feet of bulkhead waterward of jurisdictional wetlands and fill behind the bulkhead.
Construct a 10 ft x 4 ft pier with a 4 ft x 40 ft platform and a 30 ft x 45 ft accessory
storage building 30 ft from NWL.

Project Setting
The site of the proposed development is at 909 Morgan St (off SR 1164), Elizabeth City,
Pasquotank County on Charles Creek. The tract is approximately 18,664 sq ft and is
approximately 2 ft above NWL. Vegetation on this tract includes cypress trees along the
shoreline both above and below NWL, pine trees and lawn grasses. There is a wetland area
in the northeast corner of the property which is vegetated with cypress trees and typical
wetland plant species. Existing structures on this site consist of a 2 unit residential home.
There are remnants of a damaged bulkhead along the shoreline approximately 3-4 ft
warterward of NWL. The site is surrounded by undeveloped city owned property on one side
and a residential home on the other side. No submerged aquatic vegetation was observed.
The waters of Charles Creek are closed to shellfish harvesting and are classified as SW
waters by the Division of Environmental Management. Water depths in Charles Creek
along the area of the applicant's property range from 2 ft to 6 ft further offshore. There are
no known archeological sites of geologic formations associated with the applicant's
property.
Development Proposal
The applicant proposes to construct 210 ft. of vinyl bulkhead and construct a 10 ft. by 4 ft.
pier with a 4 ft. by 40 ft. floating platform. The proposed bulkhead alignment is an average
of 2 ft waterward of NWL and a maximum of 4 ft. waterward of NWL. Along 160 ft of the
proposed bulkhead the shoreline has a wetland fringe and along 50 ft. of the proposed
bulkhead there are jurisdictional wetlands which extend approximately 30 ft landward of
NWL. Shorelines on adjoining properties on either side are currently unstabilized.
The proposed pier and platform will extend 14 ft. out into the creek which is approximately
70 ft. wide. Water depth at the end of the proposed pier is approximately 3'/2 ft.
Anticipated Impacts
The proposed development will stabilize 210 ft. of natural shoreline, and fill approximately 420
sq. ft. of public trust area, 3,150, sq. ft. of public trust shoreline, 1,500 sq. ft. of wetlands, and
shade 200 sq. ft. of public trust area. Temporary water turbidity will occur in the area of the
construction.

package to be complete. Items (a) - (f) are always applicable to any major development application. Please consult the application
instruction booklet on how to properly prepare the required items below.

Thank you for your letter of December 28, 2008 outlining the initial screening of my shoreline
stabilization application.
Pursuant to your request to provide additional application information I telephoned field
representative Kelly Russell. The purpose of my call was to let your office know that I had been delayed in
Honolulu due to a medical procedure. Fortunately, the procedure has been successful. To this end I will be
able to return in mid May this year to meet with your office.
With regards to your requests, I have reviewed your letter, the returned application and site map. I
have endeavored to provide correctly the information you requested. I have attempted to follow the step by
step requests under item #I and #2. Item #3, a narrative is addressed as follows:
Item #3:
The shoreline stabilization projects in mind at 909 Morgan St. are Inclusive of the following:
a) To reconstruct an old and remnant bulkhead around the periphery of the property. The remnant
bulkhead is readily observable from mid to low water. Its position and location confirms the
natural erosion of which has occurred over the years. The replacement bulkhead is depicted in the
attached proposal diagram.
b) To provide a short, along the bulkhead pier at the West side for small boat tie up. This pier is
depicted on the sites map attached.
c) To provide fill material in the wet land area behind the bulkhead around the periphery of the
property. The justification of the fill is to regain the lost land area.
d) To provide fill material within the NW side of the property. This area is approx. 1,200 square. Ft.
or 40 ft. x 30ft... I have recently cleared the area of old stoves, car parts, tires, poison ivy, shingles
vines etc...
The justification of this project is to provide the fill necessary to reclaim the lost land area eroded
and misused over the years; to beautify the area in line with the City of Elizabeth City

beautification projects concurrent in the area. To be able to use the area as open space. The fill
will also discourage the transit of water snakes, some of which may be poisonous. The fill area is
small and will impact the existing environment little if at all. The project will improve and
enhance this recreational-park like environmental.
e) The project will indirectly enhance the infrastructure. It will enhance property values in the area.
The costs of this project will provide jobs for duration of the project.
f) Construction of an accessory structure of which may encroach slightly into the required CAMA
30% setback. *Though any encroachment will attempt to be avoided, it appears that an
encroachment of a maximum of four ft by five ft. (4'x5' or 20 sqe. ft.) may be required in order to
gain the footprint for the proposed structure. Permits for the structure will be gained through the
City of Elizabeth City building department and will conform to their required setback of 7 ft. on
the other side (North side). However, any encroachment as noted will attempt to be avoided.
*Please note should the bulkhead be constructed the CAMA setback will then conform at 30ft.
Justification of the accessory structure encroachment of approx. 20 sqe. ft. is to be able to use and
enjoy the unique benefits and qualities of this creek side residential property.
I hope the preceding meets the requirements of item #3 of your December 28, 2008 letter. Please
advise me should additional information be required. With regards to Item #4 I will provide copy of a
personal property tax document or copy of the deed as I can dig these up. Likely, I will have to provide
these to you in person when I return in May.
Item #5 has already been submitted. Mr. Rich Olson, City Manager of the City of Elizabeth City
has already signed off as the riparian land owner for this project. The City of Elizabeth City owns all of the
surrounding property. Please check your file. This document submitted in December 20, 2008 was not
returned to me. I hope it remains in your possession.
Item #6, a check for $250.00 is enclosed.
Thank you for your informative letter. I hope my application and corrected sites maps provide the
information your office seeks to be able to proceed with this permit process. Please do let me know how I
