Dear Mr. Krebs:
Results of analytical sampling of our storm water outfall designated SDO002 have exceeded the
benchmark value for Zinc as outlined in our permit on more than four occasions. This letter is to
inform you of this issue as required in the permit.
We are continuing to investigate the possible sources of Zinc into SDO002. Actions to date include
completion of a site sampling plan to eliminate potential sources, comparison of results to production
records to look for correlation and modification of maintenance activities such that the activities do
not cause Zinc to be present in the storm water at unacceptable levels. Following these activities, two
consecutive sample results of SDO002 indicated results below the benchmark values for Zinc, leading
us to believe we had resolved the issue. However, subsequent results from SDO002 have exceeded
the benchmark value. Additional investigative inspections have been performed, and more corrective
actions are planned to eliminate potential causes. We will continue to sample our storm water outfalls
monthly as required by the Tier Two program in the permit until three consecutive sample results are
below benchmark values.

Dear Ms. Smith:
On April 19, 2010, Jeff Mitchell from Charlotte -Mecklenburg Stormwater Services (CMSWS), conducted a site
inspection of the Rohm and Haas Chemical facility located at 6101 Orr Road in Charlotte, Mecklenburg
County, North Carolina. The site drains to Briar Creek, Class C waters located in the Catawba River Basin,
The site visit and file review revealed that the subject facility is covered by NPDES Individual Stormwater
permit NCS000386.
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations were
noted during the Charlotte -Mecklenburg Stormwater Services inspection (please see the attached addendum
for information about your permit):

During the inspection it was noted that the permittee captures part of the facilities stormwater in a retention
pond. The pH of the retention pond is checked and documented prior to determining whether the water is to
be released to the facilities stormwater system or pumped to the pretreatment system. During the review of

the SPPP and lab documents, it was noted that the pH range was listed at 5.5 to 9.0 in the SPPP and lab
documentation. The permittee should update the pH to 6.0 to 9.0 to be consistent with the monitoring
requirements for pH listed in the individual permit.
Thank you for the assistance and cooperation during the inspection. Overall, the facility's Stormwater program
was well developed and implemented and this Office commends the permittee's efforts to ensure compliance
with your NPDES permit.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established i.n 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NO]) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial -activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records —Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than -180-days prior to the expiration date. Any Permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
NamelOwnership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Inspection Summary:
Facility Description. -
Rohm and Haas Chemical is a wholly -owned subsidiary of The Dow Chemical Company and operates a ten -acre polymer
manufacturing plant at the Orr Road facility. The site is bounded by the Norfolk and Southern Railroad to the north, Orr
Road to the south and west, and a warehouse and storage yard to the east. The Charlotte Plant is a manufacturing and
distribution center for polymers [Standard Industrial Classification Code (SIC) 28211. The plant manufactures water -based
emulsions of vinyl acetate, acrylic homopolymers, copolymers, and thickeners. Wastewater is collected and discharged to
the Charlctte-Mecklenburg Utilities sanitary sewer system.
Compliance History:
The facility was last inspected by Charlotte -Mecklenburg Stormwater Services (CMSWS) on March 26, 2007, under the
authority granted by the Charlotte City Code; Chapter 18, Article III, Section 18-84. No vio#ations were noted during the
inspection. Stormwater monitoring was conducted at the facility by CMSWS on April 12, 2007. Elevated concentrations of
copper, zinc, and turbidity were detected.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
During the inspection it was noted.that the permittee captures part of the facility's stormwater in a retention pond. The pH
of the retention pond is checked and documented prior to determining whether the water is to be released to the facility's

Dear Mr. Bou-Ghazale:
As we discussed in our phone conversation on Wednesday, August 27, 2007, the Rohm and Haas
Plant in Charlotte, NC experienced an overflow of one of the Plant's process wastewater basins
due to the heavy rain event that occurred on August 26th-27th. It is roughly estimated that about
20 gallons of the Plant's process wastewater overflowed the basin and co -mingled with normal
stormwater runoff. This stormwater was initially contained on -site, but due to the extraordinary
amount of rain, overflowed the detention area and had to be released.
At the beginning of the day on 8/26/08, steps were taken in waste treatment to accommodate the
rainwater expected throughout the day. Wastewater was transferred out of the raw waste basin
that receives the majority of process rainwater, and accumulated rainwater in the stormwater
detention area was tested and released. Approximately 2-4 inches of rain was expected based on
weather forecasts.
At approximately 11 AM, rain intensity increased and the operator took additional steps to
increase the transfer of wastewater from the receiving basin. As extra pumps were being set up,
an estimated 20 gallons of wastewater overflowed the basin, and contaminated the stormwater
detention area. Discharge flow from the detention area was immediately stopped to prevent
discharge of the contaminated stormwater, and pumps were set up to transfer the stormwater to
the aeration basin for discharge to the Plant's permitted city sewer outfall.
Because additional rain was expected, extra measures to prevent additional overflow were also
taken, including pumping wastewater to available empty tanks and rail cars, stopping transfer
operations and blocking drains to waste treatment to minimize the volume of stormwater routed
to the waste basin, and running the waste treatment operation at maximum rate (24 hours/day).
At approximately 3 AM on 8/27/08, the continued heavy rain began flooding buildings on site
and overflowing the stormwater detention area dam. The stormwater discharge valve was
opened to drain the accumulated stormwater to minimize damage to site equipment and
structures. At 7 AM, the darn for the stormwater detention area was observed to have collapsed
(see Figure 1).
The material contained in the basin that overflowed consists of latex emulsion rinse water from
the Plant production process. This material is non -hazardous, and similar to whitewater from
rinsing out a latex paint brush.
The cause of the overflow was the heavy volume of rain that fell that day, along with the
facility's Best Management Practices design in which areas of potential stormwater
contamination from tank truck and rail -car loading and unloading operations drain to the Plant's
waste treatment process. While rainwater from heavy rains is normally contained in the waste
treatment process, the extremely heavy volume and intensity of this rain event exceeded the
holding capacity of the waste treatment process, and of the stormwater detention area.
The Plant's rain gauge overflowed at 5". It is estimated that I I+ inches of rain fell at the site,
based on reports from nearby rain gauges (as reported in the Charlotte Observer and weather
station websites), and from estimates of rain depth in dikes at the Plant. Nearby weather station
websites (www.wunderground.com) also indicate rainfall rates up to 2 inches/hour in the time
period corresponding to the raw waste basin overflow.
The Plant has no permit limits on stormwater effluent, thus no limit violation exists. The Plant
was being operated in accordance with proper procedures, including those in the Plant's
Stormwater Pollution Prevention Plan and the SPCC Plan.

in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III,
IV, V, and VI hereof.
This permit shall become effective December 2, 2005.
