bridges that will also require review by the
Cherokee. Will you please let me know if/when those have been forwarded?

1. Ashe 177 (submitted 3/15/19)
2. Avery #79 (submitted 3/18/19)
3. Caldwell #115 (submitted 3/20/19)
Thank you Eric. Let me know if there is anything I can provide to help.

Heath: I sent the attached email to the Cherokee tribes on 3/15, and we DO have to wait 30 days for a response, so I will
not be able to verify the NWP until 15 April. I apologize for the delay in getting that process started – I didn’t know about
that requirement for consultation until after we got NCWRC’s comments.

This project was submitted 2 months ago. I know that you requested tribal comments but I think the clock is up at this
point. Are we ok to proceed with the project?
