Cape Fear River Basin The Wall Brothers Phase II Buffer Mitigation Bank Parcel ("Parcel") is proposed under the terms and conditions of the Wall Brothers Buffer Mitigation Banking Instrument (MBI), which was made and entered into by Wildlands Holdings V, LLC, the acting as Bank Sponsor (Sponsor), and the North Carolina Department of Environmental Quality (NCDEQ) Division of Water Resources (NCDWR). The Parcel shall be planned and designed according to the MBI, 15A NCAC 02B .0240, and the Consolidated Buffer Mitigation Rule 15A NCAC 026.0295, which became effective on November 1, 2015. The project includes restoring the riparian areas along several unnamed tributaries (UT1, UT2, UT3, UT3a, UT4, and UT5) in Randolph County, NC. The primary purpose of the Bank is to provide riparian buffer mitigation credits to mitigate for unavoidable buffer impacts in the Randleman Lake Watershed, Hydrologic Unit Code (HUC) 03030003 and the NCDWR Sub -basin 03-06-08 of the Cape Fear River Basin. The Parcel's service area is depicted in Figure 1. 1.0 Project Location and Description 1.1 Introduction This Parcel is being proposed to provide buffer mitigation through the creation of a riparian buffer mitigation bank. The project involves restoring riparian buffers in order to help reduce non -point source contaminant discharges to downstream waters, the Randleman Reservoir, and the Cape Fear River Basin. There is an existing conservation easement on the first 50 feet from the top of bank of several of the Parcel's project streams: UT1, UT2, UT3, UT3a, UT4, and UT5 (Figure 2). This existing easement was recorded on the Parcel in 2012 as part of a NC Division of Mitigation Services (NCDMS) Wall Brothers Buffer Mitigation Site (NCDWR #2012-0949). Phase II of the project, proposed here, expands the buffer restoration area an additional 50 feet on either side of UT1-UT5 and upstream 200 feet on UT3 and UT4. Of the 9.92 acres protected under the Phase II conservation easement, 9.12 acres are proposed for riparian buffer restoration and 0.51 acres for riparian buffer preservation, for a total of 351,964.800 square feet of riparian buffer credits. An additional 0.29 acres of riparian buffer will be protected under the conservation easement but are not eligible for mitigation credit in compliance with 15A NCAC 02B .0295, due to the distance from the project features. 1.2 Parcel Location, Access and Site Constraints The Site is approximately three miles northwest of Asheboro and 0.5 mile west of Randleman in Randolph County, NC (Figure 2). The site is located within the 14 -digit HUC 03030003010060 and the NCDWR Sub - basin 03-06-08, which is in the Randleman Lake Watershed of the Cape Fear River Basin. The project site is accessible from Wall Brothers Road. There are two 40 -foot existing easement breaks for existing stream crossings on UTI and UT2. These breaks are not included in the buffer mitigation credits calculated for the project. There are no other known constraints on the proposed project site. Wall Brothers Phase II Buffer Mitigation Bank Parcel HUC 03030003 — BPDP 2.0 Project Area - Existing Conditions 2.1 Parcel Features The project includes restoring the riparian areas along six unnamed tributaries which flow to Randleman Reservoir shown on Figure 3: UT1, UT2, UT3, UT3a, UT4, and UT5. The reservoir is a regional water supply and stream buffer protection rules are in place throughout the watershed. As stated in Section 1.0, the project features were part of Phase I of Wall Brothers Buffer Mitigation Project. As such, 50 feet of the riparian buffer from those stream channels have been restored and are protected under a conservation easement. Phase II expands beyond that for an additional 50 feet of buffer restoration on each side of those reaches and extends upstream of UT3a and UT4 for a total of 200 feet. Photos showing current site conditions (as of February 2019) of the Parcel are provided in the Appendix. NCDWR performed an onsite visit of the Parcel to determine viability for buffer mitigation and nutrient offset on October 2, 2018 (letter dated October 22, 2018) for the project. All six of Parcel's stream features were deemed viable by NCDWR to generate buffer mitigation credit under the Randleman Buffer Rules and Water Quality Standards (15A NCAC 02B.0250). The classification and subjectivity calls for the Parcel were approved as part of the Phase I NCDMS Wall Brothers Mitigation Site, which was planted in 2012 and completed in 2017. The site viability letter for buffer mitigation and the on-site stream determination letter are included in the Appendix. There have not been any changes to the land use in the project area since the October 2018 DWR site visit. Table 1. Per the Phase I NCDMS Wall Brothers As -Built data, UT4 is an ephemeral channel for its entire length. There are areas on UT1 and UT2 that are already forested. These forested areas meet the requirements of the Consolidated Buffer Mitigation Rule (15A NCAC 02B 0.0295(0)(5)) for preservation by having a buffer width that is at least 30 feet from the stream, by the area meeting the requirements of 15A NCAC 02R 0.0403 (c) (7), (8), and (11) with no known structures, infrastructure, hazardous substances, solid water, or encumbrances within the mitigation boundary, and by credits only being requested on 25% of the total area of buffer mitigation. Documentation supporting compliance with 02R 0.0403 is included in Section 2.8. In addition to buffer restoration and preservation on subject streams, per the Consolidated Buffer Mitigation Rules (15A NCAC 02B 0.0295 (0)(7)), alternative mitigation is proposed on the Site in the form of buffer restoration on ephemeral channels. The proposed project is in compliance with the rules in the following ways: • NCDWR performed an evaluation of the Site as part of Phase I of the project and identified the perennial, intermittent, and ephemeral channels on the property. • The area of mitigation on the Site's ephemeral channels is within their drainage areas. Wall Brothers Phase II Buffer Mitigation Bank Parcel HUC 03030003 — BPDP 4 The ephemeral channels are directly connected to intermittent or perennial stream channels and will be protected under the same contiguous easement boundary. The area of mitigation on the ephemeral channels is less than 25% of the total area of buffer mitigation on the Site. 2.2 Historical Land Use The current land use on the property is mainly row crop agriculture. The unforested areas of the floodplain, from top of bank to 50 feet adjacent to all streams onsite, were planted with native woody vegetation in March 2012 as part of the Phase I DMS Wall Buffer Mitigation Site. The Phase I assessment found the site primarily characterized by agriculture with some forested land in riparian corridors. Low- density development exists along the roadways near the project area. Land use within this area is expected to remain constant for the foreseeable future. After the completion of the Interstate 74 corridor, development does not appear to have increased near the site. This is based on 2018 aerial imagery. During Phase I of the project, a small farm pond was removed and 10.39 acres of riparian buffer were planted with native forest vegetation. 2.3 Geology and Soils The Site is located in the Carolina Slate Belt of the Piedmont Physiographic Province. The Piedmont Province is characterized by gently rolling, well rounded hills with long low ridges and elevations ranging anywhere from 300 to 1500 feet above sea level. The Carolina Slate belt consists of heated and deformed volcanic and sedimentary rocks. Approximately 550 to 650 million years ago, this region was the site of a series of oceanic volcanic islands. The belt is known for its numerous abandoned gold mines and prospects. Specifically, the proposed restoration site is located in the CZg geologic region within the Carolina Slate Belt. This region is classified as intrusive, metamorphosed granite rock. Furthermore, this rock type is described as a well foliated and megacrystic that locally contains hornblende. The predominant floodplain soils on site are described in Table 2. Figure 5 shows an image of the Natural Resource Conservation Service 2006 Soil Survey of Randolph County. Table 2. Boulders GeC2 cover much of the area of the soil surface. 2.4 Existing Vegetative Communities The area upstream of UT3a, UT4, and UT5 are currently used for row crop agriculture outside of the Phase I conservation easement. Additionally, along UT1 upstream of the Wall Brothers site, there is row crop agriculture. Downstream of the Wall Brothers Road is a field with shrubby vegetation and some mature forest. The project area along UT2 is comprised of a combination of mature forest and row crop agriculture. Sparse tree species in pockets within the easement include red cedar (Juniperus virginiana), Wall Brothers Phase II Buffer Mitigation Bank Parcel HUC 03030003 — BPDP red maple (Acerrubrum), sweetgum (Liquidambarstyraciflua), multiple oak species (Quercus spp.), black willow (Salix nigra), hackberry (Celtis laevigata), Chinese privet (Ligustrum sinense), Japanese honeysuckle (Lonicera japonica), blackberry (Rubus spp.), and fescue (Festuca spp.) To create the native community composition of a Piedmont/ Low Mountain Alluvial Forest, tree species planted within the Wall Buffer Mitigation Site - Phase I conservation easement include: American elm (Ulmus americana), ironwood (Carpinus caroliniana), swamp chestnut oak (Quercus michauxii), green ash (Fraxinus pennsylvanica), persimmon (Diospyros virginiana), and sycamore (Platanus occidentalis). 2.5 Threatened and Endangered Species The US Fish and Wildlife Service (USFWS) and the NC Natural Heritage Program (NHP) databases were searched for federally listed threatened and endangered plant and animal species in Randolph County, NC. Two federally listed species identified as threatened or endangered are currently listed in Randolph County (Table 3). Table 3. The project will not include any work in the stream or within 50 feet of the stream; therefore, will have "no effect" on the federally listed Cape Fear Shiner (Notropis mekistocholas) species. As for the Schweinitz's sunflower (Helianthus schweinitzii), there is marginally suitable onsite habitat in the form of relic cattle pastures, agricultural cropland, early successional forests, and streamside thickets. However, the area lacks the proper light and soil regimes needed for establishment of the species; therefore, the project will have "no effect" on the Schweinitz's sunflower. 2.6 Cultural Resources There are no existing structures in the project area. The site is not located near any sites listed on the National Register with the State Historic Preservation Office (SHPO). During Phase I of the project, SHPO was contacted by DMS's representatives with a request to provide comment on the Parcel. On November 10, 2010, SHPO responded and found that no historic resources will be affected by the project. Correspondence from SHPO is included in the Appendix. 2.7 FEMA Floodplain Compliance The Site is not located in a FEMA floodplain. No grading activities are proposed in the floodplain, so a floodplain development permit will not be required. No hydraulic modeling is proposed for this project. 2.8 Other Environmental Issues An EDR Radius Map Report with Geocheck was ordered for the Site through Environmental Data Resources, Inc. on December 5, 2011 by DMS's representatives as part of DMS Phase I project. The target property and the adjacent properties are not listed in any of the Federal, State, or Tribal Wall Brothers Phase II Buffer Mitigation Bank Parcel HUC 03030003 — BPDP environmental databases searched by EDR. There were no known or potential hazardous waste sites identified within one mile of the Parcel. The Executive Summary of the EDR report is included in the Appendix. 3.0 Proposed Riparian Restoration & Enhancement Plan Developing the Parcel for mitigation will require converting existing agriculture land use practices adjacent to streams into riparian forest. The riparian areas will be planted with appropriate native tree species along the project corridors. Vegetation management and herbicide applications may be needed during the first year of tree establishment in the restoration areas to control establishment of invasive species that could impact the planted native species. More detailed descriptions of the proposed restoration activity follow in Sections 3.1- 3.3. 3.1 Parcel Preparation The land adjacent to the streams within 51-200 feet from top of bank is currently used for row crop fields, except for the small preservation areas along UT2, UT3, and UT4 (Figure 5). Areas slated for buffer restoration will require site preparation that will include select herbicide treatments or limited mechanical clearing to remove undesirable underbrush or invasive species. Where needed, invasive species will be removed by hand and spot treated by a licensed pesticide applicator. 3.2 Riparian Area Restoration Activities The revegetation plan for the entire buffer restoration area will include permanent seeding, planting bare root trees and controlling invasive species growth. The specific species composition to be planted was selected based on the community type, observation of occurrence of species in riparian buffers adjacent to the Parcel, and best professional judgement on species establishment and anticipated site conditions in the early years following project implementation. Species chosen for the planting plan are listed in Table 4 below. Table 4. No single tree species will be greater than 50% of the established stems. An appropriate seed mix will also be applied to provide temporary and permanent ground cover for soil stabilization and reduction of sediment loss during rain events in areas without existing herbaceous cover. Planting is scheduled for winter 2019/2020. Wall Brothers Phase II Buffer Mitigation Bank Parcel HUC 03030003 — BPDP 3.3 Riparian Area Preservation Activities There will be no parcel preparation work done in the buffer preservation areas, as allowed under 15A NCAC 02B .0295(o). The preservation area will be protected in perpetuity under a conservation easement. 4.0 Monitoring and Maintenance Plan 4.1 Monitoring Protocol Permanent vegetation monitoring plots will be installed and evaluated within the buffer restoration areas to measure the survival of the planted trees. The plots will be randomly placed throughout the planted riparian areas. A total of seven (7) plots will be established within the riparian buffer restoration and enhancement credit generation areas (Figure 7). The size of individual quadrants will be 100 square meters for woody tree species. Vegetation assessments will be conducted following the Carolina Vegetation Survey (CVS) Level 2 Protocol for Recording Vegetation (2008). A reference photo will be taken from the southwestern corner of each of the seven plots. Photos will be taken from all vegetation plot photo points each monitoring year and provided in the annual reports. All planted stems will be marked with flagging tape and recorded. Planting is scheduled for winter 2019/2020. The first annual monitoring activities will commence at the end of the first growing season, at least five months after planting has been completed and no earlier than the fall season. Species composition, height, and survival rates will be evaluated on an annual basis by plot. The total number of volunteer woody stems will also be documented and reported. The measures of vegetative success for the Parcel will be the survival of at least 4 native hardwood tree species, where no one species is greater than 50% of the established stems, and at an established density of at least 260 planted trees per acre at the end of Year five. Appropriate and desirable native volunteer species may be included to meet the performance standards with NCDWR approval. The Sponsor shall submit the annual monitoring report to NCDWR by December 31St of each year for five consecutive years and will follow the terms and conditions of the MBI. 4.2 Parcel Maintenance If the Parcel or a specific component of the Parcel fails to achieve the success criteria outlined in Section 4.1, adaptive measures will be developed and/or appropriate remedial actions will be implemented. Site maintenance will be performed to correct any identified problems on the Parcel that have a high likelihood of affecting project success. Such items include, but are not limited to, fire, flooding, drought, or insects that cause excess tree mortality. Any actions implemented will be designed to achieve the success criteria and will include a work schedule and updated monitoring criteria. Any parcel maintenance performed will be included in the monitoring report for that year. A rigorous herbicide schedule may need to be implemented in the first few years of tree establishment in the restoration areas to prevent establishment of invasive species that may out -compete the planted native vegetation. The only herbicides used on the Parcel will be aquatic approved herbicides that will be applied in accordance with North Carolina Department of Agriculture rules and regulations. The easement boundary will be checked annually as part of monitoring activities. Easement boundary conditions as well as any maintenance performed will be reported in the annual monitoring reports to NCDWR. If mowing is deemed necessary by the Sponsor during the monitoring period, the Sponsor must receive approval from the NCDWR prior to conducting any mowing activities within Zone 1 and Zone 2 of the Randleman Lake buffers to ensure that no buffer violations have occurred. Wall Brothers Phase II Buffer Mitigation Bank Parcel HUC 03030003 — BPDP 4.3 Easement Boundaries and Fencing Easement boundaries will be identified in the field to ensure clear distinction between the Parcel and adjacent properties. Boundaries may be identified by fence, marker, post, tree -blazing, or other means as allowed by site conditions and/or conservation easement. Boundary markers that have been disturbed, damaged, or destroyed will be repaired and/or replaced on an as needed basis. Contact information for the conservation easement holder will be included on easement markers. 5.0 Financial Assurance and Long -Term Management 5.1 Financial Assurances Following approval of the Wall Brothers Bank Parcel Development Package, the Sponsor shall provide a Performance Bond from a surety that is rated no less than an "A-" as rated by A.M. Best. The Performance Bond amount shall be 100% of the estimated cost for implementation of the project as described in the Bank parcel Development Package (BPDP), but not less than $150,000.00. In lieu of posting the performance bond, the Sponsor may elect to construct the project prior to the first credit release. In that case no performance bond will be necessary. After completion of the restoration/construction, a separate Performance/Maintenance Bond will be secured for 100% of the estimated cost to implement the monitoring and maintenance plan but not less than $100,000.00. The Performance/Maintenance Bond shall apply at the inception of the monitoring period for a term of one year and be extended annually for a minimum of five years. Upon NCDWR approval, this may be lowered each year based on the adjusted cost to complete the monitoring. Performance bonds for monitoring shall be renewed at least annually to cover the next years monitoring period, with confirmation of renewal provided to NCDWR with each annual monitoring report when applicable. NCDWR reserves the right to alter the credit release schedule if monitoring reports are submitted without proof of bond renewals when applicable. 5.2 Long-term Management The Parcel will remain in private ownership, protected in its entirety by an approved NCDWR long term stewardship, and will be managed under the terms detailed in an approved NCDWR conservation easement. The long-term manager will be responsible for periodic inspection of the Parcel to ensure that the restrictions documented in the recorded easement are upheld. 6.0 Mitigation Potential Approximately 9.92 acres will be protected with a permanent conservation easement. Out of the 9.92 acres, a total of 9.12 acres are proposed for riparian buffer restoration and 0.51 acres for riparian buffer preservation, for a total of 351,964.800 riparian buffer credits. An additional 0.29 acres will be protected under the conservation easement but are not eligible for mitigation credit in compliance with 15A NCAC 0213 .0295. Mitigation activities per drainage feature are outlined in Table 5. These acreages were calculated prior to applying any reductions in riparian buffer credits for areas between 101 feet and 200 feet from top of bank, per 15A NCAC 02B.0295(n), riparian buffer credit limits on ephemeral channels per 15A NCAC 02B .0295(0)(7), or the 2:1 and 10:1 credit ratios on the enhancement and preservation of rural streams respectively, per 15A NCAC 02B .0295(m). After applying the applicable reductions in credits and credit ratios, the Wall Brothers Phase II Bank Parcel includes 8.08 credited acres, or 351,964.800 ft' of riparian buffer credits as shown in Table 6.
