Swine Waste Collection, Treatment, Storage and Application System Duplin County Drreclor In accordance with your Notification of Change of Ownership received April 22, 2016, we are hereby forwarding to you this Certificate of Coverage (COC) issued to Todd Smith, authorizing the operation of the subject animal waste management system in accordance with General Permit AWG100000. This approval shall consist of the operation of this system including, but not limited to, the management and land application of animal waste as specified in the facility's Certified Animal Waste Management Plan (CAWMP) for Todd Smith Farms, Inc., located in Duplin County, with a swine animal capacity of no greater than the following annual averages: Wean to Finish: Feeder to Finish: 4896 Boar/Stud: Wean to Feeder: Farrow to Wean: Gilts: Farrow to Finish: Farrow to Feeder: Other: If this is a Farrow to Wean or Farrow to Feeder operation, there may be one boar for each 15 sows. Where boars are unnecessary, they may be replaced,by an equivalent number of sows. Any of the sows may be replaced by gilts at a rate of 4 gilts for every 3 sows. . This COC shall be effective from the date of issuance until September 30, 2019, and shall hereby void Certificate of Coverage Number AWS310808 dated October 1, 2014. Pursuant to this COC, you are authorized and required to operate the system.in conformity with the conditions and limitations as specified in the General Permit, the facility's CAWMP, and this COC. An adequate system for collecting and maintaining the required monitoring data and operational information must be established for this facility. Any increase in waste production greater than the certified design capacity or increase in number of animals authorized by this COC (as provided above) will require a modification to the CAWMP and this COC and must be completed prior to actual increase in either wastewater flow or number of animals. Please read this COC and the enclosed State General Permit carefully. Please pay careful_ attention to the record keeping and monitoring conditions in this permit. Record keeping forms are unchanged with this General Permit. Please continue -to use the same record keeping forms. If your Waste Utilization Plan (WUP) has been developed based on site -specific information, careful evaluation of future samples is necessary. Should your records show that the current WUP is inaccurate you will need to have a new WUP developed. Unless such a request is made within 30 days, this COC shall be final and binding. In accordance with Condition II.22 of the General Permit, waste application shall cease within four (4) hours of the time that the National Weather Service issues a Hurricane Warning, Tropical Storm Warning, or a Flood Watch associated with a tropical system for the county in which the facility is located. This plan provides an estimate of the number of acres of cropland needed to use the nutrients being produced. The plan requires consideration of the realistic yields of the crops to be grown, theirnutrient requirements, and proper timing of applications to maximize nutrient uptake. This table provides an estimate of the amount of nitrogen required by the crop being grown and an estimate of the nitrogen amount being supplied by manure or other by-products, commercial fertilizer and residual from previous crops. An estimate of the quantity of solid and liquid waste that wil I be applied on each field it order to supply the indicated quantity of nitrogen from each source is also included. A balance of the total manure produced and the total manure applied is included in the table to ensure that the plan adequately provides for the utilization of the manure generated by the operation. These estimates are based on average nitrogen concentrations for each source, the number of animals in the facility and the plant available nitrogen application rates shown in the second column. Lagoon sludge contains nutrients and organic matter remaining after treatment and application of the effluent. At clean out, this material must be utilized for crop production and applied at agronomic rates. In most cases, the priority nutrient is nitrogen but other nutrients including phosphorous, copper and zinc can also be limiting. It is the responsibility of the owner of the waste production facility to secure an update of the Nutrient Management PIan when there is a change in the operation, increase in the number of animals, method of application, receiving crop type, or available land. 3. If animal production at the facility is to be suspended or terminated, the owner is responsible for obtaining and implementing a "closure plan" which will eliminate the possibility of an illegal discharge, pollution, and erosion. 19. Waste handling structures, piping, pumps, reels, etc., should be inspected on a regular basis to prevent breakdowns, leaks, and spills. A regular maintenance checklist should be kept on site. 20. Animal waste can be used in a rotation that includes vegetables and other crops for direct human consumption. However, if animal waste is used on crops for direct human consumption, it should only be applied pre -plant with no further applications of animal waste during the crop season. 21. Highly visible markers shall be installed to mark the top and bottom elevations of the temporary storage (pumping volume) of all waste treatment lagoons. Pumping shall be managed to maintain the liquid level between the markers. Since I have one lagoon that may be considered a problem in regards to sludge depths. My plans are to address this sludge problem by taking in account the cash flow of my farm. C. 28405-2845 Dear Mr. Shiver, �i -0' j 0$ I am writing to you to give my perspective on conversations that took place during a January 20, 2004 DWQ inspection of my hog farm in Duplin County. The inspection was conducted by Mr. Gale Stenberg of your office and he was accompanied by Mr. Geno Kennedy who I employ to assist and advise me regarding my regulatory and record keeping responsibilities. When these gentlemen arrived at my farm I was in the middle of unloading a load of new animals for my operation. I told them that I was busy at the time and unable to go with them on the inspection. I told them to go ahead with the inspection and that as far as I knew everything on the farm was ok. At this point time I was particularly concerned for the well being of my newly arrived pigs. They arrived in very cold weather and I was worried about keeping them warm and preventing them from getting too cold. Typically, when pigs arrive I have enough pigs in a house to produce enough collective body heat to warm the house. In this instance, I only received half the usual number of pigs. I felt that tending to my animals was more important than going with these guys on the inspection. When they came back from the inspection Mr. Stenberg insisted that I meet with him. He told me that he had seen things on my farm which could result in a $25,000 fine. He went on to tell me that he saw ponding in my sprayfield and wastewater outside my hog house. i was aware of some low areas in my field and had moved dirt into these areas to level their out. This was done in the fall of last year. After I filled the low areas I had someone go into the field to plant an overseed core for the winter. The tractor operator drove through the areas where I had placed the fill dirt. This left some fairly deep ruts in those areas. Since that time it has not been dry enough for me to go back and level out the ruts. I knew that the ruts had collected some water from rainfall and perhaps a small amount of irrigated water. To the best of my knowledge there was no runoff from this field. Regarding the water at the back end of my barn, I was aware of this situation as well. Hogs were shipped from one of my barns in the early morning hours of January 15. The loading crew noticed water collected in the barn and some had escaped the building. The loading crew called my home around 3:00am. I did not hear the phone ring and did not become aware of the situation until around 9:00arn when a production supervisor from Murphy -Brown called me to ask me if I knew there was a problem on the farm. I told him that I was not aware of a problem. I went immediately to the farm and found that a drain outlet was plugged which resulted in water backing up in the house. I immediately turned the recycle pump off and stopped the flow of water. I got my farm employee to help me remove the obstruction from the drain outlet which allowed the accumulated water in the house to drain to the lagoon. There was a small amount of water (I estimate to be approximately 100 gallons or less) standing on the outside of the building. This water was contained by an earth berm and none left the area. The amount of water was so small that I could not utilize a pump to pump it back to the lagoon. Subsequent to this incident and prior to the inspection, we received a rain event. Rainwater from the tops of two buildings collected in the same area where the small amount of wastewater had collected. I considered this situation to be so minor that no further action was required. When Mr. Stenberg confronted me with the prospect of a $25,000 fine for the things he saw I was shocked and surprised I was angered by the situation and reacted by using language that was inappropriate and for that I apologize. However, I feel strongly that Mr. Stenberg overreacted to a minor situation. I always thought that there was some due process for gathering all the relevant facts in a given situation and for determining what kind of regulatory response there would be. I believe that it was wrong for Mr. Stenberg to have told me that I was facing a major fine for a situation where no wastewater reached waters of the state. I understand that Mr. Stenberg has reported to you that he was uncomfortable returning to my farm alone in the future. I assure you that I harbor no ill will toward him or anyone lese from your staff. You have a job to do and I have a responsibility to cooperate with you and to comply with my permit requirements. I intend to do so because my livelihood depends on continued operation of my farm. I wish this unfortunate incident had not occurred. The General Permit was issued to enable swine facilities in North Carolina to obtain coverage under a single permit that addresses both State and Federal requirements. In accordance with a request by you, we are hereby forwarding to you this corrected Certificate of Coverage (COC) issued to Faison Smith, authorizing the operation of the subject animal waste collection, treatment, storage and land application system in accordance with NPDES General Permit NCA200000. If this is a Farrow to Wean or Farrow to Feeder operation, there may also be one boar for each 15 sows. Where boars are unneccessary, they may be replaced by an equivalent number of sows. Any of the sows may be replaced by gilts at a rate of 4 gilts for every 3 sows The COC shall. be effective from the date of issuance until July 1, 2007. Pursuant to this COC, you are authorized and required to operate the system in conformity with the conditions and limitations as specified in the General Permit, the facility's CAWMP, and this COC. An adequate system for collecting and maintaining the required monitoring data and operational information must be established for this facility. Any increase in waste production greater than the certified design capacity or increase in number of animals authorized by this COC (as provided above) will require a modification to the CAWMP and this COC and must be completed prior to actual increase in either wastewater flow or number of animals. Item 1 & Item 2 has been addressed by the new plans that have been created for this farm (See enclosed letter dated 5/4/98). Mr. Smith is currently abiding by the interim wup that will be valid until January 1, 1999. He has his cropping system in place for the interim plan. Item 3 was addressed as requested, by pumping the ponded area back into the sprayfield. The traveling lane has been adjusted to prevent spray or runoff into the area of question. In addition there has been an earthen berm created to prevent access to waters of the state. Item 4 was being addressed at the time of the inspection and efforts to gain adequate freeboard have continued and are evident by spray records enclosed. The lagoon currently has 26 inches of freeboard and applications are scheduled to resume. SMITH OCATION: 524 BILL SUTTON RD ALBERTSON NC 28508 TELEPHONE: 919-568-7450 TYPE OPERATION: Feeder to Finish Swine s NUMBER OF ANIMALS: 4896 hogs design capacity The waste from your animal facility must be Land applied at a specified rate to prevent pollution of surface and/or groundwater.- The plant nutrients in the animal waste should be used to reduce the amount of commercial fertilizer required for the crops in the fields where waste is to be applied. This waste utilization plan uses nitrogen as the limiting. nutrient. Waste should be analyzed before each application cycle. Annual soil tests are strongly encouraged so that all plant nutrients can be -balanced for realistic yields of the crop to be grown. Several factors are important in implementing, your waste utilization plan in order to maximize the fertilizer value of the waste and to ensure that it is applied in an environmentally safe manner. Always apply waste based on the needs of the crop to be grown and the nutrient content of the waste. - - Do not apply more nitrogen than the crop can utilize. Soil types are important as they have different infilitration rates, leaching potentials, cation exchange capacities, and available water holding capacities. Normally waste shall not be applied to land eroding at greater than 5 tons per acre .per year. With special pre- cautions, waste -may be applied to land eroding at up to 10 tons per acre'per year. Do not apply waste on saturated soils, when it is raining, or when the surface is frozen. Either of these conditions may result in runoff to surface waters which is not allowed under DEM regulations. Wind conditions should also be considered to avoid drift and downwind odor problems .•.To maximize the value of the •nutrients for crop production and to reduce the potential for pollution, the waste should be applied to a growing crop or applied to bare ground not more than 30 days prior to planting. Injecting the.waste or disking will conserve nutrients and reduce odor problems. This plan is based on waste application through irrigation for this is the manner in which you have -chosen to apply your waste. I£ you choose to inject the waste in the future, you need to: revise this - plan. Nutrient levels for .injecting waste and -irrigating waste are not the same. The estimated acres needed to apply the -animal waste is based on' typical nutrient content for this type of facility. Acreage require- ments should be based on the waste analysis report, from your waste management facility. Attached you'will find information on.proper sampling techniques, preparation; and transfer of waste samples to the lab for analysis. This waste utilization plan, if carried out, meets the requirements for compliance with•15A NCAC 2H.0217 adopted by the Environmental Management Commission. In interplanted field's (i.e. small grain, etc, interseeded in bermudagrass), forage must be removed through grazing, hay and/or silage. Where grazing, plants should be grazed when they reach a height of six to nine i.nches'. Cattle should be removed when plants are grazed to a height of four inches. In fields where small grain, etc, is to be removed for hay or silage, care should be exercised not to let small grain reach maturity, especially late -in the season (i.e. Aril or. May). Shading may result if small grain gets too high and this will definitely interfere with the stand of bermudagrass. This loss .of stand will result in rgduced yields and less. nitrogen being utilized. Rather than cutting small grain for hay or silage just before heading as is the normal situation, you are encouraged to cut the small grain earlier. You may want to consider harvesting hay or silage two to three times during the season, depending on time small grain• is planted in - the fall. The ideal time to interplant -small grain, etc, is late September or early October. .Drilling is recommended over broadcasting. APPLICATION OF WASTE BY IRRIGATION The irrigation application rate should not exceed the intake rate of the soil at the time of irrigation such that runoff or ponding�,occurs. This rate is limited by initial soil moisture content, soil structure, soil texture, water droplet size, and organic solids.. The application amount should not exceed the aveilab�e water holding capacity.o.f the soil at the time of irrigation nor sk4vu d the ,plant available -nitrogen applied exceed the nitrogen needs of the cxop. Your -facility is designed for 180 days of temporary storage and the .temporary storage must be removed on the average of once. every 6 months. In no instance should the volume of waste being stored in your structure be within 1.7.feet of the top of the dike. If surface irrigation is .the method of land application for this plan, it is the responsibility of the producer and irrigation designer to ensure that an irrigation system is installed to properly. irrigate the acres shown in Tables I and 2. Failure to apply the recommended rates and amounts of Nitrogen shown in the tables may make this plan invalid. Call your technical specialist after you receive the waste analysis report for assistance in determining ..the amount of'waste per acre and the proper application rate prior to applying the waste. NARRATIVE OF OPERATION: WASTE UTILIZATION PLAN Plans and Specifications VAGZ b Animal waste shall not reach surface waters of the state by runoff, drift, -manmade conveyances, direct application, or direct discharge during operation or land application. Any discharge of waste which reaches surface water is prohibited. Illegal discharges are subject to assessment of civil penalties of $10,000 per day by the Division of Environmental Management for every day the discharge continues. 2. The Field Office must have documentation in the design folder that the producer either has owns or has long term access to adequate land to properly dispose of waste. If the producer does not own adequate land to properly dispose of waste, he shall provide NRCS with a copy of a written agreement with a landowner who is within a reasonable proximity, allowing him/her the use of the land for waste application for the life expectancy of the production facility. It is the responsibility of the owner of the facility to secure an update of the Waste Utilization Plan when there is a. change .in the operation, -increase in the number of animals, method of utilization, or available land. 3. Animal waste shall be applied to meet, but not exceed, the Nitrogen needs for realistic crop yields based on soil type, available moisture, historical data, climate conditions; and level of management, unless there are regulations that restrict the rate of. application for other nutrients. 4. Animal waste may be applied to land that has a Resource Management System (RMS) or an Alternative Conservation System (ACS). If an ACS is used the soil loss shall be no greater than 10 tons per acre per year and appropriate filter strips will be used where runoff leaves the field. These filter strips will be in addition to "Buffers" required -by DEM. (See FOTG Standard 393 - Filter Strips and Standard.390 Interim Riparian Forest Buffers). 5. odors can be reduced by injecting the waste or -disking after waste application. Waste should not be applied when'the wind is blowing. 6. When animal waste is to be applied on acres subject to flooding,.it will be soil incorporated on conventionally, tilled cropland. Liquid waste shall be.applied at rates not to exceed the soil infiltration rate such that runoff does not occur offsite or to surface waters and in a method which does not cause drift from the site during application. No ponding should occur in order to control conditions conducive to odor or flies and to provide uniformity of application. 8. Animal waste shall not be applied to saturated soils, during rainfall events, or when the surface is frozen. A protective cover of appropriate vegetation will be established on.all disturbed areas (lagoon embankments, berms, pipe runs, etc.). If needed, special vegetation shall be provided for these areas and shall be fenced, as necessary, to protect the vegetation. Vegetation such as trees, shrubs,.and other woody species, etc. are limited to areas where considered appropriate. Lagoon areas should be kept mowed and accessible_ Lagoon berms and structures should be inspected regulaKly for. evidence of erosion, leakage or discharge. 19. If animal production at the facility is to be suspended -or terminated, the owner is responsible for obtaining and imple- menting a "closure plan" which will eliminate the possibility of an illegal discharge, pollution and erosion. 20. Since most of the soils in this county have inclusions of wetlands, it is necessary that a soil scientist visit the area you want to clear to determine the presence or absence of these wet inclusions. Generally, I can get a soil scientist within 2 weeks so depending on the number of requests ahead of yours, I will try to have a determination for you within 4 weeks and possibly sooner. In order to avoid delays, there are a few things that you need to do to prepare for the soil scientist's visit. 1. If the area is wooded or overgrown with weeds and brush, cut some trails throughout the area so that the soil scientist can walk through the area in several places and set flags of wetland area. If the trails are not cut the soil scientist may not be able to see the area completely thus either resulting in too much area being classified as wetlands or a delay in the determination until the trails are cut. Trails should not be pushed with tracked ..equipment since this may require a permit from the US Army Corp of,Engineers. • Manual labor or mowing is recommended. Trails should be 3 - 4 feet wide and spaced approximately every 100 - 150 feet apart throughout the area to be cleared. 2. Clearly mark the area where you want the determination.' Since most of the soils in this county have inclusions of wetlands, it is necessary that a soil scientist visit the area you want to. clear to determine the presence or absence of these wet inclusions. Generally, a soil scientist comes to this county about once per week, but because of the number of requests ahead of yours, I estimate that it may be I - 2 months before we visit your tract. Once I review the specific area you wish to clear, I may be. able to get the determination quicker if I can make the determination myself rather than being required to get the soil scientist. If I can do the determination myself, it generally only takes 2 - 4 weeks for me to schedule the visit. Please be aware that after the initial field visit, it may require up to an additional 60 days before I can finalize your wetland delineation/determination. This delay is due to a requirement that I send all wetland determinations to the US Fish and Wildlife Service and the Army Corp of Engineers and allow. up to 45 days for them to review this determination. I am prohibited from sending you any official determination prior to these agencies having this review time. Please be assured that i will expedite your determination as quickly as possible but I have no control over this 45 day review period. In order to avoid delays on the initial field visit, there are a few things that you need to do to prepare for the soil scientist's or my visit. 1. If the area is wooded or overgrown with weeds and brush, cut some trails throughout the area so that the soil scientist can walk through the area in several places and set flags of wetland area. If the trails are not cut the soil scientist may not be able to see the area completely thus either resulting in too much area being classified as wetlands or a delay in the determination until the trails are cut. Trails should not be pushed with tracked equipment since this may require a permit from the US Army Corp of Engineers. Manual labor or mowing is recommended. Trails should be 3 - 4 feet wide and spaced approximately every 100 feet apart throughout the area to be cleared. 2. Clearly mark the area where you want the determination. Corners should be easily identifiable on the ground. 3. Contact this office when you have completed these prerequisites so that a field visit can be scheduled. It was observed that no suitable cover crop has been established for waste application. MRCS -USDA requirements specify that a suitable cover crop be established for land application of waste. The certified animal waste management plan was given a conditional approval based on a committment to have a cover crop established by January 29, 1997. An appropriate cover crop, as designated by the certified animal waste management plan, should be planted for waste application at the next available growing season. In addition, erosion areas on the inner and outer walls of the lagoon should be filled with a suitable clay material, compacted and reseeded with an appropriate vegetative cover. We suggest that you contact your service company, local NRCS or Soil and Water District office for any assistance they may be able to provide to correct the situation.
