Box 368 Mars Hill, NC 28754 Subject: NOTICE OF VIOLATION NOV-2019-PC-0067 Permit No. WS0100062 Town of Mars Hill Madison County Required Response Date: March 12, 2019 Dear Mr. Boone: On September 13, 2019, the Division of Water Resources (DWR) issued well construction permit WS0100062 to the Town of Mars Hill for the construction of one 100,000 gallons per day or greater water supply well. A review of the file for the subject permit revealed the following permit condition violation: 1. Condition 5, which states, "Water samples shall be collected from the well and reported to the Asheville Regional Office as described in the attached Appendix A." Appendix A requires that the first water sample be collected within one month of well completion. The well construction record indicates the well was completed September 26, 2018. To date, DWR has not received the results of the water sample analyses. You are required to take any necessary action to correct the above violation on or before March 12, 2019, and to provide a written response to this Notice by March 12, 2019. Please include in your response all corrective action already taken and a schedule for completion of any corrective actions not addressed. Assessment of civil penalties may have already been recommended for violations described within this Notice of Violation. Civil penalties in an amount not to exceed $1000.00 per violation may be assessed pursuant to NCGS 87-94.
