Sullins Director Dee Freeman Secretary August 6, 2009 DWQ No. 09-0040 Wake County Mr. Patrick Denton Beacon Lake Industrial Commons, LLC 5112 Departure Drive Raleigh, North Carolina 27616 APPROVAL OF MODIFIED STORMWATER MANAGEMENT PLAN Dear Mr. Denton: On May 5, 2009, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to fill 0.0015 acre of wetland and 188 linear feet of perennial stream (148 linear feet of permanent impact and 40 linear feet of temporary impact), 8,545 square feet of Zone 1 Neuse Buffer and 4,631 square feet of Zone 2 Neuse Buffer in order to construct Beacon Lake Industrial Commons in Wake County. In accordance with Condition 9 of the 401 Water Quality Certification, a Stormwater Management Plan for this site was approved on May 5, 2009. On July 7, 2009, the DWQ received a revised stormwater management plan, dated July 6, 2009, submitted by the consulting engineer Mr. Marty B. Bizzell of Bass, Nixon & Kennedy, Inc. This revised stormwater management plan has been reviewed and has been found to satisfy the stormwater management requirements of the 401 Water Quality Certification for the roadway portion of this development. A stormwater management plan for the remainder of the site must be submitted and approved prior to development of the individual lots on this site. The approved stormwater management plan for the lots must be constructed and operational before any permanent building or other structure is occupied at the site. The structural stormwater practices as approved by DWQ as well as drainage patterns must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the DWQ. Stormwater easements shall be recorded for a distance of at least ten feet on each side of all stormwater conveyances on all lots containing these structures including future access for maintenance. The stormwater easements shall allow for the ability to maintain the structures, perform corrective actions as described above and shall provide protection of the structures from potential alternations by future property owners.
