The best way to treat the Tier response system is to view the Tier 1, 2, and 3 responses as cumulative. Tier 2 dictates when you can return to semi-annual sampling. The second action outlined in Tier 2 states: "Immediately institute monthly monitoring and reporting for all parameters. The permittee shall conduct monthly monitoring at every outfall where a sampling result exceeded the benchmark value for two consecutive samples. Monthly (analytical and qualitative) monitoring shall continue until three consecutive sample results are below the benchmark values or within benchmark range." This condition applies to Tier 3 as well. All three samples were below the benchmark in the previous permit (note, the zinc benchmark has increased since the recent renewal in November 2018), and this satisfied the criterion to drop back to semi-annual sampling. It should have gone to Stan Aiken, who is Regional Supervisor for DEMLR. The Stormwater Program moved out of the Division of Water Resources back in 2013 over to DEMLR, so I know that may have been confusing. This may be the reason for no response to date. I am forwarding this facility's request for monthly monitoring relief to Stan Aiken at the ARO so his staff can address this request. I am also copying Isaiah Reed, the ARO's primary contact for Stormwater. In Tier 2, a facility can automatically resume semi-annual monitoring after three consecutive results below benchmark, but I understand from this letter that the facility was in Tier 3 -- and hence the request to the RO for relief.
