Upon review of your request for Water Quality Certification
to place fill material in 300 square feet of water to
replace a tide gate and rip rap located at Greenfield Creek in
New Hanover County, we have determined that the proposed fill can
be covered by General Water Quality Certification No. 2665 issued
January 21, 1992. A copy of the General Certification is
attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 13.

8. Project Summary The applicants propose to replace the existing wooden tide gate
with a metal sheet pile gate and to stabilize the adjacent banks.
'9. PROJECT DESCRIPTION - The project site is located within the mouth of
Greenfield Lake Creek at the confluence of the Cape Fear River. There is an existing
tide gate which was repaired by permit issued to the City of Wilmington (58-81). This
existing gate was of wooden construction and has failed to the point of being non-
functional. The creek at this location is approximately 21 feet wide. In addition to
the failed gate the creek and river banks adjacent to the structure have also
experienced varing degrees of erosion. Rip-rap had previously been used on the stream
banks on the north side (upstream). As indicated on the work plats, three of these
areas have washed out. There is also a portion of an existing bulkhead along the river
bank on the south shore. As noted above the creek and river are classified as SC and
the river is a designated nursery area.
The applicants propose to remove the existing timber tidal gates, seats and apron
and replace them with new sheet piling, install two metal flap gates, repair and
install trash screens rip-rap banks to stabilize and place new fill landward of
existing timber piling bulkheads. The new structure to hold the two gates will be
lengthened to approximately 30 feet long. The two gates will be approximately 51x6'.
Two trash screens located on both sides of the gate structure will be installed. These
screens will be accessed by platforms originating from the pile cap as shown in the
proposed site plan. Those areas requiring stabilazation are identified in the proposed
site plan. In areas A and D the banks will be excevated to remove existing rip-rap and
sand. The areas will be shaped as shown in section-AA where there is no existing
bulkhead(4). Following this preparation these two areas will be rip rapped as per the
referenced plan. The approximate dimensions of area A are 351x12'. Those of D are
301x12'. Landward of the bulkheads (locations B and C) the banks will be stabilized as
shown in section-CC(1) and (3). The work will be accomplished landward of the
bulkheads. In addition to these areas, rip-rap will be placed at the toes of the new
apron on each side of the new structure. This toe protection is approximately 1 foot
wide by 3 feet deep for each structure. Rip-rap will also be placed landward of the
existing bulkhead on the south bank. The length will be approximately 21' long.
10. - Anticipated Impacts- The existing failed structure has resulted in the occasional
flooding of a portion of the Ports property. The proposed structure should correct
this problem. No significant adverse impacts are expected if the project is
constructed as shown in the plans.

In addition to the completed application form, the follow-

A copy of the deed (with state application only) or other
instrument under which the applicant claims title to the
affected property. If the applicant is not claiming to be
the owner of said property, then forward a copy of the
deed or other instrument under which the owner claims
title, plus written permission from the owner to carry out
the project.
An accurate work plat (including plan view and cross
sectional drawings) drawn to scale in black ink on an 8
1/2 x 11 white paper. (Refer to Coastal Resources
Commission Rule 7J.0203 for a detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 18 high
quality copies are provided by applicant. (Contact the
U.S. Army Corps of Engineers regarding that agency's
use of larger drawings.) A site or location map is a part
of plat requirements and it must be sufficiently detailed
to guide agency personnel unfamiliar with the area to the
site. Include county road (SR) numbers, landmarks, and
the like.

Enclosed is the application of the North Carolina States Ports Authority,
represented by Mr. Gerald Devito, for Department of the Army authorization and
a State Water Quality Certification to replace a wooden tide gate and
stabilize banks at the mouth of Greenfield Creek, off the Cape Fear River,
Wilmington, New Hanover County, North Carolina. Your receipt of this letter
verifies your acceptance of a valid request for certification in accordance
with Section 325.2(b)(ii) of.our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification may be required under the provisions of Section 401 of the same
law. A Department of the Army permit will not be granted until the
certification has been obtained or waived.
In accordance with our administrative regulations, 60 days after receipt
of a request for certification is a reasonable time for State action.
Therefore, if you have not acted on the request by August 31, 1992, the
District Engineer will deem that waiver has occurred.

The Division of Coastal Management hereby acknowledges receipt of
your application for state approval for the replacement of an existing
tidal gate located at the confluence of Greenfield Creek and the Cape Fear
River. It was received on June 5, 1992, and appears to be adequate for
processing at this time. The projected deadline for making a decision is
August 19, 1992. An additional 75-day review period is provided by law
when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you
should consider the review period extended. Under those circumstances,
this letter will also serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
NCGS 113A-119(b) requires that Notice of an application be posted at
the location of the proposed development. Enclosed you will find a
"Notice of Permit Filing" postcard which must be posted at the site of
your proposed project. You should post this card at a conspicuous point
along your property where it can be observed from a public road. Some
examples would be: nailing the notice card to a telephone pole or tree
along the road right-of-way fronting your property, or at a point along
the road right-of-way where a private road would lead one into your
property. Failure to post this Notice could result in an incomplete
application.
A field report has been prepared and is in the process of being
circulated to the various state and federal review agencies for their
comments. If additional information is required based on this review, the
agencies may contact you directly.

Reference the application of the North Carolina State Ports Authority,

The Federal agencies have completed review of the proposal as presented by
the application and your field investigation report.
We recommend that the following conditions be included in the State
authorization:
a. All work authorized by this permit must be performed in strict
compliance with the permit plans.
b. The riprap material will be positioned in strict accordance with
permit plans.
C. The riprap material will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials or debris will not be
used.
d. No vegetated wetlands will be excavated or filled.
e. The permittee will maintain the authorized work in good condition and
in conformance with the terms and conditions of this permit.
f. The activity will be conducted in such a manner as to prevent a
significant increase in turbidity outside the area of construction or
construction-related discharge. Increases such that the turbidity in the
waterbody is 50 NTU's or less are not considered significant.
