The purpose of this letter is to solicit your input conceming the potential impacts of the proposed project. Please see the attached dowments that have been provided for your review. Various conflicts required the proposed construction to be on the downstream side. Hanc�ah Ferry Rd. is a dead-end road which requires NCDOT to maintain traffic. Additionally, there is an e�sting water main that is located on the upstream side of the existing bridge. However, all impacu have been minimized as much as possible during the design process and the permanent impacts will be compensated by tertns of mirigation. No. 17BP.9.R.76 � � Proiect Description This project is being developed for the replacement of Bridge No. 81 on SR 1926 (Hannah Ferry Road) located north of Salisbury. Bridge No. 81 carries SR 1926 over Deals Creek. The bridge is located approximately 0.88 mile from the intersection with SR 1910 (old Mocksville Road) and is approximately 1,600 feet, along Deals Creek, from the confluence with the Yadkin River. The existing bridge was constructed in 1961 with timber caps on timber piles and a timber deck on steel I-beams superstructure. The bridge has an overall length of approximately 31 feet with two spans, both approximately 15.3 feet in length and a clear roadway width of 12.667 feet with a total bridge width of 14.58 feet. The approach roadway width is approximately 18 feet including grassed shoulders and does not have any guardrail at the bridge approaches. The bridge is considered functionally obsolete. There is no posting for weight restrictions. Given the age, current condition, and timber components, rehabilitation of this structure is not a recommended treatment option. Therefore, it is recommended that the bridge be replaced with a new structure to meet the current design standards for sub-regional tier roadways. The proposed structure will be a concrete cored slab bridge. The proposed bridge will be constructed of concrete substructure and superstructure components. The proposed bridge will have an overall length of 55 feet with a single span and will have a clear roadway width of 20 feet with a total deck width of approximately 22.4 feet. The approach roadway will be realigned to construct the proposed bridge adjacent to and downstream of the existing bridge. Conflicts with the existing water main that is located on the upstream side of the existing bridge required the proposed construction to be on the downstream side. The approach roadway will be widened to accommodate the new bridge width and for the installation of guardrail to meet new design standards. Widening will be minimized to only the extent necessary to install the guardrail and adequately tie back into the existing roadway width. The new approach roadway will be 26 feet including the grassed shoulders. The existing bridge will continue to be used during the construction of the proposed bridge, and trafiic will be diverted to the new bridge when the construction of the new bridge and roadway approaches have been completed. The existing bridge and roadway approaches will then be demolished and removed. Deals Creek is not a FEMA regulated sfream however, it does appear on the FIRM Panel number 5762 within the Yadkin River floodplain. The Yadkin River 100-year flood elevation is approximately 17' above the finish grade of this proposed bridge. There are no additional impacts to the floodplain due to the proposed bridge.� Shoreline Impact Summary There will be no impacts to the shoreline of the Yadkin River. Permanent impacts will be limited to the forested wetlands in the bridge area. Temporary impacts to Deals Creek may result from construction and demolition activities. � � Environmental Impacts and Permits The project will permanently impact 0.46 acre of forested wetland, temporarily impact 0.18 acre of forested wetland, and temporarily impact 1261inear feet of Deals Creek for construction of the new bridge and demolition of the old bridge. The Division of Mitigation Services In-Lieu Fee program will be used to provide compensatory mitigation for the 0.46 acre of wetland impact. Design Standards in Sensitive Watersheds have been implemented for the project. The currently anticipated permits for this project are: • United States Army Corps of Engineers, Clean Water Act Section 404, Nationwide Permit #14 • NC Department of Environmental Quality, Division of Water Resources Clean Water Act Section 401, General Certification #4135 No impacts to historic architecture or archaeological resources are anticipated. Please see attached "No Archaeological Survey Required Form" and Historic Architecture and Landscapes No Survey Required Form." The USFWS county page for Rowan County updated June 26, 2018 lists three federally protected species including the bald eagle. Federally protected species listed for Rowan County. Surveys for Schweinitz's sunflower were conducted on October 4, 2017, during the optimal flowering �vindow, and no sunflowers were observed. In addition, the NCDOT DEO completed a sunflower survey on October 17, 2016 and no sunflowers were observed. A search of the North Carolina Natural Heritage Program (NCNHI') database, accessed on February 14, 2019 found no occurrences of Schweinitz's sunflower within 1.0 mile of the study area. A biological conclusion of "No Effect" was reached for Schweinitz's sunflower. Q a Northern long-eared bat Siological Conclusion: May Affect, Not Likely to Adversely Affect There is summer roosting habitat in the surrounding trees for northern long-eared bat (NLEB). No evidence of bats using the bridge was found during a March 13, 2018 field review. The USFWS nearest record of occurrence for the NLEB is more than 30 miles away. Anticipated tree clearing impacts for this project are estimated to be less than 0.5 acre. The NCDOT determined that the project `May Affect, Not Likely to Adversely Affect' the NLEB. NCDOT has determined that the proposed action does not require separate consultation on the grounds that the proposed action is consistent with the final Section 4(d) rule, codified at 50 C.F.R. § 17.40(0) and effective February 16, 2016. Section 7 responsibilities are therefore considered fulfilled. Bald and Golden Eagle Protection Act Bald eagles are protected under the Bald and Golden Eagle Protection Act. A desktop-GIS assessment of the study area, as well as the area within a 1.0-mile radius of the project limits, was performed on March 15, 2018 using September 2, 2017 color aerials. The confluence of the Yadkin River and the South Yadkin River is located approximately 500 feet to the northeast of the study area. Both of these rivers were large enough and provided suitable foraging habitat for bald eagles. Using GIS, a buffer of 660 feet was created around the study area which was then loaded into a Trimble Geo7X and used as the bald eagle study area. A survey of the bald eagle study area was conducted on March 16, 2018. The survey entailed a review of the study area on foot as �vell as kayaking the shoreline of the Yadkin and South Yadkin Rivers for a distance of approximately 1,500 feet. No nests were found within the bald eagle study area and there were no eagles observed during this survey. Additionally, a review of the NIIP database on Apri15, 2018 and February 14, 2019 revealed no known occurrences of this species within 1.0 mile of the study area. Due to the lack of nests or bald eagles observed during the survey, and minimal impact anticipated for this project, it has been determined that this project will not affect this species or its habitat. The archaeological Area of Potential Effects (APE) measures 600 feet in length (300 feet fi•om each bridge end-point) and 150 feet in width (75 feet from the SR 1926 center-line). SUMIVIA1tY OF CULTURAL RESOURCES REVIE�V Brief rlescription of revie►v activities, resirlts of review, and conclusions: Permitting and funding information was reviewed for determining the level of archaeological input required by state and federal laws. Based on the submitted "request for cultural resources review" form, the project is state- funded with federal permit interaction. As such, Section 106 of the National Historic Preservation Act will apply and the United States Army Corps of Engineers (USACE) will serve as the leatl federal agency. Next, construction design and other data was examined (when applicable) to define the character and extent of potential impacts to the ground surfaces embracing the project locale. Because the project appears to be an in-place replacement of the structure, the APE was primarily designed to capture any federal permit area or construction footprint within the proposed 150ft wide right-of-way (ROW). Once an APE was outlined, a map review and site file search was conducted at the Office of State Archaeology (OSA) on Friday, June 9, 2017. No previously documented archaeological sites are located in the APE or directly adjacent. One archaeological site was recorded a short distance north of the project area. However, the site is characterized by the recovery of a single artifact (flake) from eroded soils. No other archaeological sites are in.the vicinity, probably due to the absence of landform and underlying poorly drained ground surfaces. ' Examination of National Register of Historic Places (NRHP), State Study Listed (SL}, Locally Designated (LD), Determined Eligible (DE), and Surveyed Site (SS) properties employing resources available on the NCSHPO website is important in establishing the location of noteworthy historic occupations related to a perspective construction impact area. In addition, historic maps of Rowan County were appraised to identify former structure locations, land use patterns, or other confirmation of historic occupation in the project vicinity. Archaeological/historical reference materials were inspected as well. In general, the cultural background review established that no previously recorded archaeological sites, NRHP properties, or cemeteries are located within the APE. Based on cultural-historical factors, the APE is considered to have a low potential for the documentation of archaeological resources. Further, topographic, geologic, flood boundary, and NRCS soil survey maps (ChA) were referenced to evaluate pedeological, geomorphological, hydrological, and other environmental determinants that may have resulted in past occupation at this location. Since the current project area is situated in a frequently flooded area very near to the Yadkin River, the APE is considered to have very low archaeological site potential. As currently proposed as a state-funded project with federal permit interaction, no further consultation is advocated. A finding of "no archaeological survey required" is considered appropriate.
