In order to meet this directive, a representative of DENR has recently evaluated the inactive lagoon(s) and/or storage pond(s) on your property. Inactive lagoons and storage ponds were defined by the Statute as structures which were previously used to store animal waste but have not received waste for at least one year. The information collected on your property is contained in the attached field data sheets. Using this field data, staff ranked your inactive waste structures as high, medium or low according to its potential risk for polluting surface ,and/or groundwater. Staff of the Division of Water Quality will be in contact with owners of all inactive structures that have been determined to pose a serious environmental risk, based on its ranking and/or additional field data collected by the Department. All liquids and waste removed from these structures must be land applied at a rate not to exceed the agronomic needs of the receiving crops. Any major modifications made to the dike walls or structure must be done in accordance with current standards and under the direction of a technical specialist designated for structural design. Your local Soil and Water Conservation District is an excellent source for information and guidance related to proper waste application practices, structure operation and maintenance, and other related animal waste management standards and/or requirements. Nothing in this letter should be taken as removing from you the responsibility and liability for any past or future discharges from your lagoon(s) and/or storage pond(s) or for any violations of surface water or groundwater quality standards. The owner of each animal waste management system must submit a designation form to the Technical Assistance and Certification Group which designates an Operator in Charge and is countersigned by the certified operator. The enclosed form must be submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a certified operator for your animal waste management system is a violation of 15A NCAC 2H .0224 and may result in the assessment of a civil penalty. If you have questions concerning operator training or examinations for certification, please contact your local North Carolina Cooperative Extension Service agent or our office. Examinations have been offered on an on -going basis in many counties throughout the state for the past several months and will continue to be offered through December 31, 1996. New Bern, North Carolina 28560 Subject: Dail's Swine Farm Animal Waste Lagoon Facility No. 25-14 Craven County Dear Mr. Dail: On July 25, 1995 staff from the Washington Regional Office of the Division of Environmental Management inspected the lagoon serving your animal feeding operation. It was observed that the lagoon had an insufficient amount of freeboard, water level in relation to the lowest point of your dike wall. You should maintain a minimum of nineteen inches of freeboard in the lagoon. This letter is written to bring your attention to this situation and to ask you to, begin spray irrigating wastewater or take the appropriate action necessary to reduce the level of your lagoon(s) immediately. Please note that a buffer of twenty-five feet must be maintained while spray irrigating from any drainage system (ditch, Swale, canal, stream, etc.). Please be aware that it is a violation of North Carolina General Statutes to discharge wastewater to the surface waters (farm ditches, creeks streams, etc) of the State without a permit. The Division of Environmental Management has the authority to levy a fine of not more than $10,000 per day for the unpermitted discharge of wastewater into the surface waters of the State. At some point in the future, staff will reinspect your facility. Lagoon dikes should be mowed so they can be visually inspected. This Review, undertaken in accordance with G.S, 143-215.10D, is one of two visits scheduled for all registered livestock operations during the 1997 calendar year. The Division of Water Quality may conduct a second site inspection. During the Review, it was determined that waste was not being discharged to the waters of the State, and that a portion of the animal waste collection, treatment, storage and disposal system were maintained and operated under the responsible charge of a certified operator. The remaining portion has been abandoned. Please see first item listed below. A copy of the completed review form is enclosed for your information. The :'c1L,1.r: questions, and management deficiencies were discovered and noted for corrective action or response: • It was noted that the two of the swine houses and their respective lagoons have been out of operation for some time and there are no plans to reopen this portion of the facility. These lagoons (one closest to the state road and the middle structure) have been partially filled and need to be maintained to avoid potential discharge. Contact the Craven Soil & Water Conservation District for technical assistance that will ensure the waste lagoons are properly closed. I have attached the current Natural Resource Conservation Service standard for the Closure of Abandoned Waste Treatment Lagoons and a copy of the Lagoon Closure Report Form for your information. Once these structures are closed, the Waste Utilization Plan (WUP) and certification can be revised to reflect the farm's actual design capacity. ■ Concrete at corner of the occupied swine house has been undermined by rodents and is leaking animal waste to the middle lagoon. Mr. Daughety has agreed to repair this item by July 1, 1997. ■ Reshape, stabilize, and vegetate areas around lagoon and swine houses as documented in the review report. • Install maximum and minimum pumping marker in the lagoon. • Irrigation system not fully installed as shown in WUP. System requirements may change based on any WUP revision. As a result of this inspection it has been found that the Leon Calhoun Swine Operation was in compliance at the time of inspection. However, there was strong evidence that periodic discharges were occurring from the old lagoons. Currently, Mr. Dail is in the process of scaling back the operation and shutting down two houses which are in poor repair.
