Please be advised that I am in receipt of your Notice of Violation letter dated February
12, 2019 sent to former Town Manager Darhyl Boone, in regard to the collection and submission
of a water sample be collected from a newly constructed well on September 26, 2018. I am
writing to advise you that the Town of Mars Hill has taken necessary actions to correct the noted
violation.
The subject well, which was constructed in September 2018, was for exploratory
purposes as a potential future public water source. Upon completion of well construction, it was
determined that the well was not a viable source of water. The well did not produce a sufficient
water supply necessary to continue development of the project. Therefore, the well was capped
and was never placed into service as a water source for the Town of Mars Hill. The engineers
directing this activity on behalf of the Town did not inform us of the requirement to provide a
water sample OR that the well would have to be formally abandoned pursuant to State
guidelines. We sincerely apologize for our failure to notify the Division of this determination.
In a faithful response to the notice in your letter, be advised that the Town has hired a
certified well contractor and the firm McCall Brothers to provide formal closure and
abandonment services for this subject well as the Town has no intention of placing the well into
service. Furthermore, on March 4, 2019 these contractors successfully completed the well
abandonment services for this subject well. The certified well operator has completed the
"Well Abandonment Record," form GW-30, and has submitted it as required to the N.C.
