Dear Mr. Cranfill:
Reference your application of July 20, 1992, for Department of the Army
authorization to install two utility lines within a confirmed Section 404
wetland located within the Pine Island Planned Unit Development, off the west
side of N.C. 12, adjacent to the Currituck Sound, approximately 3.6 miles
north of the Dare-Currituck County line, Currituck County, North Carolina.
The project as proposed will impact approximately 1,200 square feet (0.3 AC)
of Section 404 wetlands.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits (NWP).
Authorization, pursuant to Section 404 of the Clean Water Act, was provided
for the discharge of material for backfill or bedding for utility lines,
including outfall and intake structures, provided there is no change in
pre-construction contours.
Your work is authorized by this NWP provided it is accomplished in strict
accordance with the enclosed conditions. This NWP does not relieve you of the
responsibility to obtain any required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the NWP authorization is modified, reissued, or revoked. Also, this
verification will remain valid for the 2 years if, during that period, the NWP
authorization is reissued without modification or the activity complies with
any subsequent modification of the NWP authorization. If during the 2 years,
the NWP authorization expires or is suspended or revoked, or is modified, such
that the activity would no longer comply with the terms and conditions of the
NWP, activities which have commenced (i.e., are under construction) or are
under contract to commence in reliance upon the NWP will remain authorized
provided the activity is completed within 12 months of the date of the NWP's
expiration, modification or revocation, unless discretionary authority has
been exercised on a case-by-case basis to modify, suspend, or revoke the
authorization.

SUBJECT: Comments on application for Section 401 Water Quality
Certification for Nationwide 404 Permit application;
Turnpike Properties, Inc., Nationwide # 12 permit for
Utility Line Backfill and Bedding within Section 404
wetlands, Currituck County.
Biologists on our staff have reviewed the Nationwide permit
application. Turnpike Properties, Inc. has applied for a permit
to dredge two (2) 4' wide x 4' deep x 150' long trenches to place
potable water and wastewater lines. According to the agent
applying for the permit, Quible and Associates, P.C., the
proposed alignment minimizes to the fullest extent, possible
impacts to Section 404 wetlands. The North Carolina Wildlife
Resources Commission also requests that issuance of the permit be
conditional on the return of the area to pre-project elevations,
hydrology, and plant communities.

Associates, P.C., on behalf of Turnpike Properties, Inc., for a Nationwide #
12 Permit for Utility Line Backfill and Bedding within Section 404 wetlands.
The subject tract is a part of the Pine Island Planned Unit Development and
is located adjacent to the west side of NC 12 approximately 3.6 miles north
of the Dare-Currituck County line in Currituck County, North Carolina.
The permit application and enclosed plat proposes to excavate two (2) 41wide
X 4' deep X 150 long trenches within a confirmed Section 404 wetlands area
for the placement of potable water and wastewater lines to service the
central potable water and wastewater treatment systems that are permitted
for the PUD. The proposed alignment minimizes to the fullest extent
possible impacts to Section 404 wetlands and the trenches will be return to
pre-construction elevations after the utility lines are installed. As can
be seen in the enclosed plat there is no viable route for the utility lines
that does not cross wetlands at some point.

the review process as quickly as possible. I am sending a copy of this
application package to Mr. John Dorney of the N.C. Division of Environmental
Management (DEM) for his review and comments. It is my understanding from
Steve Benton that he will forward a copy to the Division of Coastal
