Sullins, Director Division of water Quality On December 11, 2009, the staff of the NC Division of Water Quality (DNNIQ), Aquifer Protection Section (AFS), were notified of a high freeboard level in one or more of the facilities lagoons. As a result of this incident, you are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste disposal system pursuant to 15A NCAC 2T .1300; you have been found to be in violation of your Certified Animal Waste Management flan (CAWMP) and the Swine Waste System General Permit No. AWG100000 as follows: Deficiency 1: Failure to maintain waste levels in your lagoon/storage ponds in accordance with the facility's CAWMP in accordance with Condition V. 2. Of Swine waste System General Permit No. AWG 100000. On December 11, 2009, a lagoon/storage pond level was documented at 18 inches of freeboard. A level of 19 inches is the maximum level allowed by your permit and Certified Animal Waste Management Plan. Continue to follow the proposed actions outlined in your Plan of Action (POA) submitted to the Fayetteville Regional Office. Take all necessary additional steps to insure lagoon levels remain in compliance with Section (2) of your permit. The Fayetteville Regional Office has determined that no further enforcement actions will be taken by the Division for the inadequate freeboard. However, upon review and consideration of the information submitted, the Fayetteville Regional Office has determined that an NOV is appropriate due to poor operation and management. In the future, please continue to evaluate ways to maintain freeboard levels in the required range. These methods include, but are not limited to, water conservation practices, adding additional application sites, updating your cropping systems, adding additional and/or more flexible application equipment, and maintaining the lagoon levels at the lowest allowable and appropriate levels throughout the year. As the result of this complaint, your farm was investigated on this same date. Please find enclosed a copy of our Compliance Inspection Report for your Information. Is the general condition of this CAFO facility, including management and operation, satisfactory? ysfto is Section III (3) According to the Certified Waste Management Plan, approximately 25-30 acres are required to assimilate the wastewater generated from this facility. Approximately 130-140 acres are available to be utilized for this animal waste complex. Section III (4) The cover crops are a combination of row crops, small grains (wheat, oats, rye, etc.) and Coastal Bermuda. All land observed had an established cover crop in place and some fields were being prepared for the winter cover. Section III (Q This farm is relatively new and this was the first spray event that occurred from this facility. BMP's appeared to be implemented at this farm and managing of spray irrigation potential runoff was thoroughly discussed. Overall, the animal waste management at this facility appeared to be operating in compliance with all DEM regulations.
