Dear Mr. Kubel:
On January 11, 2017, the Division of Energy, Mineral and Land Resources received your
request to rescind your NPDES Stormwater Permit Number NCS000100. In accordance with
your request, Stormwater Permit Number NCS000100 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of
stormwater to waters of the State without valid coverage under an NPDES permit is against
federal and state laws and could result in fines. If something changes and your facility would
again require stormwater or wastewater discharge permit coverage, you should notify this office
immediately. We will be happy to assist you in assuring the proper permit coverage.
If the facility is in the process of being sold, your will be performing a public service if you
would inform the new or prospective owners of their potential need for NPDES permit
coverage.

Enclosed with this letter is a copy of the draft stormwater permit,for your facility. Please review the draft
very carefully to ensure thorough'understanding of the conditions and requirements it contains.
The.draft permit contains the'following significant changes from this facility's current permit:
Analytical monitoring changes--
1. Analytical monitoring parameters, pH, TSS, and Antimony, have maintained in this permit.
2. All analytical monitoring has been set to semi-annually during a representative storm event as defined in
Part II Section B. The permittee must also document the total precipitation for each event. If no discharge
occurs during the sampling period, the permittee must submit a monitoring report indicating "No Flow"
within 30 days of the end of the six-month sampling period. Additionally; samples must be taken a
minitnum of 60 days apart, as specified in Table 2.
3. Benchmarks for analytical monitoring have been added to this draft permit. Exceedances of benchmark
values require the permittee to increase monitoring, increase management actions, increase record
keeping, and/or install stormwater Best Management Practices (BMPs) in a tiered program. If the
sampling results are above a benchmark value, or outside of the benchmark range, for any parameter at
any outfall then the facility shall follow the Tier 1 guidelines which require a facility inspection within
two weeks and implementation of a mitigation plan within two months. If during the term of this permit,
the sampling results are above the benchmark values, or outside of the benchmark range, for any specific
parameter at a specific discharge outfall two times in a row (consecutive), then the facility shall follow the
Tier 2 guidelines which require a repetition of the steps listed for Tier 1 and also immediately institute
monthly monitoring'for all parameters at every outfall where a -sampling result exceeded the benchmark
value for two consecutive samples.
4. You are required to collect all of the analytical and qualitative monitoring samples during representative
storm events as defined in Part II Section B. Qualitative monitoring is required regardless of
representative outfalI status.
5. You are responsible for all monitoring until the renewal permit is issued. See Footnote 1 of Tables 1, 4,
and 5.
6. The flow reporting requirement has been removed per DWQ revised strategy. (The total rainfall
parameter is in this permit, however.)

7. Vehicle maintenance monitoring has been revised to semi-annually in order to coincide with analytical
and qualitative monitoring. Monitoring for TPH has replaced Oil & Grease. This requirement appears in
all Individual Stormwater permits, however it only applies to facilities that do vehicle maintenance. if the
facility begins vehicle maintenance during the permitted timeframe then the requirements shall apply.
Other permit changes:
1. Additional guidance is provided about the Site Plan requirements. The site map must now identify if the
receiving stream is impaired and if it has a TMDL established. It must also describe potential pollutants.
in each outfall. The map requirements are stated more explicitly. And, the site plan must contain a list of
significant spills that have occurred in the past three years and also must certify that the outfalls have
been inspected to ensure that they do not contain non-stormwater discharges. Additional information is
provided in Part II Section A.
2. Additional requirements for the Stormwater Management Plan have been specified in Part II Section A.
More details regarding secondary containment are provided.
3. Additional requirements for the Stormwater Pollution Prevention Plan have been specified in Part II
Section A. The plan must also be updated annually to include a list of significant spills and to certify that
the outfalls do not contain non-stormwater discharges.
4. The facility must now implement a semi-annual Facility Inspection Program of the site's stormwater
management controls as specified in Part II Section A.
5. Information regarding the No Exposure Exclusion has been added to this draft permit. If industrial
materials and activities are not exposed to precipitation or iunoff as described in 40 CFR §122.26(g), the
facility may qualify for a No Exposure Exclusion from NPDES Stormwater discharge permit
requirements. Additional information is provided in Part I Section A.
6. In addition to submitting two signed copies of DMRs to Central Files, a separate signed Annual Summary
DMR copy must be submitted to the local DWQ Regional Office by March 1 of each year.

• Performance Fibers' Moncure plant produces DSPR fiber; standard, low -shrink and low -denier polyester,
and adhesive activated fiber. The site manufactures polyester fiber from terephthalic acid (TPA) and
ethylene glycol. _

2. General Observations: The plant operations most likely to cause stormwater pollution are material storage, drainage
processes, loading and unloading, and V= 4,ste disposal practices.
Impairment: Neither, the Haw River not Shaddox Creek is listed on the 303d list of impaired waters; however,
they both are Water Supply Waters. The 2005 Basinwide Plan states the Haw River is Supporting aquatic life
but Moncure Plywood (NC0023442) had silpi ficant violations of dissolved oxygen permit limits. Shaddox
Creek is Not Rated for aquatic life on an evaluated basis because Sierrapine Limited (NC0040701) had
significant violations with TSS permit lii,iits. The facility has installed screens to solve the TSS violations.
However, both of these issues could have adversely impacted aquatic life.
4. Threatened and Endangered: Based on the Natural Heritage Virtual Workroom there is one federal endangered
plant species within two mile of the facility is the Ptilimnium nodosum (Harperella). One state threatened
species Moxostoma sp. 3 (Carolina Redhorse).
5. Location: Facility discharges stormwater to two waterbodies: an unnamed tributary to Haw River and Shaddox
Creek.
6. Industrial Changes Since Previous Permit: The only change since the last renewal application was the shutdown
and decommissioning of a beaming operation in 2007.
Anal3qical Monitoring Notes: See Table 1. There was no data collected in the fall of 2007, 2008 and 2009
because rainfall events that occurred during those time periods (September — November) were not representative
storm events.
The last reviewer noted the facility stores several chemicals outside that may be pollutants of concern. TPA,
glycol, fuel and diesel oil tanks, gasoline tanks, caustic, and finish oil tanks are not stored under roof, according
to the site map. Many of these tanks have secondary containment with diked -area inspections required before
release. The majority of these areas drain to the NPDES wastewater outfall and fall under another permit
(NC0001899), which also includes acute toxicity monitoring. (Information for previous staff report by Bethany
Georgoulias)
The facility uses antimony as a catalyst, and drift from two process water cooling towers is the likely source of
the metal in stormwater runoff. Antimony (Sb) was kept in the previous permit even though the reported values
were below the benchmarks because process water cooling tower drift still has potential to contaminate
stormwater. The old benchmark in the permit was 4.5 mg/l but it is now 0.09 mg/l which is %2 FAV. The EPA's
human health and organism consumption criteria is 0.006 mg/l. This value reflects the drinking water standard
(not a stream standard for water supply waters in North Carolina). This value is important to note because there
are values at outfall 3 and 4 that are above this value. The reviewer recommends retaining Antimony in
order to continue monitor this parameter.
This industry is covered in the EPA Multi -Sector permit under Sector C: Chemicals and Allied Products. The
permit includes zinc monitoring; however, this site is not a likely source. Based on the pervious staff report,
years ago, the site used a zinc coating and a zinc -containing anti -corrosive material (Zinc is monitored at the
NPDES wastewater outfall 002, where some stormwater drained); however the site no longer uses any zinc or
chromates.
Reviewer recommends retaining monitoring for pH, TSS, and Antimony; pl-Is are sometimes low and TSS
is over the benchmarks in 3 of the 4 outfalls.

Attached is the Annual Summary Discharge Monitoring Report for calendar year
2013 for the Performance Fibers, Inc., New Hill, North Carolina (Chatham
County) facility. Performance Fibers, Inc., discharges stormwater under NPDES
Stormwater Permit Number NCS000100.
This report contains summarized results for the one of the two NPDES
Stormwater Permit required semi-annual stormwater monitoring events in 2013.
We were unable to obtain a representative sample from all outfalls in the 2"d half
of 2013. This non-compliance issue is being addressed with our staff and we
intend to make sure this incident is not repeated in the future.
