Miller, wetlands associated with Little Limestone Creek, Duplin County, North Carolina. Professional biologists from our staff have reviewed the subject 401 water quality certification and are familiar with the subject area. This correspondence is provided in accordance with certain provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant, Michael K. Miller, proposes to construct a hog lagoon in wetlands associated with Little Limestone Creek. The excavation for the lagoon will impact a total of 1 acre. We feel that the excavation and drainage caused by this project will have serious negative impacts to fish and wildlife resources. In addition, overflow of hog lagoons into wetland areas will be detrimental to water quality in the area. We feel that the proposed lagoon should be located outside any wetland areas and that certification be denied. Thank you for the opportunity to review and comment on this application. BOX 1890 WILMINGTON, NORTH CAROLINA 28402-1890 IN REPLY REFER TO April 29, 1992 Regulatory Branch Action ID. 199201270 and Nationwide Permit-4110. 26 (Headwaters and Isolated Waters) Mr. Michael Miller Route 1, Box 255K Beulaville, North Carolina 28518 Dear Mr. Miller: Reference our letter of April 9, 1992, and your subsequent April 28, 1992, telephone conversation with Mr. Jeff Richter of my staff concerning your proposed construction of a waste lagoon and truck turn-around area at a hog operation adjacent to a tributary of Little Limestone Creek, near Beulaville, Duplin County, North Carolina. lw! On December 2, 1991, Mr. Richter met with you onsite to determine the presence of wetlands subject to our regulatory jurisdiction pursuant to Section 404 of the Clean Water Act on this approximate 1.5 acre tract. Mr. Richter determined that about half of this site did not meet our definition of wetlands, and thus stated that no authorization from this office would be required for work performed in this area. Your request of February 28, 1992, stated that a waste lagoon was to be constructed on this site. However, your recent telephone conversation with Mr. Richter revealed that you have talked with Mr. Johnny Lanier of the Duplin County Soil Conversation Service and will construct the lagoon on the area that is not wetlands. The proposed turn-around will be situated in the wetland area, impacting about; e`.`t acre. Mr. Richter has determined that this area is located in the headwaters of the Little Limestone Creek tributary. Because less than one acre of wetlands will be impacted, and work in wetlands will not be a part of the waste lagoon, your work can be authorized by our Nationwide Permit No. 26. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters provided: a. the discharge does not cause the loss of more than 10 acres of waters of the United States; Y -2- b. the permittee notifies the District Engineer if the discharge would cause the loss of waters of the United States greater than one acre in accordance with the "Notification" general condition. For discharges in special aquatic sites, including wetlands, the notification must also include a delineation of affected specific aquatic sites, including wetlands; and c. the discharge, including all attendant features, both temporary and permanent, is part of a single and complete project. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain any required State or local approval. Please be aware that impacts to greater than one third of an acre of wetlands located in headwaters may require authorization from the North Carolina Division of Environmental Management in the form of a 401 Water Quality Certification. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued, or revoked. Evans, wetlands associated with Northeast Cape Fear River, Duplin County, North Carolina. V r. 3 199?_ The Wildlife Resources Commission has reviewed the subject document and professional biologists from our staff are familiar with the habitat values of the project area. Our comments are provided in accordance with certain provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), the North Carolina Environmental Policy Act (G.S. 113A-1 et seq., as amended; 1 NCAC 25), and the Coastal Area Management Act ( G.S. 113 A-100 through 113A-128). The applicant, William K. Evans, is requesting 401 water quality certification to excavate 3 acres of wetlands to construct an airstrip. The construction will follow an existing road. Wetlands lie on either side of the road and the applicant proposes to K-G the vegetation and grass the area. As proposed, we cannot support the destruction of wetlands for airstrip construction. Wetlands provide valuable wildlife habitat and water purification and filtering properties. We ask that the certification be denied. Thank your for opportunity to comment on this project.
