Dear Mr. Ellis: '
The North Carolina Division of Water Resources (NCDWR), Winston-Salem Regional
Office (WSRO), attempted to contact you at your residence at the subject address on September
28, 2018, and again approximately one month later, to conduct a compliance evaluation
inspection (CEI) of the discharging single-family wastewater treatment system that serves your
home.We were not able to contact anyone on either date and therefore left notification in the door
asking you to contact us to schedule a time convenient for both of us to meet and conduct the
required inspection.
According to current county tax records:you became homeowner of the subject residence
in March, 2017, but the Division has yet to receive a request to remove the former homeowner
from the permit and list you as the new homeowner and permittee. If the home still discharges
wastewater to Tomahawk Creek, then failure to have the permit reissued in your name essentially
constitutes a discharge of wastewater into surface waters of the state without a valid permit,which
is a violation of NC General Statute(NCGS) 143-215,1, Control of Sources of Water Pollution;
Permits Required. You should also be aware that NCGS 143-215.6A, Enforcement
Procedures, Civil Penalties, authorizes the Secretary of the Department of Environmental
Quality (NCDEQ), to assess civil penalties of not more than $25,000 against any person who
violates NCGS 143-215.1.
Please contact this office as soon as possible at 336-776-9800, to schedule the required
inspection and initiate the process of you taking over as homeowner and permittee for the home's
discharging wastewater system. Failure to do so by February 15, 2019, may result in us drafting
a civil penalty assessment document against you for illegally discharging wastewater into the
surface waters of the State.

Permit not in homeowner's name. Status of system completely unknown due to homeowner's
apparent refusal to contact us so we can inspect the system.Visited home on 9/28/2018 and again
approximately one month later and left notification on the front door for them to call us to schedule an
inspection.They never reached out to us. Permit is currently in former homeowner's name. Last deed
date of 3/7/2017 shows that Daniel J. Ellis is current homeowner but he has not submitted any
paperwork to the Division to take over ownership and responsibility as required.
