Following a three week outage, the site began to discharge treated wastewater from the temporary alkaline/ thermal treatment system to Outfall 001. Initial discharge would have been riverwater with very little BOD5 value. The first five BOD5 results for Outfall 001 Indicated that quantities of BOD5 were being discharged In excess of the permitted mass limits. DuPont feels confident that these results are in error either from the standpoint of Incorrect analysis or sample misidentification. See attached cover letter. The Outfall 002 BOD5 analysis for 02/19/01 was not a valid test because the depletion of dissolved oxvaen (D.O.) did not satisfy the requirement of a minimum of 2 mg/L D.O. depletion, and therefore the laboratory reported the test as being estimated, or less than, 118 mg/L BOD5, which was the analytical result with the greatest D.O. depletion. This report includes an additional DMR page for Outfall 001 to report the special monitored parameters required by the DWQ Fayetteville Regional Office. The discharge from the central Wastewater Treatment Plant (WWTP) at this site was stopped on February 2, 2001, due to an unpermitted pollutant, hexafluoroacetone hydrate, which was discovered in the WWTP. DuPont installed a temporary treatment facility to destroy the hydrate, and on February 23, 2001, the site began to discharge from this temporary facility to Outfall 001. As required by the DWQ authorization to operate the temporary facility, DuPont began monitoring Outfall 001 seven days per week for BOD5, TSS, and Oil & Grease. The analytical results for the Outfall 001 BOD5 samples for February 23 through February 28, 2001, indicated a BOD5 daily mass discharge of 348, 230, 486, 669, >127, and 50.1 pounds respectively. This resulted in an apparent monthly average of 318 lb/day BOD5 versus a permitted limit of 191.3 lb/day BOD5. The discharge of 669 lb/day BOD5 on February 26, 2001, exceeds the daily maximum limit of 508.2 lb/day BOD5. The BOD5 test performed on the sample taken on February 27, 2001, depleted the dissolved oxygen in the BOD5 sample bottles to less than 1 mg/L, thereby invalidating that test. DuPont is confident that the high BOD5 values reported on this DMR are not correct, however we have been unable to find a definitive explanation for the error. It appears that the samples that were analyzed during this period were actually untreated influent wastewater samples instead of actual Outfall 001 composite samples. Unfortunately, we have not been able to determine how such a sample identification error took place. DuPont's claim that the analysis of the high BOD5 value water was not from Outfall 001 is substantiated by the following information: 1. After the temporary alkaline/thermal treatment facility was constructed, it was filled with riverwater to allow the project team to check out the operability and mechanical integrity of the system. On 02/17/01, the project team began circulating the water through the system. E. On 02/23/01, water from the site's WWTP was first introduced to the front of the alkaline/thermal treatment facility, thereby displacing the riverwater in the system to Outfall 001. Because this facility is comprised of twelve 20,000-gallon frac-tanks, interconnected with piping, one would expect nearly plug flow of the liquid. Therefore, it would have taken nearly twenty hours before the first amount of water from the site's WWTP to reach Outfall 001, which means that the entire flow through Outfall 001 on 02/23/01 was the riverwater originally in the system. The analysis of the sample submitted as the Outfall 001 effluent for 02/23/01 indicated it contained 195 mg/L BODS, which is not consistent with either the COD analysis of that water during the check-out period, nor with historical knowledge of the water quality of the Cape Fear River. 2. During the period of the clean up of the site's WWTP, DuPont was sending its untreated process wastewater to the two Fayetteville PWC wastewater treatment plants. PWC required that DuPont submit to them a daily analysis of BODS, COD, and TSS of our influent wastewater. For the month of February 2001, the influent BODS averaged 251 mg/L, with a range of 118 mg/L to 362 mg/L BODS. The suspect Outfall 001 BODS analyses were all within this range (see below). The normal BODS values for this site range from 5 mg/L to 15 mg/L, and usually the monthly DMR contains reported values of non -detect. Therefore, these suspect values cannot be explained as merely the laboratory running the influent sample as the Outfall 001 sample and vice versa. Additional analytical results taken of Outfall 001 samples during this period supports the DuPont claim that the reported BOD5 values are incorrect. The DuPont ORC routinely analyzes Outfall 001 for COD as an internal control sample to assist him in operating the WWTP. Historically, the WWTP effluent has a BOD5 that is approximately 15% of the corresponding COD value. During the period in question, the reported BOD5 values ranged from 311% to 1225% of the ORC COD results. It is very unexpected to have COD values that are less than the BOD5 value for the same sample. Following the discovery of the suspect BOD5 values, DuPont asked that the commercial laboratory run retained samples of Outfall 001 for both BOD5 and COD. These samples were the remnants of the TSS samples for February, and had been stored in the laboratory's refrigerator in darkness at less than 4°C. While these samples obviously exceeded the hold time for BOD5 analysis, and did not have the required acidification for COD preservation, the analytical results are very informative (see below). While the Outfall 001 TSS samples greatly exceeded the hold time for a BOD5 sample, the fact that they had been stored at a nearly freezing temperature and in darkness makes it highly unlikely that subsequent biological degradation would have occurred to have dropped the BOD5, in the case of 02/25/01, from 245 mg/L to <4.7 mg/L. Therefore, this information, while not admissible on the February 2001 DMR, does support the DuPont contention that the samples analyzed for BOD5 were not actually from Outfall 001. We suspect that samples of the site's untreated influent wastewater were analyzed for BOD5 instead of the Outfall 001 effluent, however we have no substantial evidence to support this claim. The circumstantial evidence we can make reference to is the following: • The first day of discharge (02/23/01) to Outfall 001 was completely riverwater that had low measured amounts of COD and TSS, and could not have resulted in the 195 mg/L BOD5 that was reported by the laboratory. • The suspect Outfall 001 BOD5 results were all within the range of the influent BOD5 measured during that time. • Further analyses of Outfall 001 resulted in COD values that were substantially lower than the suspect BOD5 values, and analyses of retained Outfall 001 samples showed normal levels of BOD5 during this period. With regard to the apparent exceedance of the permitted monthly average, DuPont feels it is mathematically incorrect to consider the reported monthly average to be a true indication of the actual mass discharge average. The contentious issue here is the Division's disregard of periods when there is no flow from a permitted facility. During the period beginning at 6:00 p.m. on February 2, 2001, until 9:00 a.m. on February 23, 2001, there was no flow from Outfall 001, and hence there was no BOD5 mass discharge from Outfall 001. DuPont's NPDES permit requires three BOD5 samples per week, so during that period, seven BOD5 mass discharge determinations should have been made. It is intuitively obvious that the mass discharge for those days was zero (0) pounds per day. The only reason DuPont did not take a sample for BOD5 analysis during those seven days is because there was no flow of treated wastewater to sample. If the seven required monitoring days with 0 lb/day BOD5 discharge is considered, then the actual monthly average for February 2001 would be 147 lb/day BOD5, which is well under the permitted limit.
