Subject: APPROVAL OF STORMWATER BASIN B4-A REMOVAL REQUEST
Crossfield Taxiway Project-Phase I
Dear Mr. Rosser:
The Division of Water Resources (Division) recently reviewed the submitted request received
December 11, 2018 with additional information received by the Division on February 11, 2019 to
remove a stormwater BMP (Basin B4-A)that was previously permitted and constructed under the
401 Individual Certification#WQC003428.
The additional information received on February 11, 2019 indicated that the PTAA believes that
the removal of Basin 134-A has already been approved by the issuance of Water Quality
Certification#WQC004053 dated March 11, 2016. Upon a complete file review, the Division has
determined that neither the presence of Basin 134-A nor clear indication for the pond removal was
disclosed on any documents supplied to the Division during the application for the Taxiway Project
which was approved under WQC004053. Therefore,the Division does not agree with the PTAA's
statement as a lack of essential information does not indicate approval by the Division.
Also within the additional information received on February 11, 2019 the PTAA indicates that
alternatives to Basin 134-A should be deemed permitted per NCGS 143-214.7(c3) and (c4). As
Basin B4-A is a requirement of Individual Water Quality Certification#003428 under Section 401
of the Clean Water Act, it is therefore not subject to NCGS 143-214.7 which sets out the
Departments state-stormwater program.
The Division approves the proposed removal of Basin 134-A and all associated stormwater
conveyances,inlet and outlet structures, and grading and drainage patterns depicted on plan sheets
dated January 2019 included in the Jacobs/CH2M report dated February 1, 2019, which are
incorporated by reference and are enforceable by the Division. All other aspects of the stormwater
management plan shall continue as previously approved by the Division.
