The court's partial consent order reinforces the principle issues DEQ identified in its Sept. 5 letter to
Chemours. The court order requires Chemours to not discharge GenX to the state's waterways. The order also
requires the company to not discharge Nafion byproducts I and 2 until a state wastewater discharge permit
with appropriate permit conditions is issued. The consent order also ensures that Chemours will provide the
information DEQ requested to aid the department in protecting North Carolina's rivers.

The court issued a partial consent order Friday. The partial consent order addresses the issues the state raised
with regard to protection of surface water. The court order requires Chemours to not discharge GenX to the
state's waterways. The order also requires the company to not discharge Nafion byproducts I and 2 (noted in
the order as "PFESA") until a state wastewater discharge permit with appropriate permit conditions is issued.
The consent order also ensures that Chemours will provide the information DEQ requested to aid the
department in protecting North Carolina's rivers.

As for the question you had about groundwater, you can send those folks to me or Laura Leonard. Laura is
our public information officer for the Division of Waste Management. That division is the one that will be

I understand that Chemours sent DEQ's Division of Waste Management a "Corrective Measures Study
Work Plan" on Dec. 2, 2016. The plan seems to indicate (on page 12) that a level of 7.3 ppb of PFOA was
found in a regional aquifer on the site. That seems to be well above the EPA's public health advisory level
of .07.
Can you tell me why this plan was done and what it indicated? Also, did the level of PFOA raise any
concerns at that time?
Also, can you find out if the wells that are being test now were put in to test for C8? If so, how long have
they been there and what are the levels of C8? If not, why were they put in?
