• Please provide more detailed information regarding buffer impact 131 as
described in the PCN impact table as floodplain grading. These impacts need to
be clearly shown and enumerated on the buffer impact map. [15A NCAC 02H
.0502(g)]
• Please provide more detailed information regarding the greenway trail, overlook,
art installations and pedestrian bridges as depicted on Drawing Number 7.
These impacts need to be clearly shown and enumerated on the site plan and
must be listed within the PCN impact table. As the application currently stands, it
is not possible to determine the extent of the buffer impacts. [15A NCAC 02H
.0502(g)]
• Please provide more detailed information regarding the retaining walls as
depicted on Drawing Number 4. These impacts need to be clearly shown and
enumerated on the site plan and must be listed within the PCN impact table.

3. The Corps of Engineers must also verify the Nationwide Permit that is to be used to
authorize this project. [15A NCAC 02H .0502(a)(7)]
4. Please provide more details regarding avoidance and minimization for the greenway
trail impacts for this project. [15A NCAC 02H .0506(f) and (g)]
Will the project consist of stabilizing the streambanks? As the application currently
stands, it is not possible to determine the extent of the floodplain grading impacts.
6. The pedestrian bridges, according to the Sheet No. PT01-PT05 drawings, consist of
precast concrete. According to your application the area is prone to flooding and how
will the bridges compensate and withstand the flooding issues?
7. According to your application the area is prone to flooding, substantial impervious
surface (concrete steps, greenway trail, retaining wall) is being added within the
project boundary. How will the added impervious surfaces to the project area be
compensated or counteract the flooding issues?
8. Please provide more details regarding the plantings in all the riparian areas including
the wetland areas. Please provide a more detailed planting plan describing what size
plantings will be used versus bareroot plantings including planting locations.
Riparian plantings should be done using the performance standards as outlined in
15A NCAC 0213 .0295 (n)(2)(A-E).

9. In addition to your written response, DWR deems that a site visit is warranted,
please contact Stephanie Goss at 919-791-4256 or stephanie.goss@ncdenr.gov to
set up a site visit [Title 15A NCAC 02B .0267 (11)]
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested
information for the proper consideration of the application. If all of the requested information
is not received in writing within 30 calendar days of receipt of this letter, the Division will be
unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the Division for approval, including a complete application package
and the appropriate fee.
Please respond in writing within 30 calendar days of receipt of this letter by sending four copies
of all of the above requested information to the 401 & Buffer Permitting Unit, 1617 Mail Service
Center, Raleigh, NC 27699-1617.
Please be aware that you have no authorization under the Water Quality Certification Rules for
this activity.
