Upon review of your request for Water Quality Certification
to place fill material in 0.11 acres of wetlands or waters for
commercial site development located at Lake Crabtree near Weston
Parkway and Harrison Boulevard in Wake County, we have determined
that the proposed fill can be covered by General Water Quality
Certification No. 2671 issued January 21, 1992. A copy of the
General Certification is attached. This Certification may be
used in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 26.

The purpose of this letter is to inform you of our intention to
utilize a General 401 Water Quality Certification for the,;. project
to be known as the MCI-Telecommunications RTP property. The
property is located north of Weston Parkway and south of Lake
Crabtree. The only jurisdictional areas on-site are channels
which qualify as Waters of the U.S. with no adjacent vegetated
wetlands.
The approximate dimensions of the channels are described on'the
attached map. These delineations were reviewed by Mr. Eric
Alsmeyer of the U.S. Army Corps of Engineers. Due to the poor
quality and-small , size of the jurisdictional areas we do not
believe it is necessary to flag and survey the proposed impact
area in detail because it would be an unjust cost for our client.,
Mr. Alsmeyer agreed with this conclusion.
Fill in less than 1/3 acre of Waters of the U.S. on-site will be
required to utilize the property for a commercial development
including road access, parking: etc., similar to surrounding
properties.
It will be necessary to fill approximately 5000ft2 (.11 acre)
jurisdictional Waters of the U.S. above headwaters for placement
of the proposed facilities. The waters'to be filled are contained
within channels bounded by,uplands but still technically qualify
as jurisdictional Waters of the U.S. These areas do not appear to
be of a high quality:

We realize that our client is not required to notify 'you for fills
less than 1/3 acre above headwaters but we have chosen to do so
for the record and as a professional courtesy.

Placement of dredged or fill material in wetlands on this property without a Department of the Army
permit is in most cases a violation of Section 301 of the Clean Water Act (33 USC 1311). A permit is
not required for work on the property restricted entirely to existing high ground. If you have any
