A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 26. Additional conditions of this Certification are that water must be released form the pond from middepth to prevent low dissolved oxygen releases and that fresh (wet) concrete must not come into contact with flowing waters to prevent fish kills. Please find enclosed an application, as well as plans, for a dam and lake to serve Signal Ridge in Cashiers, North Carolina. This project is being proposed by the Carolina Investment Group. This project was previously applied for, and after several rounds of discussion and due to the size of wetlands disturbance and the likelihood that a permit would not be issued, the application was withdrawn by the owner. After careful review, the size of the wetlands disturbance has been severely reduced. We have been in contact with Mickey Clemmons of the North Carolina Wildlife Fisheries Commission and Mr. David Baker of your Asheville office concerning the project. They have both viewed the site previously. We have attempted to comply with all the comments and requirements in this application. The drainage basin for the impoundment is approximately 220± acres. This project does not connect with the adjacent Thorpe reservoir, nor is this stream under the influence of Thorpe reservoir at the proposed location. The proposed dam will be constructed in order to minimize wetlands disturbance. The owner proposes to enhance the area of wetlands as part of this development. The area surrounding the lake will remain in it's natural state in order to propagate wetlands growth. We have estimated that the areas along the edge of the lake which will become wetlands is .5 acres. Until notified that the work may proceed under the nationwide permit with any special conditions imposed by the District Engineer, or b. If notified that an individual permit may be required, or c. Holman Waters, Jr., representing the Carolina Investment Group, is requesting a letter of concurrence from the North Carolina Wildlife Resources Commission (NCWRC) to obtain a 404 permit from the-U.S. Army Corps of Engineers. The NCWRC has reviewed information provided by the applicant, and a site visit was conducted on June 29, 1992. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). The applicant proposes to construct a 19-foot dam in an unnamed tributary to Hurricane Creek (Thorpe/Glenville Reservoir), creating a reservoir of 1.98 surface acres to serve the Signal Ridge development. Approximately 0.96 acre of wetland associated with the tributary will be impacted by the project, which has been reduced from approximately 2.5 acres since the original proposal. The unnamed tributary to Hurricane Creek has a bankfull width ranging from 2 to 5 feet in the project area and substrate of gravel and sand. The tributary is extremely shallow and probably does not support fish, but provides habitat for amphibians and invertebrates. Riparian vegetation consists of ash, red maple, hemlock, and rhododendron. No habitat conditions that would likely support any endangered, threatened or special concern species were observed. Mr. Robert Johnson Page 2 July 6, 1992 The NCWRC does not object to the issuance of the permit, provided that the applicant follow these stipulations: 1) Water released from the proposed reservoir should be supplied by a coldwater release rather than surface overflow. This measure should benefit trout and coolwater species such as smallmouth bass and walleye residing in Thorpe Reservoir. 2) Construction must be accomplished so that wet concrete does not contact water entering or flowing in the unnamed tributary or Hurricane Creek.
