Dear Permit Holder: STORMINATER PERMITTING
The Division of Energy, Mineral and Land Resources has reviewed your submittal of the No
Exposure Certification for Exclusion from NPDES Stormwater Permitting form. Based on your submittal
and signed certification of no exposure at the above referenced facility as well as observations made by
Brandon Wise with the Winston-Salem Regional Office on January 30, 2019, the division is grating your
conditional exclusion from permitting as provided for under 40 CFR 122.26(g), which is incorporated by
reference in North Carolina regulations.
During the site visit the following was noted by the inspector, this will not keep you from
obtaining the No Exposure Certification but should be addressed.
Wooden pallets were seen near the loading docks, these pallets did appear to be clean but
should be moved inside or covered to ensure reduced exposure.
Some cardboard trash was seen in the main drive into the site. This should be cleaned up as
part of general housekeeping with the No Exposure Certification.
Please note that by our acceptance of your No Exposure Certification, you are obligated to
maintain no exposure conditions at your facility. If conditions change such that your facility can no
longer qualify for the No Exposure Certification, you are obligated to immediately obtain NPDES permit
coverage for your stormwater discharge. Otherwise, the discharge becomes subject to enforcement as an
un-permitted discharge. You must self -re -certify annually using the enclosed form or obtain NPDES
permit coverage for any stormwater discharges from your facility. The annual self -re -certification does
not need to be submitted unless requested, this form should however remain on file and be available for
review should an inspector request it. The permit holder should also understand that should issues arise
that the department deems to be a problem, then this permit can be suspended and the site can be required
to obtain other NPDES permits.
Your conditional exclusion from permitting does not affect your facility's legal requirements to
obtain environmental permits that may be required under other federal, state, or local regulations or
