Beginning October 1, 2010, owners and operators of stationary diesel fuel -fired internal combustion engines that are subject to New Source Performance Standards (NSPS) Subpart IIII and have a displacement of less than 30 liters per cylinder must use diesel fuel that meets the following criteria: • Sulfur content cannot exceed 15 ppm; and • Minimum cetane index of 40 or maximum aromatic content of 35 percent by volume. The North Carolina Division of Air Quality (DAQ) has identified your facility as having equipment that may be subject to the above requirements. More information about the NSPS Subpart IIII and the diesel fuel requirements can be found in the Code of Federal Regulations; 40 CFR 60.4207 and 40 CFR 80.510(b). Owners and operators of pre-2011 model year stationary internal combustion engines that are subject to NSPS Subpart IIII and combust diesel fuel that does not meet the above fuel requirements may petition the DAQ to use the remaining "non -compliant" diesel fuel after the October 1, 2010 compliance date. The petition should include a detailed justification as to why the extension is needed. Please specify the remaining quantity of "non -complaint" fuel and the fuel usage rate in your petition. The petition must be submitted to and approved by the DAQ prior to October 1, 2010. If approved, the petition will be valid for a period of no more than six (6) months. If additional time is required to use the remaining "non -compliant" diesel fuel, then you must submit a new petition to the DAQ.
