On behalf of Hwy 55 Partners, LLC., we are requesting Buffer Compliance from the NC-DWR for
1,592 sq ft of permanent Neuse River riparian buffer impacts for construction of the sewer
connection to an offsite sewer line. Please note that there are no stream or wetland impacts
proposed for the construction of the subdivision or offsite sewer connection.
The project area is located at 10704 Penny Road in Cary, Wake County (35.717056°N; -
78.791236°W). The project is located in the Neuse River basin and onsite waters drain to
Dutchmans Branch. The Water Quality Classification for Dutchmans Branch is WS -III; NSW and
the Stream Index Number is: 27-43-1-4.5. The cataloging unit for the site is 03020201.
Proposed Project
The proposed project consists of construction of the connection of the Blakeford subdivision
sewer collection system to an existing Town of Cary gravity sewer, located offsite to the north.
The offsite sewer connection is located within an existing Town of Cary 20' utility easement, which
has been dedicated, but never improved. Please note that there are no stream or wetland impacts
proposed for the construction of the subdivision or offsite sewer connection.
Project History
Onsite wetlands were delineated by WR and approved in the field by James Lastinger with the
USACE on 10/15/18. An email from James Lastinger, dated 10/15/18, documents that the
delineation has been approved in the field, which has been provided as an Appendix.
Only one stream was depicted within the project area on the USGS and Soil Survey. This feature
was present in the field, and therefore subjectivity to Neuse River riparian buffers was conceded
and a formal NCDWR buffer determination was not requested.

Proposed Impacts
The proposed impacts consist of 1,592 sq ft of permanent impacts to riparian buffers (Z1: 325 sq
ft; Z2: 1,267 sq ft) for the construction of the offsite sewer connection within the dedicated Town
of Cary utility easement.
Avoidance and Minimization
The alignment of the offsite sewer connection was dictated by the existing, dedicated Town of
Cary 20' utility easement. The applicant explored the possibility of realigning the easement,
however, the adjacent property owners were uncooperative. Therefore, impacts cannot be
minimized any further.
Mitigation
The construction of the offsite sewer connection will result in both non -perpendicular impacts
within Zone 2 and perpendicular impacts in Zone 1, both of which are "Allowable".
The current request is for 1,592 sq ft of permanent impacts to riparian buffers (see the attached
maps and PCN for details).

James Lastinger with the USACE field verified the wetland delineation on 10/15/18. The Preliminary JD is being
processed and will be issued eventually.
Stream 1 is the only depicted feature within the project area and is present. Therefore, buffer subjectivity was
conceded and a formal buffer determination from NCDWR was not requested.

Will you please respond to this email concurring with the results of the site meeting so that we have documentation
for upcoming submittals. We understand that due to your current workload, the JD will be issued during permitting.
If there is no proposed impacts with the final design I will follow up stating that your concurrence email is sufficient

Good Morning James,
I've attached a request for Preliminary JD for the Holmes Tract, located at 10704 Penny Road in Cary, NC.
This site is 16.63 review area comprised of undeveloped woodlands, and a homestead.
During the site review WithersRavenel identified 1 Stream and 1 wetland. The wetland was located along the toe of
slop and the delineation was very straight forward.
Please take a look at the attached request and let me know your availability for a site visit. The site visit should take
less than an hour.
