Dear Mr. Basinger,
I am writing in response to the Notice of Violation & Intent to Issue a Civil Penalty (NOV-2019-
DV-0060).
The SSO at Pump Station #12, 2460 NC Hwy 16 North Business, that occurred on September 10,
2018 was a result of a pump malfunction, electrical shorting of several wires and tripping the control
breaker, which resulted in a loss of power on the 110 volt circuit for control power. The Auto Dialer
was connected to the 110 volt circuit and failed to identify the problem and contact Lincoln County
Public Works (LCPW). The Pump Station #12 was last checked (weekly check) on September 5,
2018 and was operating normally at that time. Once LCPW was notified that there was an SSO,
Lincoln County Staff arrived on -scene, identified the problem, replaced the shorted wires, and reset
the breaker; this allowed Pump 41 to operate and the SSO was stopped immediately. LCPW then
installed a spare pump from inventory and cleaned up any sewage that was pooled on the ground.
The Auto Dialer was also replaced and tested with no issues.
Lincoln County Public Works will continue to work diligently to fully comply with our NCDEQ
Permit #WQCS00149. We also ask that you would consider the following:
1. The spill did not reach any surface water.
2. Public Works Staff worked quickly to stop the SSO.
3. There was no impact to Public Health.
4. There were no fish kills.
5. No recreational areas were closed as a result of the SSO.

6. The spill was a result of a mechanical failure.

A review has been conducted of the self -reported Sanitary Sewer Overflows (SSO's) 5-Day Report/s submitted by
Lincoln County. The Division's Mooresville Regional Office concludes that the Lincoln County violated Permit
Condition I (2) of Permit No. WQCS00149 by failing to effectively manage, maintain, and operate their collection
system so that there is no SSO (Sanitary Sewer Overflow) to the land or surface waters and the SSO constituted
making an outlet to waters of the State for purposes of G.S. 143-215.1(a)(1), for which a permit is required by
G.S. 143-215.1.
The Mooresville Regional Office is providing the Lincoln County an opportunity to provide evidence and justification
as to why the Lincoln County should not be assessed a civil penalty for the violation(s) that are summarized
below:

This Notice of Violation / Notice of Intent to Enforce (NOV/NOI) is being issued for the noted violation. Pursuant
to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed
against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any
permit issued pursuant to G.S. 143-215.1.
This office requests that you respond to this Notice, in writing, within 30 business days of its
receipt. In your response, you should address the causes of non-compliance, remedial actions, and all other
actions taken to prevent the recurrence of similar situations. The response to this correspondence will be
considered in this process. Enforcement decisions will also be based on volume spilled, volume reaching surface
waters, duration and gravity, impacts to public health, fish kills or recreational area closures. Other factors
considered in determining the amount of the civil penalty are the violator's history of non-compliance, the cost of
rectifying the damage, whether the spill was intentional and whether money was saved by non-compliance.

Per G.S. 143-215.1 C(b), the owner or operator of any wastewater collection system shall:
In the event of a discharge of 1,000 gallons or more of untreated wastewater to the surface waters of the State, issue
a press release to all print and electronic news media that provide general coverage in the county where the
discharge occurred setting out the details of the discharge. The press release shall be issued within 24 hours after
the owner or operator has determined that the discharge has reached surface waters of the State.
In the event of a discharge of 15,000 gallons or more of untreated wastewater to the surface waters of the State,
publish a notice of the discharge in a newspaper having general circulation in the county in which the discharge
occurs and in each county downstream from the point of discharge that is significantly affected by the discharge. The
Regional Office shall determine which counties are significantly affected by the discharge and shall approve the form
and content of the notice and the newspapers in which the notice is published.

How was the SSO remediated (i./e. Stopped and cleaned up)?
Burnt wires were replaced and the breaker was reset, this allowed pump one to operate and the SSO
immediately stopped. A pumper truck was used to clean up sewage that was pooled up on the ground. Pump
#2 was replaced with a spare pump we keep on hand. The dialer was also replaced.
