Facility No. 78 - 27 Permit No. AWS780027 Robeson County Dear Mr. Hobson: On January 31, 2000, you or staff from your farm notified the Fayetteville Regional Office of the Division of Water Quality, as required by General Permit oondition 111.6.e, that the freeboard level of the lagoon was less than the minimum required by the General Permit. The liquid level of the lagoon was reported as 18 inches. General Permit condition V.3 states that 'The maximum waste level in lagoonslsbrage ponds shall not exceed that specified in the CAWMP. At a minimum, maximum waste bevel for lagoonslstorage ponds must notexceed the level that provides adequate storage to contain the 25 -year, 24-hour storm event plus as additional 1 foot of structural freeboard. The Division of Water quality will take no further action for this reported incident at this time. However, you are asked to please notify this otFroe in writing within 15 days of receipt of this letter as to what date the lagoon was lowered to the required freeboard level. This information is essential in determining if the lagoon was lowered within the specified time frame in which the Plan of Action (POA) allotted. It will also dose this event out within your file. The above mentioned forms are being attended to prevent over application and control weeds. I will list the preventive measures below because some are consistent with each farm. 1. Weed control: We are spraying the chemical ally and mowing close to allow the Coastal Bermuda to grow, 7681 and 7078-1. 2. We have installed individual sow waters which gives an overall reduction of 25% water usage, 7705 all barns, 7707 Boar Barns. We are also installing pressure regulators for a 10% reduction, 7707, 7681. 3. Within our computer record keeping system, there is a report that shows how many pumping hours are left on a hydrant. We are using this as a monitoring tool, 7681, 7705, 7707, and 7078-1. The above mentioned measures should help to prevent over application, barring a Hurricane season such as the one last year. Farms: 7705, 7707, 7681, and 7078-1 Facility Nos. 83-22, 83-23, 83-12, and 78-27 Scotland and Robeson Counties Dear Mr. Stutts: On June 27, 28, and 29, 2000, staff from the Fayettteville Regional Office of the Division of Water Quality conducted inspections of Carroll's Foods Farms in Robeson and Scotland Counties. The inspections revealed that overapplication had occured on the winter overseed at the facilities noted above. It was also noted that the application fields for these farms need work to control weeds to keep from harming the primary crop of bermuda hay. In regard to the deficiency(s) noted during the inspection, the following actions are requested: Work on weed control in application fields. 2. Make sure that the overapplication of nitrogen is avoided in the future. I Please provide a written response to this office on or before July al, 2000 as to the actions taken or proposed to be taken to resolve these deficiencies. Nothing in this letter should be taken as absolving this facility of the responsibility and liability of any violations that have resulted or may result from this deficiency. OrFiCE Subject: Fertilizer Application Recordkeeping Animal Waste Management System Facility Number 78-27 Robeson County This letter is being sent to clarify the recordkeeping requirement for Plant Available Nitrogen (PAN) application on fields that are part of your Certified Animal Waste Management Plan. In order to show that the agronomic loading rates for the crops being grown are not being exceeded, you must keep records of all sources of nitrogen that are being added to these sites. This would include nitrogen from all types of animal waste as well as municipal and industrial sl udgestresi duals, and commercial fertilizers. Beginning January 1, 2000, all nitrogen sources applied to land receiving animal waste are required to be kept on the appropriate recordkeeping forms (i.e. IRR1, IRR2, DRY1, DRY2, DRY3, SLURI, SLUR2, SLDI, and SLD2) and maintained in the facility records for review. The Division of Water Quality (DWQ) compliance inspectors and Division of Soil and Water operation reviewers will review all recordkeeping during routine inspections. Facilities not documenting all sources of nitrogen application will be subject to an appropriate enforcement action. Please be advised that nothing in this letter should be taken as removing from you the responsibility or liability for failure to comply with any State Rule, State Statute, Local County Ordinance, or permitting requirement. To our knowledge, there is no surface water getting to the lagoons. We have plans to install pressure reducers on these farms. This should cause a reduction of water usage. Howes, Secretary Carroll's Foods Inc. 7681 PO Box 856 Warsaw NC 28398 November 12, 1996 SUBJECT: Operator In Charge Designation Facility: Carroll's Foods 7681 Facility ID#: 78-27 Robeson County Dear Farm Owner: RECEIVED NOV 1 21996 FAYETTEVILLE PFR OFFICE Senate Bill 1217, An Act to Implement Recommendations of the Blue Ribbon Study Commission on Agricultural Waste, enacted by the 1996 North Carolina General Assembly, requires a certified operator for each animal waste management system that serves 250 or more swine by January 1, 1997. The owner of each animal waste management system must submit a designation form to the Technical Assistance and Certification Group which designates an Operator in Charge and is countersigned by the certified operator. The enclosed form must be submitted by January 1, 1997 for all facilities in operation as of that date. Failure to designate a certified operator for your animal waste management system is a violation of 15A NCAC 2H -0224 and may result in the assessment of a civil penalty. If you have questions concerning operator training or examinations for certification, please contact your local North Carolina Cooperative Extension Service agent or our office. Examinations have been offered on an on-going basis in many counties throughout the state for the past several months and will continue to be offered through December 31, 1996.
