I feel like I am in a WWI trench and I hear an artillery round whistling through the air, but I don't know where
it is going to land, when it is going to land, or what will be the result when it lands... but I just know it is not
going to be a pleasant experience.

Mike- good to hear from you. Our Senior Engineer Sergei Chernikov has been tracking EPA's 31.6(b) proposals, but we've
placed it on a backburner after the coal ash issd.des hit in FebrUary. Sergei did make a presentation or) 316b a few months
ago, and I'll ask him to ;send you a copy of his Powerpoint. But: we will need to regroup on implementation.

Subject: 316(b) Cooling Water Intake Rule
Hello and I hope you are doing well.
I am curious about NCDENR's position / status with the recently issued Cooling Water Intake final rule. It
reads that EPA has dumped the responsibility of implementing the rule and actually defining the Best
Technology Available ("BTA") into the lap of each State.
This site's NPDES Permit expires on October 31, 2016, so we are eligible to request an alternate schedule since
the expiration is before March 2018. In those cases I am assuming that DWR would change the due date for
submitting the applicable provisions of Section 122.21 to the following permit's expiration date, but you may
have other thoughts on this.
Will DWR consider holding a seminar on this issue? The next DWR/NCMA Water Compliance Workshop
would be a great setting for covering this topic.
It seems to me that this will be a huge undertaking for all concerned, with little guidance given in the EPA rule.
I will appreciate any thoughts you have on this rule.
